Discuss and consider termination of the Economic Development Services Agreement between the City of Bulverde and the Bulverde / Spring Branch Economic Development Foundation, in accordance with the terms and conditions of the agreement. Motion: Council Member, Place 6 Goth made a motion to table the termination of the Economic Development Services Agreement between the City of Bulverde and the Bulverde / Spring Branch Economic Development Foundation, in accordance with the terms and conditions of the agreement. Motion failed due to lack of a second. Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 4 Hays to terminate the Economic Development Services Agreement between the City of Bulverde and the Bulverde / Spring Branch Economic Development Foundation, in accordance with the terms and conditions of the agreement. Vote: Motion carried (6) ayes to (1) nay, Council Member, Place 6 Goth opposed. Page 1 of 2 2.B. Discuss and consider approval of an ordinance of the City of Bulverde, Texas, amending the Budget for Fiscal Year 2024-2025; repealing conflicting ordinances; providing a severability clause; and providing an effective date. Motion: Council Member, Place 5 Alexandre made a motion seconded by Council Member, Place 6 Goth to approve an ordinance of the City of Bulverde, Texas, amending the Budget for Fiscal Year 2024-2025; repealing conflicting ordinances; providing a severability clause; and providing an effective date. Vote: Motion carried (7) ayes to (0) nays. Ordinance #809 EXECUTIVE (CLOSED) SESSION At 8:14 PM the City Council convened into Executive Session to discuss the following: The City Council will convene into executive session as follows: 3.A. Pursuant to Government Code 551.074, the City Council will deliberate in Executive (Closed) Session regarding Personnel Matters pertaining to the positions appointed by the City Council under the City Charter (City Manager, City Attorney, and Municipal Court Judge). At 9:10 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. No Action Taken. Council Member, Place 4 Hays left the Special City Council Meeting at 9:10 PM. CITY COUNCIL ITEM: MEETING DATE: May 29th, 2025 DEPARTMENT: Administration AGENDA ITEM: Discuss and consider termination of the Economic Development Services Agreement between the City of Bulverde and the Bulverde/Spring Branch Economic Development Foundation, in accordance with the terms and conditions of the agreement. PRESENTED BY: Danny Batts, Interim City Manager SUMMARY: This item was placed on the Agenda by the Mayor. A copy of the Economic Development Services Agreement is attached to this report. Any termination becomes effective after 90 days under the terms of the agreement. CITY COUNCIL ITEM: Budget Amendment MEETING DATE: May 29th, 2025 DEPARTMENT: Administration AGENDA ITEM: Discuss and consider approval of an ordinance of the City of Bulverde, Texas, amending the Budget for Fiscal Year 2024-2025; repealing conflicting ordinances; providing a severability clause; and providing an effective date. PRESENTED BY: Danny Batts, Interim City Manager SUMMARY: The City’s Parks & Recreation budget is currently projected to exceed appropriated funds by $60,500 by the end of the Fiscal Year. This is due to cost overruns associated with creating a wildflower zone in the park, wildlife damage to that zone, and higher than anticipated water bills. City staff are proposing to transfer excess funds resulting from salary savings (i.e. vacant positions) to cover these expenses. The vacant positions, which will remain vacant for the remainder of the fiscal year, are the Code Enforcement Officer and Executive Assistant positions. The Code Enforcement Officer was contained in its own department in the budget, so we are zeroing out all line items in that department for the remainder of this Fiscal Year. Because the funds are being shifted between departments (Administration and Code Enforcement to Parks & Recreation), City Council authorization is required. The transfers that are being authorized are listed below. ORDINANCE NO. _____________ AN ORDINANCE OF THE CITY OF BULVERDE, TEXAS AMENDING THE BUDGET FOR FISCAL YEAR 2024-2025; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council adopted the Budget for Fiscal Year 2024-2025 as Ordinance No. 768 (the “2024-25 Budget”); WHEREAS, the City Council has determined that the 2024 Budget should be changed for municipal purposes as allowed by Texas Local Government Code § 102.010 to be consistent with the Proposed Adjusted Budget 2024-25 attached hereto as Attachment A; WHEREAS, the City Council finds and determines that the passage of this Ordinance promotes the health, safety, and welfare of the public and the City of Bulverde; and WHEREAS, the City Council finds and determines that the meeting at which this Ordinance was passed was open to the public, that public notice of the time, place and purpose of said meeting was given as required by the Texas Open Meetings Act, Chapter 551, Texas Government Code; and that the City of Bulverde complied with all other requirements; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BULVERDE, TEXAS THAT: 1. Findings of Fact. The foregoing recitals are incorporated into this Ordinance by reference as findings of fact as if expressly set forth herein. 2. Enactment. The 2024-25 Budget is amended to be consistent with the Proposed Adjusted Budget 2024-25 attached hereto as Attachment A; the changes to individual line items and accounts that require City Council authorization are further described in Attachment “B” (City Council Authorized Changes). 3. Repealer. All ordinances, resolutions, or parts thereof that are in conflict or are inconsistent with any provision of this Ordinance are hereby repealed to the extent of such conflict or inconsistency, and the provisions of this Ordinance shall be and remain controlling as to the matter regulated herein. 4. Severability. Should any section, subsection, sentence, provision, clause or phrase be held to be invalid for any reason, such holding shall not render invalid any other section, subsection, sentence, provision, clause, or phrase of this ordinance and same are deemed severable for this purpose. 5.
