City Manager Review: MPB Council Agenda Item No.: 1 CITY OF BUELLTON CITY COUNCIL MEETING MINUTES Regular Meeting of December 10, 2015 City Council Chambers, 140 West Highway 246 Buellton, California CALL TO ORDER Mayor Holly Sierra called the meeting to order at 6:00 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Present: Council Members Dan Baumann, John Connolly, Leo Elovitz, Vice Mayor Ed Andrisek, and Mayor Holly Sierra Staff: City Manager Marc Bierdzinski, City Attorney Steve McEwen, Finance Director Carolyn Galloway-Cooper, Lt. Shawn O’Grady, Public Works Director Rose Hess, and City Clerk Linda Reid REORDERING OF AGENDA None PUBLIC COMMENTS Kathy Vreeland, Executive Director of the Buellton Chamber of Commerce and Visitors Bureau, discussed the Winterfest event last weekend and the Chamber Installation luncheon and thanked the Council and staff for their participation. Ron Anderson, Buellton, requested that staff look into the installation of embedded crosswalk lights at the Highway 246/La Lata crosswalk. CONSENT CALENDAR 1. Minutes of November 12, 2015 Regular City Council Meeting 2. List of Claims to be Approved and Ratified for Payment to Date for Fiscal Year 2015-16 3. Proposed Calendar for 2016 City Council Meetings City Council Meeting Minutes Page 2 December 10, 2015 4. Revenue and Expenditure Reports through November 30, 2015 5. Approval of Final Map 31057 for the Village Condominiums and Acceptance of Public Easements for Emergency Access, Public Access and Trail, Water, and Sewer MOTION: Motion by Vice Mayor Andrisek, seconded by Council Member Connolly, approving Consent Calendar Items 1 through 5 as listed. VOTE: Motion passed by a roll call vote of 5-0. Council Member Baumann – Yes Council Member Connolly – Yes Council Member Elovitz – Yes Vice Mayor Andrisek – Yes Mayor Sierra – Yes PRESENTATIONS 6. Energy Watch Partnership – Survey Winners Public Works Director Hess discussed the Energy Watch Partnership program and announced the survey winners. Mayor Sierra presented the survey winners with their winning certificates. PUBLIC HEARINGS 7. Ordinance No. 15-02 – “An Ordinance of the City Council of the City of Buellton, California, Revising Title 19 (Zoning) of the Buellton Municipal Code (15-ZOA-01) by Adding Regulations Regarding a Definition of a Fast Food Restaurant and Locational Restrictions for Fast Food Restaurants” (Introduction and First Reading – Continued from October 22, 2015) RECOMMENDATION: That the City Council consider adoption of Ordinance No. 15-02. STAFF REPORT: City Manager Bierdzinski presented the staff report. DISCUSSION/WRITTEN CORRESPONDENCE RECEIVED: Correspondence regarding this item was submitted by the following individuals and made part of the record:  Susan Petrovich  Peggy Brierton  Colleen Klein  Carol Carbine  Rodney Taylor  Judi Stauffer City Council Meeting Minutes Page 3 December 10, 2015 Mayor Sierra opened the Public Hearing at 6:24 p.m. Susan Petrovich, representing James Buell, discussed her opposition to the proposed ordinance. Peggy Brierton, Buellton, spoke in support of the proposed ordinance and provided her suggested changes. Judith Dale, Buellton, discussed her opposition to the proposed ordinance and requested the City Council not approve the ordinance. Ron Anderson, Buellton, discussed his opposition to the proposed ordinance and stated the ordinance devalues property. James Buell, Reno, Nevada, discussed proposed uses of his property and his opposition to the proposed ordinance. Mayor Sierra closed the Public Hearing at 6:39 p.m. The City Council discussed the following issues:  There is sufficient control over fast food restaurants in Buellton through the existing conditional use permit process  Allowing property owners to develop their property in accordance with current rules and regulation  Revise the locations for fast food restaurants to include Dr. Buell’s property  Lack of support from the community for the proposed ordinance DOCUMENTS: Staff report with attachments as listed in the staff report. MOTION: Motion by Council Member Baumann, seconded by Vice Mayor Andrisek, denying the introduction and first reading of Ordinance No. 15-02 – “An Ordinance of the City Council of the City of Buellton, California, Revising Title 19 (Zoning) of the