City of Bulverde, Texas City Council Meeting Tuesday, June 10, 2025 Meeting Duration: 6:31 PM to 11:02 PM CALL THE MEETING TO ORDER Mayor Helen Hays called the meeting to order at 6:31 PM. Members of City Council Present: Mayor Helen Hays Council Member Jason Krawietz, Place 1 Council Member Francesca Watson, Place 2 Council Member Ted Hawkins, Place 3 Council Member Clint Hays Place 4 Mayor Pro Tem Joe Alexandre, Place 5 (arrived 6:37 PM) Members of City Council Absent: Council Member Christopher Goth, Place 6 City Staff Present: Interim City Manager / Planning Director Danny Batts, City Attorney Matthew Grove, City Secretary Sandra V. Ham, Chief of Police Gary Haecker, Public Works Director Aaron Martinez, and Finance Director Sharon Nelson REPORTS AND PRESENTATIONS 2.A. Police Department: Summary of May 2025 Activities Report given by Police Chief Gary Haecker. 2.B. Finance Department: Monthly Financial Report No report given. 2.C. Public Works Department: Summary of May 2025 Activities Report given by Public Works Director Aaron Martinez. 2.D. Planning Department Update: Summary of May 2025 Activities Report given by Planning Director Danny Batts. 2.E. Parks & Recreation: Report from Parks & Recreation Advisory Board Report given by Parks & Recreation Advisory Board Chair Rebekah Hays. CONSENT AGENDA ITEMS 4.A. Consider approval of the Regular City Council Meeting Minutes from May 13, 2025. 4.B. Consider approval of the Special City Council Meeting Minutes from May 29, 2025. Page 1 of 5 Motion: Council Member Place 4 Hays made a motion seconded by Council Member, Place 5 Alexandre to approve the Consent Agenda. Vote: Motion carried (6) ayes to (0) nays. REGULAR AGENDA ITEMS 4.A. Discuss and consider approval of a request by Mechelle Salmon, on behalf of the H.I.S. Centre, for a Parks Special Use Permit to host a Freedom Run on July 4, 2025, at the City of Bulverde Community Park. Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 1 Krawietz to approve an ordinance approving a request by Mechelle Salmon, on behalf of the H.I.S. Centre, for a Parks Special Use Permit to host a Freedom Run on July 4, 2025, at the City of Bulverde Community Park Vote: Motion carried (6) ayes to (0) nays. Ordinance #809 4.B. Discuss and consider direction to staff regarding the 2025 Right-of-Way Maintenance Program. Public Works Director Aaron Martinez provided a presentation on the 2025 Right-of-Way Maintenance Program. Staff was requested to move forward on the program as directed. 4.C. Discuss and consider direction to staff regarding the 2025 Bar Ditch and Culvert Maintenance Program. Public Works Director Aaron Martinez provided a presentation on the 2025 Bar Ditch and Culvert Maintenance Program. Staff was directed to continue future discussions on the program. 4.D. Presentation by the Bulverde Police Department referencing a grant from the State of Texas for Flock Cameras within the City. Chief Gary Haecker provided a presentation on the Flock Camera system. 4.E. Discuss and consider approval of an ordinance of the City of Bulverde, Texas, amending the Budget for Fiscal Year 2024-2025; repealing conflicting ordinances; providing a severability clause; and providing an effective date. Motion: Council Member Place 4 Hays made a motion seconded by Council Member, Place 5 Alexandre to approve an ordinance of the City of Bulverde, Texas, amending the Budget for Fiscal Year 2024-2025. Vote: Motion carried (6) ayes to (0) nays. Ordinance #810 Page 2 of 5 4.F. Hold a public hearing and consider the approval of an ordinance granting a variance to Section 3.08.102(a)(2), Section 3.08.102(a)(3), and Section 3.08.132(8) of the City of Bulverde Code of Ordinances, at 20779 State Hwy 46 Bulverde, TX 78163. Mayor Hays opened the Public Hearing at 8:44 PM. There being no one wishing to speak, the public hearing was immediately closed. Motion: Council Member, Place 4 Hays made a motion seconded by Council Member, Place 2 Watson to approve an ordinance granting a variance to Section 3.08.102(a)(2), Section 3.08.102(a)(3), and Section 3.08.132(8) of the City of Bulverde Code of Ordinances, at 20779 State Hwy 46 Bulverde, TX 78163, as amended by City Council. Vote: Motion carried (6) ayes to (0) nays. Ordinance #811 4.G. Hold a public hearing and consider the approval of an ordinance granting a variance to Section 3.08.102(a)(3) and Section 3.08.102(a)(4) of the City of Bulverde Code of Ordinances, at 427 Singing Oaks, Spring Branch, TX 78070. Mayor Hays opened the Public Hearing at 8:59 PM. There being no one wishing to speak, the public hearing was immediately closed. Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 3 Hawkins to table approval of an ordinance granting a variance to Section 3.08.102(a)(3) and Section 3.08.102(a)(4) of the City of Bulverde Code of Ordinances, at 427 Singing Oaks, Spring Branch, TX 78070. Vote: Motion carried (6) ayes to (0) nays. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Mayor Helen Hays opened the meeting for public comments not related to posted agenda items at 9:11 PM. There being no one wishing to speak, the public comments were immediately closed. REPORTS BY ELECTED OFFICIALS AND CITY STAFF ON ITEMS OF COMMUNITY INTEREST None. EXECUTIVE (CLOSED) SESSION At 9:14 PM the City Council convened into Executive Session to discuss the following: 7.A. Pursuant to Tex. Gov’t Code Ann. § 551.074 (Personnel Matters), Personnel Matters, the City Council will deliberate in Executive (Closed) Session to deliberate the appointment, employment, evaluation, and duties of the Interim City Manager. 7.B. Pursuant to Tex. Gov’t Code Ann. § 551.074 (Personnel Matters), Personnel Matters, the City Council will meet in Executive (Closed) Session to deliberate the Page 3 of 5 appointment / reappointment or removal of members of the Zoning Board of Adjustment, Planning & Zoning Commission, and Parks & Recreation Advisory Board. 7.C. Pursuant to Tex. Gov’t Code Ann. § 551.071 (Consultation with Attorney) the City Council will meet in private consultation with legal counsel to seek the advice of its attorneys about pending or contemplated litigation, a settlement offer, and/or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas conflicts with Chapter 551 of the Government Code; to wit: i. Update and receive advice on pending litigation, Franco & Huerta v. City of Bulverde, Texas and Charles West, CA No 5:24-CV-00708-OLG, In the United States District Court, Western District of Texas – San Antionio Division. ACTIONS ITEMS AFTER EXECUTIVE (CLOSED) SESSION At 10:58 PM the City Council reconvened from Executive Session and took the following action on items discussed in Executive Session. 8.A. Consider and take possible action on appointing / reappointing members to the Zoning Board of Adjustment and on the appointment of the Zoning Board of Adjustment Chair and Vice Chair. Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 4 Hays to appoint / reappoint the following members to the Zoning Board of Adjustment: Reappoint to two-year term (Term set to expire June 2027) Mike Ashmore Alyssa Hix Appoint to two-year term (Term set to expire June 2027) Sharon Parson Within the same motion, Council motioned to appoint Kevin Hardwick as Chair and Mike Ashmore as Vice Chair of the Board of Adjustment. Vote: Motion carried (6) ayes to (0) nays. 8.C Consider and take possible action on appointing / reappointing members to the Planning & Zoning Commission. Motion: Council Member, Place 5 Alexandre made a motion seconded by Council Member, Place 2 Watson to appoint / reappoint the following members to the Planning & Zoning Commission: Reappoint to two-year term (Term set to expire June 2027) Jeffrey Burrier James Flavin Michelle Molina Page 4 of 5 Fred Perry Appoint to one-year term (Term set to expire June 2026) Jason Ewing (Alternate) Vote: Motion carried (6) ayes to (0) nays. 8.D Consider and take possible action on appointing / reappointing members to the Parks & Recreation Advisory Board. Motion: Council Member, Place 2 Watson made a motion seconded by Council Member, Place 5 Alexandre to appoint / reappoint the following members to the Parks & Recreation Advisory Board: Appoint to one-year term (Term set to expire June 2026) Jessica Croll Shannon Ewing Laura Gottlieb Rebekah Hays, Chair Angie Krawietz Dominic Perez Tiffany Rider Vote: Motion carried (4) ayes, (0) nays, and (2) abstentions, with Council Members Place 1 Krawietz and Place 4 Hays abstaining.
