CITY OF BRUSH! MINUTES OF THE JANUARY 22, 2018 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on January 22, 2018. Mayor Rick Bain called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Rick Bain Councilor Jeanine Anderson Councilor Marlene Baker Councilor Vicky Quinlin Councilor Daniel R. Scalise Councilor Dana Sherman Absent: Councilor Heath Becker Also present were City Administrator Monty Torres, Assistant Administrator Karen Schminke, Police Chief Travis Anderson, Finance Director Joanne Gosselink, Public Works Director Dale Colerick, Community Service Director Lance Schwindt, and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of the January 8, 2018, were approved as submitted. VISITORS AND DELEGATIONS None. MANAGEMENT Public Hearing English Annexation (petitions 1-4 inclusive) Mayor Bain opened the public hearing at 6:02 p.m. Karen Schminke provided the staff report who stated that the subject property consists of 97 plus acres and is located northeast of Brush at the northeast corner of the intersection of Colorado Highway 71 and County Road T. The Council initiated annexation proceedings by adopting a resolution at their December 11, 2017, council meeting. The public hearing has been properly noticed. She provided the annexation impact report and the Brush Agripark Development Plan. Public Comment: Chuck Miller was present and questioned why the annexation process was before the zoning process. Council Proceedings –January 22, 2018 1 Martin Ley was present and asked for clarification on the area for annexation as it relates to County Road 27 and T. Mr. Ley provided a letter he received from the City seeking his approval to annex the property. He did not respond to the letter as he was not interested in annexing into the City. He was concerned about the Highway Right of Way. Karen Schminke provided a legal opinion from the City’s Land Use Attorney Gerald Dahl who advised that the Highway Right of Way goes with the annexed municipal property. After discussing the issue it was decided to continue the public hearing. Councilor Scalise offered a motion, second by Councilor Quinlin to continue the public hearing until February 12, 2018, at 6:00 p.m. in council chambers. Public Hearing English Feed Lot Zoning Councilor Scalise offered a motion, second by Councilor Quinlin to continue the public hearing until February 12, 2018, at 6:00 p.m. in council chambers. Public Hearing Zoning Golf Course Mayor Bain opened the public hearing at 6:35 p.m. Karen Schminke provided the staff report. She stated that in August of 2017, City Council adopted an ordinance that annexed the 109 plus acre golf course property into the City of Brush; this ordinance went into effect at the end of September 2017. She further described the property and land uses. She highlighted the District Use Table in the City’s Land Use Code. She reported at a meeting in November, the Planning Commission had a brief discussion regarding the differences between the RMD and RLD zoning districts. She reported that the City intends to continue using this property as a golf course. At this time there is not a specific plan for development of the remaining acreage but there has been various conversations regarding potential residential development adjacent to the golf course. At their January 15 meeting the Planning and Zoning Commission conducted a form review of this zoning proposal. After reviewing the Future Land Use Map and comparing the perspective zoning district, the Planning Commission recommended City Council zone the 109 plus acre golf course property as Residential Medium Density (RMD) Council will need to introduce, and after first reading, approve for publication an Ordinance zoning these recently annexed lands as RMD. Comments from the public Chuck Miller was present and asked the zoning designation for property to the west. Karen responded it was Residential Low Density. Comments from Council – None. Mayor Bain closed the public hearing at 6:35 p.m. Council Proceedings –January 22, 2018 2 Ordinance No. 869-18 An Ordinance Establishing And Determining Zoning Designation For Lands Recently Annexed To The City Of Brush Known As Brush Municipal Golf Course At Petteys Park. Councilor Scalise introduced Ordinance No. 869-18. Councilor Quinlin offered a motion second by Councilor Anderson to approve the Ordinance on First Reading and publish in full. It was approved unanimously by roll call vote. Resolution No. 2018-2 Naming Signatory Authority for Bank Accounts for the City of Brush Finance Director Gosselink present new signature cards for various accounts with the City since the new City Council was sworn in. Councilor Quinlin offered a motion, second by Councilor Anderson to approve Resolution No. 2018-2, concerning Signatory Authorization for Bank Accounts. It was approved unanimously by roll call vote. Letter of Intent to Award Premier Earthworks & Infrastructure a Contract for the English Water Line Project Public Works Director Colerick presented a Letter of Intent to Award the bid to a contractor concerning the English Property Water Line. Councilor Scalise offered a motion, second by Councilor Baker to approve Letter of Intent, to award the bid for the English Water Line Project to Premier Earthworks & Infrastructure. It was approved unanimously by roll call vote. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Baker to approve City bills from January 8-22, 2018. The motion was approved unanimously by roll call vote. General Fund $ 31,741.70 Capital Improvement Fund $ 562.50 Water Fund $ 5,833.44 Trash and Garbage Fund $ 7,197.40 Waste Water Fund $ 7,826.60 Storm Water Fund $ 445.44 Golf Course Fund $ 5,433.77 Joslin Needham Fund $ 2,500.00 Payroll $ 65,940.07 Payroll Liability and Cafeteria $ 33,143.26 Disbursements Total $160,624.18 Council Proceedings –January 22, 2018 3 STAFF REPORTS Police Chief Anderson • Reported 682 Call for service • Officers are in training in Yuma • Brush Police Department developed a tactical alert program for the area law enforcement agencies to work together. • Presented a yearend report and strategic plan Public Works Director Colerick • Crews continue to clear snow from the recent storm • Reminded everyone to refer complaints to the front office so that a work order can be generated. Community Service Director Schwindt • Thanked the Joslin Needham Foundation and the Petteys Foundation for providing financial support for the various needs of the recreation department. They have donated over $400,000 for the golf course parking, carts, baseball field, Memorial Park playground equipment and basketball courts. City Clerk Strand • Announced upcoming meetings and other announcements. Administrator Torres • Reported the City had received the REDI grant contract and staff is reviewing it. It will be brought before council and an upcoming meeting. • The fire department building design team met. The City will enter into a short term lease with Susan Balderston on her building. This will be used to house the fire department equipment during the demolition and building of the new fire station. • Appreciated Police Chief Anderson informing him about snow conditions. MAYOR AND COUNCIL REPORTS Board Appointments Appoint Dan Scalise to the Historic Preservation Board Councilor Quinlin offered a motion, second by Councilor Sherman to approve the appointments as presented. It was approved unanimously by roll call vote. Reports Council Anderson • Attended the fire department building design meeting and would like to attend others if held. Council Proceedings –January 22, 2018 4  Mayor Bain Received approval by the Council to attend a new council training session this weekend for himself and Councilor Sherman.