Buellton Municipal Code (15-ZOA-01) by Adding Regulations Regarding a Definition of a Fast Food Restaurant and Locational Restrictions for Fast Food Restaurants” by title only and waive further reading. VOTE: Motion passed by a roll call vote of 4-1. Council Member Baumann - Yes Council Member Connolly - Yes Council Member Elovitz - No Vice Mayor Andrisek - Yes Mayor Sierra - Yes City Council Meeting Minutes Page 4 December 10, 2015 8. Ordinance No. 15-03 – “An Ordinance of the City Council of the City of Buellton, California, Revising Title 19 (Zoning) of the Buellton Municipal Code (15-ZOA-03) by Adding Regulations Prohibiting Short-Term Lodging in Residential Zoning Districts” (Introduction and First Reading) RECOMMENDATION: That the City Council consider adoption of Ordinance No. 15-03. STAFF REPORT: City Manager Bierdzinski presented the staff report. DISCUSSION: Mayor Sierra opened the Public Hearing at 7:04 p.m. There being no public comment, Mayor Sierra closed the Public Hearing at 7:05 p.m. The City Council discussed the fact that staff is staying ahead of this issue and thanked them for their efforts to do so. MOTION: Motion by Vice Mayor Andrisek, seconded by Council Member Elovitz, approving the introduction and first reading of Ordinance No. 15-03 – “An Ordinance of the City Council of the City of Buellton, California, Revising Title 19 (Zoning) of the Buellton Municipal Code (15-ZOA-03) by Adding Regulations Prohibiting Short-Term Lodging in Residential Zoning Districts” by title only and waive further reading. Council Member Baumann - Yes Council Member Connolly - Yes Council Member Elovitz - Yes Vice Mayor Andrisek - Yes Mayor Sierra - Yes COUNCIL MEMBER COMMENTS Council Member Elovitz requested staff’s clarification on installing flashing crosswalk lights. City Manager Bierdzinski stated he’s awaiting the police report regarding the accident and once that’s received, staff will contact Caltrans regarding the issue and brief the Council. Vice Mayor Andrisek requested that the flashing lights remain on longer to allow pedestrians additional time to cross Highway 246. Vice Mayor Andrisek thanked the Buellton Chamber of Commerce for hosting the Chamber Installation luncheon. City Council Meeting Minutes Page 5 December 10, 2015 Council Member Baumann thanked the Buellton Chamber of Commerce and the Buellton Recreation Department for hosting the Winterfest activities last weekend. Council Member Elovitz requested that staff look into an internet connection in the Council Chambers. COUNCIL ITEMS 9. Council Reorganization A. Election of Mayor B. Election of Vice Mayor C. Presentation to Outgoing Mayor NOMINATION: Mayor Sierra nominated Vice Mayor Andrisek as Mayor. VOTE: Nomination passed by a voice vote of 5-0. Council Member Connolly - Yes Council Member Baumann - Yes Council Member Elovitz - Yes Vice Mayor Andrisek - Yes Mayor Sierra - Yes NOMINATION: Mayor Andrisek nominated Council Member Baumann as Vice Mayor. VOTE: Nomination passed by a voice vote of 5-0. Outgoing Mayor Sierra thanked her fellow Council Members, staff, and the community for providing her with support over the past year. Award of Contract for Water and Sewer Rate Study RECOMMENDATION: That the City Council award the contract for the Water and Sewer Rate Study in the amount of $64,470 to Water Consultancy and authorize the City Manager to execute that contract. STAFF REPORT: Public Works Director Hess presented the staff report. DOCUMENTS: Staff report with attachments as listed in the staff report. City Council Meeting Minutes Page 8 December 10, 2015 DISCUSSION: The City Council discussed the following issues:  How prior water and sewer rate increases were calculated  The cost of the proposed rate study  Appointing a Council Member to the rate study committee  Contact other consultants who might be interested in performing the rate study for a City the size of Buellton  Work with Water Consultancy to reduce the scope and cost of the rate study  Table this item until the next meeting for further discussion DIRECTION: The City Council agreed by consensus to table this item to the Council meeting of January 14, 2016 for further discussion. CITY MANAGER’S REPORT City Manager Bierdzinski provided an informational report to the City Council.
