City Council Proceedings
The Canistota City Council met Monday, August 5, 2024 at 6:00 PM in the Canistota City Hall Community
Room. City Council Members present: Mayor Justin Lee Engbarth, Jerry Bertelsen, Matt Anderson and
Donovan O’Donnell. Jamie Miller was absent. Others present: Maintenance Supervisor, Darin Nugteren,
Maintenance Assistant, Brandon Dolejsi, Finance Officer, Kathy J. Townsend, Fire Department Representative,
Adam Richarz, City Engineer, Darin Ligtenberg, Citizen present: Marie Chandler, Alise Nickel, Abby
Krietlow, Dawn Becker, Natalie Becker and Allen Klinkhammer.
Mayor Engbarth called the meeting to order at 6:00 PM and led the Pledge of Allegiance.
Bertelson motioned, second by Anderson to approve the agenda as presented, all voted yes, the motion carried.
Anderson motioned, second by Bertelson to approve the proceedings from the July meetings as presented, all voted
yes, the motion carried.
The written report received from the Sheriff was approved on a motion by Bertelson, second by O’Donnell, all
voted yes, the motion carried.
Richarz presented the report for the Canistota Volunteer Fire Department, they responded to two rescue calls with
no fire calls. The department is updating their meeting room, with new lighting and ceiling tiles. A television and
speakers will also be added. A new gas meter has been installed. The department will be conducting a vehicle
extraction training exercise for members. O’Donnell motioned, second by Bertelson, to approve the report, all
voted yes, the motion carried. Richarz left the meeting at 6:04 PM
Pool manager, N. Becker presented an update to the Council. It has been a good year with pool attendance, also
lessons were well attended. The last day to enjoy the pool is Monday, August 12. Becker hopes to reduce
inventory for this last week of operation so a lot of new items have not been restocked. Money left on concession
accounts was discussed. The Mayor expressed his appreciation to Becker for a good job as manager this year.
Becker left the meeting at 6:06 PM
Summer Rec Director, Abby Krietlow updated the Council, this is the last week of the program. Krietlow is doing
inventory of the supplies from the program. The supplies will be secured in the kitchen cabinet. Krietlow
indicated the activities for the younger children were well attended with the older participants busier due to work
and sport commitments. The Mayor thanked Krietlow for a good job as summer rec director. Krietlow left the
meeting at 6:08 PM.
Ligtenberg, City Engineer, updated the Council on the Phase 3 Improvement Project. He is coordinating with H &
W contractors to finish the punch list items, the Main Street curb and gutter will be repaired this week or the week
of August 12th. Ligtenberg’s office is working on measurements and confirming property ownership in
preparation for assessing the curb and gutter costs to homeowners in the Phase 3 Project area. The school
assessment was discussed. Council person Anderson, expressed he has received calls from unhappy property
owners concerning the seeding of lawns. Chandler, Nickel and Klinkhammer all expressed frustration with the
quality of the dirt that was brought in to replace what was removed during the construction process. The only thing
growing are the weeds, not grass. Ligtenberg will meet with Chandler and Nickel after the meeting to walk their
property to view their concerns first hand. Ligtenberg indicated his office follows the extension office
recommendations for seeding lawns which begins on August 15. Ligtenberg will draft a letter to homeowners
recommending how to care for the newly planted areas of their lawn. Ligtenberg will mail the letter in September.
Under Citizen Concerns Dawn Becker visited with Council about the necessary steps she would need to open her
home for lodging of visitors to the Ortman Clinic. Becker left the meeting at 6:35 PM
Nugteren & Dolejsi presented the Planning and Zoning Report: three building permits were issued during the
month of July. There were several calls for utility locates along with questions involving setbacks and zoning
regulations. Becker’s inquiry concerning providing lodging in her home for Clinic patients was discussed. The
City Ordinances would have to be amended to allow for that use in her neighborhood. Anderson motioned, second
by Bertelson, for the City to contact SECOG to begin the process of amending the Ordinance to allow for the
requested use, all voted yes, the motion carried. The P & Z report was approved on a motion by O’Donnell, second
by Bertelson, all voted yes, the motion carried.
