City of Bulverde, Texas City Council Meeting Tuesday, May 13, 2025 Meeting Duration: 6:30 PM to 10:01 PM CALL THE MEETING TO ORDER Mayor Bill Krawietz called the meeting to order at 6:30 PM. Ham, Chief of Police Gary Haecker, Public Works Director Aaron Martinez, and Finance Director Sharon Nelson CANVAS OF ELECTION, ADMINISTRATION OF OATHS, AND RECOGNITION OF OUTGOING OFFICERS 2.A. Discuss and consider approval of a resolution canvassing the returns and declaring the results of the General and Special Election held on May 3, 2025. Motion: Mayor Krawietz made a motion seconded by Council Member, Place 4 Hays to approve a resolution canvassing the returns and declaring the results of the General and Special Election held on May 3, 2025. Vote: Motion carried (6) ayes to (0) nays. Resolution #356 2.B. Issue Certificates of Election and Administer the Oath of Office to the Mayor, and City Council Members Places 1, 2, and 3 of the Home Rule City of Bulverde, Texas. City Secretary Sandra V. Ham issued the Certificates of Election and administered the Oaths of Office to Mayor Helen Hays and City Council Members Jason Krawietz, Francesca Watson, and Ted Hawkins. Page 1 of 7 2.C. Presentation in Recognition of Service to Late Council Member Place 3 Charles Hughes. Interim City Manager Danny Batts presented a plaque of recognition to Karen Hughes, wife of the late Council Member Place 3 Charles Hughes. 2.D. Presentation in Recognition of Service to Outgoing Mayor Bill Krawietz, Council Member Place 1 Mark Morkovsky, and Council Member Place 2 Yvonne Chapman. Interim City Manager Danny Batts presented a plaque of recognition to Outgoing Mayor Bill Krawietz, Council Member Place 1 Mark Morkovsky, and Council Member Place 2 Yvonne Chapman Mayor Helen Hays called for a brief recess at 6:43 PM in honor of incoming and outgoing elected officials. Regular session reconvened at 6:54 PM. REPORTS AND PRESENTATIONS 3.A. Presentation of a Proclamation in recognition of Community Action Month and Community Council of South Central Texas, Inc. (CCSCT) as a Community Action Agency. Mayor Helen Hays presented a Proclamation in recognition of Community Action Month and in recognition of Community Council of South Central Texas, Inc. as a Community Action Agency. 3.B. Presentation of a Proclamation in recognition of Motorcycle Safety Awareness Month. Mayor Helen Hays presented a Proclamation in recognition of Motorcycle Safety Awareness Month. 3.C. Presentation of a Proclamation in recognition of National Public Works Week as May 18, 2025 to May 24, 2025. Mayor Helen Hays presented a Proclamation in recognition of National Public Works Week to the City of Bulverde Public Works Department. 3.D. Police Department: Summary of April 2025 Activities Report given by Police Chief Gary Haecker. 3.E. Finance Department: Monthly Financial Report No report given. 3.F. Public Works Department: Summary of April 2025 Activities Report given by Public Works Director Aaron Martinez. 3.G. Planning Department Update: Summary of April 2025 Activities Report given by Planning Director Danny Batts. 3.H. Parks & Recreation: Report from Parks & Recreation Advisory Board Page 2 of 7 Report given by Parks & Recreation Advisory Board Chair Rebekah Hays. 3.I. Economic Development Foundation: Report for April 2025 Report given by Executive Director Paula Stakes. CONSENT AGENDA ITEMS 4.A. Consider approval of the Regular City Council Meeting Minutes from April 8, 2025. 4.B. Consider approval of the Special City Council Meeting Minutes from the following special meeting dates: a. April 15, 2025 b. April 17, 2025 c. April 22, 2025 d. April 24, 2025 4.C. Receive the City of Bulverde Investment Summary Report as of March 31, 2025. 4.D. Consider approval of a resolution adding Interim City Manager Danny Batts as signer of the City of Bulverde’s bank accounts. Resolution #357 4.E. Consider approval of a resolution appointing Mandy Barrios as Municipal Court Clerk. Resolution #358 Motion: Council Member Place 4 Hays made a motion seconded by Council Member, Place 5 Alexandre to approve the Consent Agenda. Vote: Motion carried (6) ayes to (0) nays. REGULAR AGENDA ITEMS 5.A. Discuss and consider electing one member of the City Council to serve as Mayor Pro Tem for the 2025-2026 term. Motion: Mayor Hays made a motion seconded by Council Member, Place 3 Hawkins to elect Council Member, Place 5 Alexandre to serve as Mayor Pro Tem for the 2025-2026 term. Vote: Motion carried (6) ayes to (0) nays. 5.B. Consider and take possible action regarding a request from Waste Connections Lone Star, Inc. to increase rates for solid waste disposal for customers within the city limits. Page 3 of 7 Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 1 Krawietz to approve a request from Waste Connections Lone Star, Inc. to increase rates for solid waste disposal for customers within the city limits. Vote: Motion carried (6) ayes to (0) nays. 5.C. Discuss and consider a recommendation from the Parks & Recreation Advisory Board for the establishment of a Monarch Butterfly Way Station at the Bulverde Community Park. Motion: Council Member, Place 3 Hawkins made a motion seconded by Council Member, Place 2 Watson to approve the establishment of a Monarch Butterfly Way Station at the Bulverde Community Park. Vote: Motion carried (6) ayes to (0) nays. 5.D. Presentation and discussion on data collection for road assessments and direction to staff on next steps. Direction was provided to staff to move forward with an agreement for data collection for road assessments, under the City Manager authorization. 