BACKGROUND: During the active recruitment for a successor Police Chief, a key executive-level position responsible for managing daily operations of the City’s Police Department, staff is recommending that the City Council adopt a resolution approving the appointment of Joseph Allio, a CalPERS retired annuitant, to fill the vacant Police Chief position on an interim basis effective September 24, 2024. The Police Chief position requires specialized skills and experience, and it is necessary to have an interim chief to ensure continuity of operations. Staff recommends that the City Council appoint Mr. Allio, who has the necessary experience and specialized skills, to fill the vacant Police Chief position on an interim basis as a CalPERS retired annuitant during the recruitment for a regular employee. The City has contracted with Bob Hall & Associated to manage the recruitment for a permanent appointment to the Police Chief position and that recruitment is underway. ANALYSIS: There are state laws and regulations governing post-retirement employment of a CalPERS retiree. Under Government Code Section 21221(h), the governing body of the contracting agency, i.e., the City Council of the City of Calistoga, is authorized to appoint a qualified retiree to fill a vacant executive or management position on an interim basis during the recruitment to permanently fill the vacant position. Mr. Allio possesses the necessary experience and specialized skills to fill the position of Police Chief on an interim basis. Joe has an impressive background in law enforcement, with over 35 years of dedicated service. He rose through the ranks to become a police chief in 2015, where he led with a commitment to community safety and justice. After retiring, Joe continued to contribute to the field by taking on interim Police Chief roles and consulting for a Chicago civil rights law firm. Joe's expertise and Page 3 of 5 unwavering commitment to public safety will make him a valuable contributer to our police department and the City of Calistoga. To assist CalPERS employers, CalPERS provides a model resolution for public agencies to appoint a retired annuitant to a vacant position for an interim term. Based on the model resolution, attached is a resolution certifying the appointment of Mr. Allio on an interim basis to a vacant executive position, in accordance with Government Code Section 21221(h). FINANCIAL IMPACT: There is no additional impact, as the hourly rate of pay will be funded through the salary savings resulting from the vacant position. Services Director Approved - Sep 20 2024 Yudiana Galvan, City Clerk Approved - Sep 20 2024 Page 4 of 5 RESOLUTION NO. 2024-XXX ADOPTED SEPTEMBER XXXX RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALISTOGA APPROVING THE APPOINTMENT OF JOSEPH ALLIO AS INTERIM POLICE CHIEF Government Code Section 21221(h) WHEREAS, Government (Gov.) Code section 21221(h) of the Public Employees’ Retirement Law permits the governing body to appoint a CalPERS retiree to a vacant position requiring specialized skills during recruitment for a permanent appointment, and provides that such appointment will not subject the retired person to reinstatement from retirement or loss of benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and WHEREAS, the City Council of the City of Calistoga desires to appoint Joseph Allio as an interim appointment retired annuitant to the vacant position of Police Chief for the City of Calistoga under Gov. Code section 21221(h), effective September 24, 2024; and WHEREAS, the City Council, the City of Calistoga, and Joseph Allio certify that Joseph Allio has not and will not receive a Golden Handshake or any other retirement- related incentive; and WHEREAS, an appointment under Gov. Code section 21221(h) requires that the retiree is appointed into the interim appointment during recruitment for a permanent appointment; and WHEREAS, the City of Calistoga has contracted with an executive recruiter and authorized the search for a permanent appointment on July 22, 2024; and WHEREAS, this Gov. Code section 21221(h) appointment shall only be made once and therefore will end on April 1, 2025 and WHEREAS, the entire employment agreement between Joseph Allio and the City of Calistoga has been reviewed by this body and is attached herein; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Calistoga hereby certifies the nature of the employment of Joseph Allio as described herein and detailed in the attached employment agreement and that this appointment is necessary to fill the critically needed position of Police Chief for the City of Calistoga by September 24,2024 because the Police Chief is a key executive-level position responsible for managing operations of the City of Calistoga’s Police Department Page 5 of 5 Resolution No. 2024-XXX Page 2 of 2 PASSED, APPROVED AND ADOPTED this 23rd day of September, 2024.
