City of Bulverde, Texas Planning & Zoning Commission Meeting Thursday, August 15, 2024 Meeting Duration: 6:01 PM to 7:40 PM CALL THE MEETING TO ORDER Chair Ted Hawkins called the meeting to order at 6:01 PM. Members of Planning & Zoning Commission Present: Chair Ted Hawkins Vice Chair Ashley Cartier Commissioner James Flavin Commissioner Michelle Molina Commissioner Gregory Porter Commissioner Jeffrey Burrier Commissioner Brad McCollum (arrived at 6:03pm) Commissioner Fred Perry (Alternate) Members of Planning & Zoning Commission Absent: City Staff Present: City Manager Charles West, Planner I Heath Edwards, Planner I Bailey Dorn, and City Secretary Sandra V. Ham REGULAR AGENDA ITEMS 2.I. Consider and take action on the Election of the Planning & Zoning Commission Chair and Vice Chair. Motion: Commissioner Porter made a motion seconded by Commissioner Molina to election Ted Hawkins as Chair and Ashley Cartier as Vice Chair of the Planning & Zoning Commission. Vote: Motion carried (5) ayes, (0) nays, (1) abstain, with Chair Hawkins abstaining. 2.II. Consider approval of the Planning and Zoning Commission Meeting Minutes from July 11, 2024. Motion: Commissioner Molina made a motion seconded by Commissioner Burrier to approve the Planning and Zoning Commission meeting minutes from July 11, 2024. Vote: Motion carried (6) ayes to (0) nays. Commissioner McCollum entered the meeting at 6:03pm. 2.III. Hold a public hearing and consider a request by Jay Fries for the approval of a Special Use Permit to allow a Guest House as an accessory use on an  approximately 1.82-acre tract of land at 31086 Smithson Valley Road, Bulverde, TX 78163. Chair Hawkins opened the public hearing at 6:06PM. There being no one wishing to speak, the Public Hearing was immediately closed. Motion: Chair Hawkins made a motion seconded by Commissioner Flavin to recommend approval of a request by Jay Fries for the approval of a Special Use Permit to allow a Guest House as an accessory use on an approximately 1.82-acre tract of land at 31086 Smithson Valley Road, Bulverde, TX 78163. Vote: Motion carried (7) ayes to (0) nays. 2.IV. Hold a public hearing and consider a request by Litterio Zinna with A & L Land Investments LLC, for a zone change from R-2 Residential District to PDD Planned Development District, with a base zoning of C-2 Commercial District, for approximately 2.08 acres, generally located 175 feet southwest of the intersection of FM 1863 and Roadrunner Way. Chair Hawkins opened the Public Hearing at 6:23 PM. Six (6) comments were received by the Commission. Chair Hawkins closed the public hearing at 6:40 PM. Motion: Vice Chair Cartier made a motion seconded by Commissioner McCollum to recommend denial of a request by Litterio Zinna with A & L Land Investments LLC, for a zone change from R-2 Residential District to PDD Planned Development District, with a base zoning of C-2 Commercial District, for approximately 2.08 acres, generally located 175 feet southwest of the intersection of FM 1863 and Roadrunner Way. Vote: Motion carried to recommend denial (6) ayes, (0) nays, (1) abstain, with Commissioner Porter abstaining. 2.V. Consider a request by Brittany Fernandez with HFA Architecture + Planning, on behalf of Walmart, for a variance to Section 3.08.102(a)(1), Section 3.08.102(a)(3), Section 3.08.132(8)(B)(i)(a), and Section 3.08.132(8)(B)(i)(b) of the City of Bulverde Code of Ordinances, at 305 Singing Oaks, Spring Branch, TX 78070. Motion: Vice Chair Cartier made a motion seconded by Commissioner Burrier to recommend denial of request by Brittany Fernandez with HFA Architecture + Planning, on behalf of Walmart, for a variance to Section 3.08.102(a)(1), Section 3.08.102(a)(3), Section 3.08.132(8)(B)(i)(a), and Section 3.08.132(8)(B)(i)(b) of the City of Bulverde Code of Ordinances, at 305 Singing Oaks, Spring Branch, TX 78070. Vote: Motion carried to recommend denial (7) ayes to (0) nays. 2.VI. Vote: Motion carried (7) ayes to (0) nays. 2.VII. Consider a request by Executive Signs, on behalf of Methodist, for a variance to Section 3.08.102(a)(2), Section 3.08.102(a)(3), and Section 3.08.102(j) of the City of Bulverde Code of Ordinances, at 20475 SH 46 W, Ste. 100, Spring Branch, TX 78070. Motion: Commissioner Porter made a motion seconded by Vice Chair Cartier to recommend approval of a request by Executive Signs, on behalf of Methodist, for a variance to Section 3.08.102(a)(2), Section 3.08.102(a)(3), and Section 3.08.102(j) of the City of Bulverde Code of Ordinances, at 20475 SH 46 W, Ste. 100, Spring Branch, TX 78070 Vote: Motion carried (7) ayes to (0) nays. 2.VIII. Consider a request by Pedro Diaz for a variance to Sections 17.03.005, 17.04.003, and 17.04.004 related to Cuts and Fills and Disturbance within Steep Slope, of the City of Bulverde Code of Ordinances, on 3.174 acres located at 4360 US HWY 281 N, Spring Branch, TX 78070. Motion: Chair Hawkins made a motion seconded by Commissioner Molina to table a request by Pedro Diaz for a variance to Sections 17.03.005, 17.04.003, and 17.04.004 related to Cuts and Fills and Disturbance within Steep Slope, of the City of Bulverde Code of Ordinances, on 3.174 acres located at 4360 US HWY 281 N, Spring Branch, TX 78070.
