City Manager Review: SW Council Agenda Item No.: 1 CITY OF BUELLTON CITY COUNCIL MEETING MINUTES Regular Meeting of March 9, 2023 City Council Chambers, 140 West Highway 246 Buellton, California CALL TO ORDER Mayor King called the meeting to order at 6:05 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Present: Council Members Elysia Lewis, David Silva, Vice Mayor John Sanchez, and Mayor Dave King Absent: Council Member Hudson Hornick Staff: City Manager Scott Wolfe, Planning Director Andrea Keefer, Finance Director Shannel Zamora (via Zoom), City Clerk Linda Reid, City Attorney Greg Murphy City Attorney Murphy announced that Council Member Hornick will not be attending the Council meeting for medical reasons and opted not to use one of the Zoom exemptions defined in Assembly Bill 2449 to preserve those exemptions. REORDERING OF AGENDA None PUBLIC COMMENTS None CONSENT CALENDAR 1. Minutes of February 23, 2023 Regular City Council Meeting 2. List of Claims to be Approved and Ratified for Payment to Date for Fiscal Year 2022/2023 3. Monthly Treasurer’s Report - January 31, 2023 City Council Meeting Minutes Page 2 March 9, 2023 MOTION: Motion by Vice Mayor Sanchez, seconded by Council Member Silva, approving Consent Calendar Items 1 through 3 as listed. VOTE: Motion passed by a roll call vote of 4-0. Council Member Lewis – Yes Council Member Silva - Yes Vice Mayor Sanchez – Yes Mayor King - Yes PRESENTATIONS None PUBLIC HEARINGS None COUNCIL MEMBER COMMENTS/ITEMS Vice Mayor Sanchez requested that staff attend to, and the City Council agreed by consensus that the restriping of McMurray Road in front of the Santa Ynez Valley Marriott was important. WRITTEN COMMUNICATIONS None COMMITTEE REPORTS Vice Mayor Sanchez announced that he attended a Special Meeting for Central Coast Water Authority (CCWA) and provided an oral report for the record. Mayor King announced that he attended the Santa Barbara County Association of Governments (SBCAG) North County Sub-regional Planning Committee meeting and provided an oral report for the record. BUSINESS ITEMS 4. Discussion and Direction for Funding Buellton Senior Center RECOMMENDATION: That the City Council consider the funding request from the Buellton Senior Center. STAFF REPORT: Finance Director Zamora presented the staff report. City Council Meeting Minutes Page 3 March 9, 2023 SPEAKERS/DISCUSSION: Correspondence was received and made part of the record from Hannelore Nixon, Lompoc, supporting the Buellton Senior Center for all they do to help residents. Pam Gnekow, CEO of the Buellton Senior Center, spoke to the Council regarding her funding request and thanked them for their support. The City Council thanked the Buellton Senior Center for everything they do to help Valley residents. DOCUMENTS: Staff report with attachments as listed in the staff report. MOTION: Motion by Vice Mayor Sanchez, seconded by Council Member Lewis approving the Buellton Senior Center’s request for advance funding in the amount of $70,203 and that staff perform the appropriate budget adjustment. VOTE: Motion passed by a roll call vote of 4-0. Council Member Lewis – Yes Council Member Silva - Yes Vice Mayor Sanchez - Yes Mayor King – Yes 5. Discussion and Possible Direction Regarding Code Revisions for Appeals of Land Use Decisions RECOMMENDATION: That the City Council discuss the issue of appeals and other referrals of land use decisions and provide direction to the City Attorney’s office on the preparation of an ordinance to revise the Municipal Code related to land use appeals. STAFF REPORT: City Attorney Murphy presented the staff report. SPEAKERS/DISCUSSION: The City Council discussed the current land use appeals process. DIRECTION: The City Council agreed by consensus to direct the City Attorney to work with staff to revise the Municipal Code regarding appeals and other referrals of land use decisions. Review of Annual Comprehensive Financial Report (ACFR) for Fiscal Year Ended June 30, 2022 RECOMMENDATION: That the City Council review and file the ACFR for Fiscal Year ended June 30, 2022. STAFF REPORT: Finance Director Zamora presented the staff report. DOCUMENTS: Staff report with attachments as listed in the staff report. SPEAKERS/DISCUSSION: The City Council thanked Finance Director Zamora and her staff for their hard work on the ACFR. DIRECTION: The City Council agreed by consensus to receive and file the Annual Comprehensive Financial Report for Fiscal Year ended June 30, 2022. CITY MANAGER’S REPORT City Manager Wolfe provided an informational report for the record. CLOSED SESSION ITEMS 7. Closed Session - California Government Code Section 54957 regarding: PUBLIC EMPLOYEE PERFORMANCE EVALUATION Title: City Manager The City Council met in closed session to discuss Item 7. No reportable action was taken. 8. Closed Session - California Government Code Section 54956.9(d)(4) regarding: POTENTIAL INITIATION OF LITIGATION (1 matter) The City Council met in closed session to discuss Item 8. No reportable action was taken. 9. Closed Session – California Government Code Section 54956.9(d)(1) regarding: EXISTING LITIGATION (1 matter): City of Buellton v. Thrifty Oil Co., et al.; Santa Barbara County Superior Court Case No. 21CV02778 The City Council met in closed session to discuss Item 9. No reportable action was taken.
