City Manager Review: SW Council Agenda Item No.: 1 CITY OF BUELLTON CITY COUNCIL MEETING MINUTES Special Meeting of October 29, 2020 City Council Chambers, 140 West Highway 246 Buellton, California CALL TO ORDER Mayor Sierra called the meeting to order at 6:00 p.m. via Zoom. PLEDGE OF ALLEGIANCE ROLL CALL Present via Zoom: Council Members Ed Andrisek, Dave King, John Sanchez, Vice Mayor Art Mercado, and Mayor Holly Sierra Staff: City Manager Scott Wolfe, Public Works Director Rose Hess, Planning Technician Clare Barcelona, City Attorney Greg Murphy (via Zoom), Finance Director Shannel Zamora (via Zoom), Planning Director Andrea Keefer (via Zoom), and Contract City Planner Irma Tucker (via Zoom) PUBLIC COMMENTS Kathy Vreeland, Executive Director of the Buellton Chamber of Commerce and Visitors Bureau, submitted written comments for the record expressing concern regarding the new tabled crosswalks/speed bumps on the Avenue of Flags. PUBLIC HEARINGS - (Continued from October 22, 2020) 1. Resolution No. 20-26 - “A Resolution of the City Council of the City of Buellton, California, Approving a Final Development Plan (19-FDP-01) and Lot Line Adjustment (19-LLA-01) for the Proposed Creekside Village – Mixed-Use Development Project, Located at 480 Avenue of Flags, Assessor’s Parcel Number 137-170-042 & -043” and Ordinance No. 20-07 - “An Ordinance of the City Council of the City of Buellton, California, Approving a Development Agreement (20-DA-01) for the Creekside Village – Mixed-Use Development Project, Located at 480 Avenue of Flags and Authorizing Execution of the Agreement by the City Manager” (Introduction and First Reading) Special City Council Meeting Minutes Page 2 October 29, 2020 RECOMMENDATION: That the City Council receive public comment regarding Resolution No. 20-26 and Ordinance No. 20-07 and introduce the first reading of Ordinance No. 20-07 and adopt Resolution No. 20-26. STAFF REPORT: Contract City Planner Tucker presented the staff report. SPEAKERS/DISCUSSION: Mayor Sierra opened the continued public hearing at 6:11 p.m. Brandon Mann and Waleed Elbayar, MB Development Company, discussed the project and answered questions from the City Council. Michael Holiday, DMHA Architecture, discussed the project. Ken Hira, Kosmont Companies, discussed the project. Public comments were received and made part of the record, supporting the proposed project, from the following individuals:  Collin Dvorak  India Amarina  Rev. Mary Moreno Richardson  Kui-Xiang Li The City Council discussed the following issues:  Parking  Lack of amenities for children  Height of the proposed project There being no further public comment, Mayor Sierra closed the Public Hearing at 6:20 p.m. DOCUMENTS: Staff report with attachments as listed in the staff report. MOTION: Motion by Mayor Sierra, seconded by Vice Mayor Mercado adopting Resolution No. 20- 26 - “A Resolution of the City Council of the City of Buellton, California, Approving a Final Development Plan (19-FDP-01) and Lot Line Adjustment (19-LLA-01) for the Proposed Creekside Village – Mixed-Use Development Project, Located at 480 Avenue of Flags, Assessor’s Parcel Number 137-170-042 & -043” Special City Council Meeting Minutes Page 3 October 29, 2020 VOTE: Motion passed by a roll call vote of 5-0. Council Member Andrisek - Yes Council Member King – Yes Council Member Sanchez – Yes Vice Mayor Mercado - Yes Mayor Sierra – Yes MOTION: Motion by Mayor Sierra, seconded by Vice Mayor Mercado approving the introduction and first reading of Ordinance No. 20-07 - “An Ordinance of the City Council of the City of Buellton, California, Approving a Development Agreement (20-DA-01) for the Creekside Village – Mixed-Use Development Project, Located at 480 Avenue of Flags and Authorizing Execution of the Agreement by the City Manager” by title only and waive further reading. VOTE: Motion passed by a roll call vote of 5-0. Council Member Andrisek - Yes Council Member King – Yes Council Member Sanchez – Yes Vice Mayor Mercado - Yes Mayor Sierra – Yes CLOSED SESSION ITEMS (POSSIBLE ACTION) 2. Closed Session Pursuant to Government Code Section 54956.8 Conference with Real Property Negotiator Property: 264 La Lata Drive, Buellton, CA (APN: 099-450-012) Agency Negotiator: Scott Wolfe, City Manager Negotiating Party: ECCUMENICAL III, LLC, Property Owner Under Negotiation: Price and Terms of Payment The City Council met in closed session to discuss Item 2. No reportable action was taken. CITY OF BUELLTON SPECIAL MEETING - CITY COUNCIL AGENDA Special Meeting of October 29, 2020 – 6:00 p.m. City Council Chambers, 140 West Highway 246 Buellton, California Copies of staff reports or other written documentation relating to each item of business referred to on this Agenda are on file in the office of the City Clerk and are available for public inspection CORONAVIRUS (COVID-19) ADVISORY NOTICE Consistent with Executive Orders N-25-20 and N-29-20 from the Executive Department of the State of California and a Declaration of Local Health Emergency from the County of Santa Barbara, City Council meetings will not be physically open to the public and one or more (or even all) City Council Members may be teleconferencing into the meeting. To maximize public safety while still maintaining transparency and public access, members of the public can observe the meeting through the City’s website, via City TV Live Stream at: http://www.cityofbuellton.com/government/cityTV.php and may provide public comment by sending comments via email to council@cityofbuellton.com (reference subject matter or agenda item in the subject line of email). Please include name and address in contents of message. Comments will then be read into the record, with a maximum allowance of 3 minutes per individual comment, subject to the Mayor’s discretion. All comments should be a maximum of 500 words, which corresponds to approximately 3 minutes of speaking time. If a comment is received after the agenda item is heard but before the close of the meeting, the comment will still be included as a part of the record of the meeting but will not be read into the record.