5.E. Hold a public hearing and consider approval of an ordinance granting a variance to Ch. 10A, Section 4.08, related to Riparian Buffers, of the City of Bulverde Code of Ordinances, on 0.83-acres located at the northeast intersection of Bulverde Road and Heimer Cove, Bulverde, TX, 78163, for the construction of a proposed drive- through restaurant. Mayor Hays opened the Public Hearing at 8:11 PM. One comment was received by Council. Mayor Hays closed the Public Hearing at 8:14 PM. Motion: Mayor Hays made a motion seconded by Council Member, Place 4 Hays to deny an ordinance granting a variance to Ch. 10A, Section 4.08, related to Riparian Buffers, of the City of Bulverde Code of Ordinances, on 0.83-acres located at the northeast intersection of Bulverde Road and Heimer Cove, Bulverde, TX, 78163, for the construction of a proposed drive-through restaurant. Vote: Motion carried (5) ayes to (1) nay, Council Member, Place 3 Hawkins opposed. 5.F. Hold a public hearing and consider approval of an ordinance granting a variance to Section 17.04.004, related to Fills, of the City of Bulverde Code of Ordinances, on 1.936-acres located at 21 Inverness Court, Bulverde, TX, 78163, for the construction of a retaining wall for a terrace and swimming pool. Mayor Hays opened the Public Hearing at 8:27 PM. There being no one wishing to speak, the public hearing was immediately closed. Motion: Council Member, Place 3 Hawkins made a motion seconded by Council Member, Place 1 Krawietz to approve an ordinance granting a variance to Page 4 of 7 Section 17.04.004, related to Fills, of the City of Bulverde Code of Ordinances, on 1.936-acres located at 21 Inverness Court, Bulverde, TX, 78163, for the construction of a retaining wall for a terrace and swimming pool. Vote: Motion carried (6) ayes to (0) nays. Ordinance #805 5.G. Hold a public hearing and consider an ordinance of the City of Bulverde, Texas approving a Special Use Permit at 2545 Bulverde Road, Bulverde, TX 78163, to permit the operation of four (4) food trucks as an accessory use; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Mayor Hays opened the Public Hearing at 8:38 PM. Two comments were received by Council. Mayor Hays closed the Public Hearing at 8:41 PM. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Watson to approve an ordinance approving a Special Use Permit at 2545 Bulverde Road, Bulverde, TX 78163, to permit the operation of four (4) food trucks as an accessory use; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Vote: Motion carried (6) ayes to (0) nays. Ordinance #806 5.H. Hold a public hearing and consider an ordinance of the City of Bulverde, Texas approving a Special Use Permit at 29768 Bulverde Lane, Bulverde, TX 78163, to permit the operation of indoor batting cages; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Mayor Hays opened the Public Hearing at 8:48 PM. There being no one wishing to speak, the public hearing was immediately closed. Motion: Council Member, Place 5 Alexandre made a motion seconded by Council Member, Place 4 Hays to approve an ordinance approving a Special Use Permit at 29768 Bulverde Lane, Bulverde, TX 78163, to permit the operation of indoor batting cages; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Vote: Motion carried (6) ayes to (0) nays. Ordinance #807 5.I. Hold a public hearing and consider an ordinance of the City of Bulverde, Texas approving a Special Use Permit at 5163 Hawk Eye Dr, Bulverde, TX 78163, to permit the operation of a guest house; amending the zoning ordinance; directing the Page 5 of 7 amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Mayor Hays opened the Public Hearing at 8:59 PM. There being no one wishing to speak, the public hearing was immediately closed. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Watson to approve an ordinance approving a Special Use Permit at 5163 Hawk Eye Dr, Bulverde, TX 78163, to permit the operation of a guest house; amending the zoning ordinance; directing the amendment of the zoning map; repealing conflicting ordinances; and providing a severability clause and an effective date. Vote: Motion carried (6) ayes to (0) nays. Ordinance #808 PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Helen Hays opened the meeting for public comments not related to posted agenda items at 9:05 PM. Seven (7) comments were received by Council. Mayor Hays closed the public comments at 9:20 PM. REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST Council Member, Place 5 Alexandre commented that any concerns with the school district should be directed to Comal ISD. EXECUTIVE (CLOSED) SESSION At 9:23 PM the City Council convened into Executive Session to discuss the following: The City Council will convene into executive session as follows: 8.A. Pursuant to Texas Government Code Section 551.074, the City Council will deliberate in Executive (Closed) Session to deliberate the appointment, employment, evaluation, and duties of the Interim City Manager. 8.B. The City Council will meet in Executive (Closed) Session to deliberate the appointment / reappointment or removal of members of the Zoning Board of Adjustment, Planning & Zoning Commission, and Parks & Recreation Advisory Board. 8.C. The City Council will meet in Executive (Closed) Session to seek the advice of legal counsel about pending or contemplated litigation, to discuss a settlement offer, or on matters in which the duty of the attorney to the City Council under the Texas Rules of Professional Conduct conflict with the Texas Open Meetings Act; to wit: i. Legal Issues related to the current land use and court case at the Oak Village North Fire Station. Page 6 of 7 ii. Franco et al v. City of Bulverde et al; Civil Action No. 5:24-cv-708-OLG, US District Court, Western District of Texas. At 10:01 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. No Action Taken.
