CITY OF BRUSH! MINUTES OF THE MARCH 12, 2018 – REGULAR CITY COUNCIL MEETING The City Council of the City of Brush, Colorado met in regular session on March 12, 2018. Mayor Rick Bain called the meeting to order at 6:00 p.m. The meeting was held at Brush City Hall. The pledge of allegiance was given. Present on roll call were: Mayor Rick Bain Councilor Jeanine Anderson Councilor Marlene Baker Councilor Heath Becker Councilor Vicky Quinlin Councilor Daniel R. Scalise Councilor Dana Sherman Absent: Also present were City Administrator Monty Torres, Assistant Administrator Karen Schminke, City Attorney Robert Chapin (arrived at 6:25 p.m.) Community Service Director Lance Schwindt, Police Chief Travis Anderson and City Clerk Andrea Strand. MINUTES The minutes of the regular meeting of the February 26, 2018, were approved as submitted. VISITORS AND DELEGATIONS Mayor Bain presented several Brush organizations with a donation from the City of Brush. Brush Community Cupboard received $1,000, accepting was Alice Carter, Deb Loose and Diane Cox. They reported that the funds are for a food bank located in the Brush United Methodist Church and open on Thursdays from 10 a.m. to 2 p.m. Brush Senior Center received $500, accepting were Carmelita Mayhugh and Betty Emerson. The funds are used for programs for seniors. Brush Area Museum received $3,500, accepting was Steve Rhode. The funds are used for operating the museum. VFW received $1500, receiving was Eric Christensen who stated the funds would be used to replace the back door, and for tables and chairs. MANAGEMENT Council Proceedings – March 12, 2018 1 Second and Final Reading of Ordinance No. 870-18, An Ordinance Amending Various Provisions Of The Brush Municipal Code To Incorporate The New Flood Insurance Study For Morgan County, Colorado, And Incorporated Areas, Dated April 4, 2018. Karen Schminke provided an overview of the public hearing held on February 26, 2018. The councilors that were not in attendance at that meeting reviewed the public hearing on the city’s website. She also mentioned a letter from FEMA that was in the council packet addressing consequences if the City did not adopt the map. Monty Torres added that a meeting will be arranged between the Brush School District Superintendent Bill Wilson, FEMA and CWCB to answer his questions about the Brush Middle School building. Council discussed the Beaver Creek Study that is currently be conducted by CWCB and expected to be completed in a few weeks. This will be presented to Council when available. Councilor Becker voiced his concern over the high cost of FEMA flood insurance and encouraged citizens to look at other sources for insurance. Councilor Anderson stated she is hopeful that other options will be available to the City once the Beaver Creek Study is completed. Councilor Anderson offered a motion, second by Councilor Quinlin to approve Ordinance No. 870-18 for second and final reading and publish by title only. It was approved unanimously by roll call vote. Deed of Perpetual Easement and Temporary Easement for Construction between the City of Brush and Public Properties Development & Leasing LLC Monty Torres presented a Deed of Perpetual Easement that necessary to begin the waterline to the Agri Park. Councilor Sherman offered a motion, second by Councilor Quinlin to approve The Deed of Perpetual Easement and Temporary Easement for Construction between the City of Brush and Public Properties Development & Leasing LLC was unanimously by roll call vote. FINANCE City Disbursements Councilor Quinlin moved, second by Councilor Scalise to approve City bills from February 26 – March 12, 2018. The motion was approved unanimously by roll call vote. General Fund $ 60,288.95 Fire Equipment Fund $ 43,313.18 Water Fund $ 39,711.94 Trash and Garbage Fund $ 12,565.70 Waste Water Fund $ 12,610.03 Storm Water Fund $ 1,601.44 Golf Course Fund $ 1,902.04 Council Proceedings – March 12, 2018 2 Community Enhancement Fund $ 6,075.61 Joslin Needham Fund $ 54,740.79 Payroll $ 63,718.34 Payroll Liability and Cafeteria $ 54,740.79 Disbursements Total $ 332,319.09 STAFF REPORTS Community Service Director Schwindt • Announced the 13th Annual Brush St. Patrick’s Day 5K starting at the Jaycee Building, followed by corn beef and cabbage and green beer. • Baseball and softball registration has started. • Backflow devices are being installed at park’s sprinkling systems. • Golf course parking lot project is progressing, expected to be completed the first week of April. • Inside painting, lighting and new doors are being installed. • Buildings by Design and the foundations of Joslin and Petteys are to be thanked for their contributions to this project. City Clerk Strand • Announced upcoming meetings and other announcements Administrator Torres • The City is expecting an annexation petition to be filed on property north of the cemetery. • A power line through Brush Prairie Ponds has been requested. MAYOR AND COUNCIL REPORTS Councilor Anderson • Received a complaint from an individual concerning motorcycle noise in her neighborhood. She contacted Chief Anderson and reported back to the individual the importance of calling the police during the noise event. • She would like items added to the Code of Conduct for Council. Those being, dress code during the CML conference, binge drinking while at the conference and that it be required to report on training. She will attend the legislative session at the conference. • She attended the Ag Appreciation Dinner sponsored by the Brush Chamber. Also attending were, Councilor Baker, Scalise, Administrator Monty Torres and City Clerk Andrea Strand. • She attended the City and County meeting hosted by Wiggins. She asked that Monty contact the Wiggins Town Administrator. Council Proceedings – March 12, 2018 3 • She would like a report on Central School and also would like to take action to encourage the school district to take back the property. Monty added that the Chamber will be reporting at the next meeting. • She reported that she is still waiting on the ACLU to respond to her complaint. • She was locked out of the community garden and is disappointed that the location did not remain a permanent location. It is being abandoned due to construction on the school district property. She felt a filing of replevin should be done. Councilor Becker • Would like school safety added to an upcoming work session as he has ideas. Board Appointments Mayor Bain presented the following board appointments: Ace Ward to the Water Advisory Board for a term ending April 2021. Ken Weisser to the Board of Adjustment for a term ending January 2019. Susanna Speers to Historic Preservation Board for a term ending January 2019. Councilor Scalise offered a motion second by Councilor Quinlin to approve the various appointments of Boards for the City of Brush. It was approved unanimously by roll call vote.
