City Manager Review: SW Council Agenda Item No.: 1 CITY OF BUELLTON CITY COUNCIL MEETING MINUTES Regular Meeting of October 12, 2023 City Council Chambers, 140 West Highway 246 Buellton, California CALL TO ORDER Mayor King called the meeting to order at 6:00 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Present: Council Members Hudson Hornick, Elysia Lewis, David Silva, Vice Mayor John Sanchez, and Mayor Dave King Staff: City Manager Scott Wolfe (Via Zoom), City Attorney Greg Murphy, Public Works Director Rose Hess, Finance Director Shannel Zamora (Via Zoom), Planning Director Andrea Keefer, and City Clerk Linda Reid REORDERING OF AGENDA None PUBLIC COMMENTS John Dorwin, Buellton, discussed the Rancho de Maria common area adjacent to the HUB project and stated the map recordation needs to identify the common area as belonging to Rancho de Maria and not the HUB project site. CONSENT CALENDAR 1. Minutes of September 28, 2023 Regular City Council Meeting 2. List of Claims to be Approved and Ratified for Payment to Date for Fiscal Year 2023/2024 3. Financial Report for the Fourth Quarter Ending June 30, 2023 City Council Meeting Minutes Page 2 October 12, 2023 MOTION: Motion by Council Member Silva, seconded by Council Member Hornick, approving Consent Calendar Items 1-3 as listed. VOTE: Motion passed by a roll call vote of 5-0. Council Member Hornick – Yes Council Member Lewis – Yes Council Member Silva – Yes Vice Mayor Sanchez – Yes Mayor King – Yes PRESENTATIONS None PUBLIC HEARINGS 4. Ordinance No. 23-01 – “An Ordinance of the City Council of the City of Buellton, California, Re-Adopting Chapter 8.12 of the Buellton Municipal Code Pertaining to the 2022 California Fire Code as Adopted and Amended by the County of Santa Barbara” (Second Reading) RECOMMENDATION: That the City Council consider approval of Ordinance No. 23-01. STAFF REPORT: City Manager Wolfe presented the staff report. SPEAKERS/DISCUSSION: Mayor King opened the public hearing at 6:06 p.m. There being no public comment, Mayor King closed the Public Hearing at 6:07 p.m. DOCUMENTS: Staff report with attachments as listed in the staff report. MOTION: Motion by Council Member Lewis, seconded by Council Member Silva approving Ordinance No. 23-01 – “An Ordinance of the City Council of the City of Buellton, California, Re-Adopting Chapter 8.12 of the Buellton Municipal Code Pertaining to the 2022 California Fire Code as Adopted and Amended by the County of Santa Barbara” by title only and waive further reading. Council Member Hornick - Yes Council Member Lewis – Yes Council Member Sanchez – Yes Council Member Silva – Yes Mayor King – Yes COUNCIL MEMBER COMMENTS/ITEMS Council Member Hornick questioned the HUB project map recordation and that the map identify the common area between the HUB project site and Rancho de Maria as belonging to Rancho de Maria and not the project site. City Attorney Murphy explained how the map recordation will rectify the common area issue between Rancho de Maria and the HUB developer and that the developer is aware of the common area fencing change and plans to comply with the property line as it exists. Council Member Hornick questioned the status of the speed trailer being replaced on the Avenue of Flags. Public Works Director Hess stated that the speed trailer should be back on the Avenue of Flags during the week of October 16. Council Member Hornick requested that staff agendize discussion of the Urban Growth Boundary. WRITTEN COMMUNICATIONS None COMMITTEE REPORTS Vice Mayor Sanchez announced that he attended an Arts and Culture Committee meeting and provided an oral report for the record. Mayor King announced that he attended the Santa Barbara County Association of Governments (SBCAG) North County Sub-Regional Planning Committee meeting and provided an oral report for the record. BUSINESS ITEMS 5. Discussion Regarding Splash Pads City Attorney Murphy discussed Council Member Silva’s potential conflict of interest with regard to Item 5, due to the proximity of his residence to the proposed project location at Village Park and phasing the discussion to allow his participation until an actual conflict occurs. City Council Meeting Minutes Page 4 October 12, 2023 RECOMMENDATION: That the City Council discuss this item and provide direction to staff. STAFF REPORT: Public Works Director Hess presented the staff report. SPEAKERS/DISCUSSION: Written comments supporting Splash Pads in Buellton were received and made part of the record from the following individuals: Issa Lavoie, Erika Whitham Garcia, Pam Andrade, Maeve Willis, Kristen Roylance, Sarah Kiser, Lydia Lombard, Megan DeCicco, Jonathan Roylance, Susan Sorensen, Allison Firey, Nicole Leite, Jennelle Rodriguez, Kate Finlinson, Jill DePalma, Lillie Francis, Joanna McLean, Phil Hauck, Sara Matteson, Rachelle Anderson, Shawna Jones, Samantha Whicker, Esther Hundley, Emily Campbell, Luis Andrade, Thamara Fleming, Kelly Herrick, and Kaitlyn Humphrey. The City Council discussed the following issues: • Annual maintenance costs associated with Splash Pads • Obtaining various designs and costs for Splash Pads • Making the Splash Pads ADA accessible • Available funding for the project DIRECTION: The City Council agreed by consensus to direct staff to obtain various designs and costs associated with installation and maintenance of Splash Pads and reagendize this item for discussion and possible action at a future meeting. CITY MANAGER’S REPORT City Manager Wolfe provided an informational report for the record.
