City of Bulverde, Texas Planning & Zoning Commission Meeting Thursday, September 12, 2024 Meeting Duration: 6:01 PM to 7:57 PM CALL THE MEETING TO ORDER Chair Ted Hawkins called the meeting to order at 6:01 PM. Ham REGULAR AGENDA ITEMS 2.I. Consider approval of the Planning and Zoning Commission Meeting Minutes from August 15, 2024. Motion: Chair Hawkins made a motion seconded by Commissioner Porter to approve the Planning and Zoning Commission meeting minutes from August 15, 2024. Vote: Motion carried (6) ayes to (0) nays. 2.II. Consider a request by Pedro Diaz for a variance to Sections 17.03.005, 17.04.003, and 17.04.004 related to Cuts and Fills and Disturbance within Steep Slope, of the City of Bulverde Code of Ordinances, on 3.174 acres located at 4360 US HWY 281 N, Spring Branch, TX. Motion: Commissioner Porter made a motion seconded by Commissioner Molina to recommend approval of a request by Pedro Diaz for a variance to Sections 17.03.005, 17.04.003, and 17.04.004 related to Cuts and Fills and Disturbance within Steep Slope, of the City of Bulverde Code of Ordinances, on 3.174 acres located at 4360 US HWY 281 N, Spring Branch, TX. Vote: Motion carried (5) ayes to (1) nay, Vice Chair Cartier opposed. 2.III. Consider a request by Southwest Texas Sign Service Inc, on behalf of Academy Sports + Outdoors, for a variance to Section 3.08.102(a)(2) and Section 3.08.102(a)(3) of the City of Bulverde Code of Ordinances, at 407 Singing Hills, Ste 101, Spring Branch, TX 78070. Motion: Commissioner Porter made a motion to table a request by Southwest Texas Sign Service Inc, on behalf of Academy Sports + Outdoors, for a variance to Section 3.08.102(a)(2) and Section 3.08.102(a)(3) of the City of Bulverde Code of Ordinances, at 407 Singing Hills, Ste 101, Spring Branch, TX 78070. There was no second. Motion withdrawn. Motion: Vice Chair Cartier made a motion seconded by Commissioner Flavin to recommend approval of a request by Southwest Texas Sign Service Inc, on behalf of Academy Sports + Outdoors, for a variance to Section 3.08.102(a)(2) and Section 3.08.102(a)(3) of the City of Bulverde Code of Ordinances, at 407 Singing Hills, Ste 101, Spring Branch, TX 78070, to include the primary, rear, but not accessory signage, contingent upon calculations by City staff. Vote: Motion carried (6) ayes to (0) nays. 2.IV. Consider a request by Southwest Texas Sign Service, on behalf of O’Reilly Auto Parts, for a variance to Section 3.08.102(a)(2) and Section 3.08.102(b)(2)(B) of the City of Bulverde Code of Ordinances, at 18502 Forty-Six Parkway, Spring Branch 78070. Motion: Commissioner Molina made a motion seconded by Vice Chair Cartier to recommend approval of a request by Southwest Texas Sign Service, on behalf of O’Reilly Auto Parts, for a variance to Section 3.08.102(a)(2) and Section 3.08.102(b)(2)(B) of the City of Bulverde Code of Ordinances, at 18502 Forty- Six Parkway, Spring Branch 78070, on the condition that the requestor provide the City Council of the City of Bulverde with corrected measurements. Vote: Motion carried (4) ayes to (2) nays, Chair Hawkins and Commissioner Burrier opposed. 2.V. Discuss and consider a recommendation to the City Council of the City of Bulverde, Texas, amending Chapter 14, Zoning, City of Bulverde Code of Ordinances, by amending Article 14.13, Miscellaneous Development Standards, to add a new Section 14.13.015, Structures Permitted within Setbacks, to define which types of structures may be placed within required building setbacks. Motion: Vice Chair Cartier made a motion seconded by Commissioner Porter to recommend to the City Council of the City of Bulverde, Texas, amending Chapter 14, Zoning, City of Bulverde Code of Ordinances, by amending Article 14.13, Miscellaneous Development Standards, to add a new Section 14.13.015, Structures Permitted within Setbacks, defining which types of structures may be placed within required building setbacks to include fences, signs, flagpoles, utility infrastructure (including, but not limited to, water meters, electric service pedestals and poles, sewer and septic systems, and water wells, but not applicable to auxiliary or supplemental utility service 240912 Planning & Zoning Commission Meeting Minutes | Page 2 of 3  infrastructure, including, but not limited to, rainwater collection systems, electrical generators, and solar panels), driveways, and mailboxes. Vote: Motion carried (6) ayes to (0) nays. 2.VI. Discuss and consider a recommendation to the City Council of the City of Bulverde, Texas, regarding an amendment to Chapter 14, Zoning, City of Bulverde Code of Ordinances, by amending Article 14.01, Administration and General Provisions, Section 14.01.019, Special Use Permits, to expand the types of uses that may be authorized by special use permits (SUP). Motion: Chair Hawkins made a motion seconded by Vice Chair Cartier to recommend to the City Council of the City of Bulverde, Texas, regarding an amendment to Chapter 14, Zoning, City of Bulverde Code of Ordinances, by amending Article 14.01, Administration and General Provisions, Section 14.01.019, Special Use Permits, to expand the types of uses that may be authorized by special use permits (SUP). Vote: Motion carried (6) ayes to (0) nays. PUBLIC COMMENTS NOT RELATED TO POSTED AGENDA ITEMS Chair Hawkins opened the meeting for public comments not related to posted agenda items at 7:56 PM. There being no one wishing to speak, the public comments were immediately closed.