Anderson presented the Canistota Development Corporation report from their recent meeting. The group is
exploring options to utilize their Travel SD Grant funds. Options being explored include: enhancing the City
website, billboard advertising, hiring a professional to increase City presence on social media and entering into an
agreement to contract for drone footage of the City at various times of the year. A program, backed by the CDC to
loan money at a reduced interest rate to business to update the façade of their building is being explored. The
group is also looking for other opportunities to enhance the City of Canistota. The report was approved as
presented on a motion by O’Donnell, second by Bertelson, all voted yes, the motion carried.
Mayor Engbarth presented a proposal from Sight and Sound for speaker/amplifier installation at the ballpark. The
proposal could also be considered by Canistota School and/or CAA. No action was taken by the Council.
Chandler, Nickel and Ligtenberg left the meeting at 7:02 PM
Nugteren and Dolejsi presented the Maintenance report for July: Equipment has been taken to Sioux Falls for
annual inspections, including, the Wheel Loader, the Bobcat MT 100 and the Mahindra Tractor. O’Donnell
motioned, second by Anderson to purchase an extended warranty of two (2) years, 2,000 miles at a cost of
$2,772.00 for the 2020 Case Wheel Loader, all voted yes, the motion carried. New umbrellas have been installed at
the pool. Options for retro-fitting the hydraulic system on the 1993 dump truck for the 2024-2025 snow season are
being explored. Nugteren has attended the final meeting of the McCook County Pre-Disaster Mitigation Plan.
Plans will be reviewed August 29th at the Court House; Council is invited to attend. Dolejsi sprayed mosquitos
seven time in July. The pass-through, roll up door for the kitchen has been installed at the picnic shelter. The sewer
line leading to the pool, along 6th Ave will be replaced when H & W are back in Canistota. Several items have been
placed for sale on Purple Wave Auction. Sludge build up in Cell One at the Lagoon and treatment plans offered
by Team Lab were discussed. Nugteren will bring more information and recommendations from SD Rural Water
to the September meeting for Council consideration. Because residents are not completing the State mandated
Lead-Free SD Survey, Bertelson motioned, second by Anderson to hire Brad Jensen, independent contractor, at a
rate of $10.00 per every home successfully completed and submitted to the State web-site, all voted yes, the motion
carried. Anderson visited with CAA to have a parking area of the ballpark deeded to the city without any
monetary compensation. The Finance Officer will contact the city attorney for direction on how to proceed.
Nugteren will initiate a survey of the property. Bertelson motioned, supported by Anderson to approve the
maintenance report as presented, all voted yes, the motion carried.
Klinkhammer left the meeting at 7:46 PM

Townsend presented the Finance Officer’s report: Delinquent utility bills were discussed. Bertelson motioned,
second by Anderson to approve the increase in the State mileage rate to $.66 per mile when an employee uses their
private vehicle for City approved business, all voted yes, the motion carried. The FO report was approved as
presented on a motion by O’Donnell, second by Bertelson, all voted yes, the motion was approved.
Council Concerns:
Mayor Engbarth: The second reading of Ordinance 2024-07, Nuisance Fire Alarms was approved on a motion by
Bertelson, second by O’Donnell, all voted yes, the motion carried. The Ordinance can be found elsewhere in this
issue of The Special. The first reading of Ordinance 2024-08, Appropriations Ordinance was acknowledged. The
Council declined a request to abate sewer costs associated with filling a home pool. The Canistota City Council
will convene on TUESDAY, September 3, 2024 at 6 PM. Please note change of date due to Labor Day Holiday.
The ballpark rental agreement between the City and Canistota Public School was discussed with Anderson
motioning a proposed fee of $5,000.00, second by O’Donnell, Anderson and O’Donnell voted yes, with Bertelson
abstaining due to a conflict of interest. Bertelson will present the proposed agreement to the Superintendent for
school board consideration. The rental agreement will be discussed at the September Council meeting. Ambulance
service was discussed. Mayor Engbarth also discussed reimbursement of concession fund money on file at the
pool; more information will be available for the September meeting.

Anderson discussed a drainage issue along Railway Ave.
Bertelson motioned, second by Anderson to adjourn the meeting at 8:50 PM, all voted yes, the motion carried.
Canistota City Council will meet in regular session on TUESDAY, SEPTEMBER 3, 2024 at 6 PM in the
Community Room of City Hall. All are welcome. Note date change due to Labor Day Holiday.
