City Council Proceedings
The Canistota City Council met Monday, February 3, 2025 at 6:00 PM in the Canistota City Hall Community
Room. City Council Members present: Mayor Justin Lee Engbarth, Matt Anderson, Donovan O’Donnell; and
Jerry Bertelson. Jamie Miller arrived at 6:15 PM. Others present: Maintenance Supervisor, Darin Nugteren,
Maintenance Assistant, Brandon Dolejsi, Finance Officer, Kathy J. Townsend, Fire Chief Dave Miller, Jeanette
Nugteren, and Pat Letcher. Barb Spicer arrived at 6:15 PM
Mayor Engbarth called the meeting to order and led the Pledge of Allegiance.
Bertelson motioned to amend the agenda to include consideration of Resolution 20205-03, Annual Street
Assessment, second by O’Donnell, all voted yes, the motion was approved. On a motion by O’Donnell, second by
Bertelson, the amended agenda was approved, the motion carried.
Bertelson motioned, second by Anderson to approve the proceedings from the last regular meeting as presented, all
voted yes, the motion carried.
No one was present from the Sheriff’s Office and no written report was received.
Fire Chief Miller presented a report for the Fire Department: The Department responded to three fire calls and two
rescue calls in January. The first training date for ISO compliance has been completed with a second training date
scheduled for February 12, 2025. Door codes will be updated. Bids are being obtained to install cameras on the
property. The Department has sixteen active members. The report was approved as presented on a motion by
Bertelson, second by O’Donnell, all voted yes, the motion carried. Miller left the meeting at 6:10 PM.
Nugteren presented the Planning and Zoning report: Six building permits were issued in January. Nugteren
answered various questions concerning set-backs, ordinances and zoning regulations; he is also reviewing zoning
ordinances and regulations. The report was approved on a motion by Bertelson, supported by O’Donnell, all voted
yes, the motion carried.
Anderson presented an update for the CDC. Because of illness and scheduling conflicts, no meeting has been
convened.
Citizen Concerns:
A nuisance concern was discussed with garbage and debris littering a property on 2nd Avenue. The Code
Enforcement Officer will be notified to address those issues. Zoning and the allowed use of the property was
discussed. The City Attorney has given the City a letter that will be sent to the registered owner of the property for
compliance with nuisance ordinances as well as direction to adhere to the allowed zoning use of the property.
Spicer, Nugteren, and Letcher left the meeting at 6:30 PM.
Nugteren and Dolejsi presented the Maintenance report: Three bids for replacing the current Mahindra tractor were
submitted for Council review. The current tractor has a hydraulic issue that is expensive to repair. After some
discussion, the bid from Sioux International in the amount of $35,900.00 was approved on a motion by Bertelson,
supported by Anderson, all voted yes, the motion carried. This is the final cost with the Mahindra tractor traded in
on the purchase of the 2024 Case IH Farmall tractor. Updating security cameras on City property was discussed
with Nugteren bringing bids to the March Council meeting; he is also exploring grant opportunities. Replacing the
grandstand at the ballpark was discussed. Several bids were reviewed. Removing and selling the existing
grandstand was discussed. Partnership with the school contributing a portion of the replacement cost will be
presented to the school board for their input. A current bid of $114,652.00 was received, this does not include the
recommended concrete pad. More information will be presented at the March 3, 2025 regular Council meeting.
The snowblower is ready to go for the first snowfall, the air compressor trailer is being inspected and serviced.
Nugteren has been elected as a municipal board member on the SDARWS, Congratulations Darin! The lagoon
sludge issue and ammonia levels were discussed with Nugteren and Dolejsi presenting a long-term treatment
option. The cost is approximately $80,000.00 using solar powered re-oxygenation through surface renewal. No
action was taken on the proposal at this time. Nugteren will explore if grant options are available. Water meters
are being replaced in various residences. An update on the lead pipe survey was briefly discussed. Anderson
motioned to approve the report as presented, second by Miller, all voted yes, the motion carried.
Miller motioned, second by Anderson to approve the following bills for payment including the Xcel Energy billing
which was not received in time for this meeting, all voted yes, the motion carried:

The following bills were approved for payment after the last meeting: AFLAC, Full time Employees, $426.62;

Security State Bank, Payroll Taxes, $3,609.03.
Delinquent utility accounts were acknowledged in the Finance Officer’s report. A utility bill was reviewed and on
a motion by Bertelson, second by Anderson, a portion of the drinking water fees for account #0358800 will be
abated in the amount of $681.36, all voted yes, the motion carried. The Finance Officer’s report was approved on a
motion by Miller, second by O’Donnell, the motion carried.
Council Concerns:
Mayor Justin Lee Engbarth: On a motion by Miller, second by Bertelson, Schoenfish & Co. letter of engagement
was approved to complete the 2024 annual report for the City of Canistota, all voted yes, the motion carried. The
first reading of Ordinance #2025-02, repealing Ordinance 2022-06 was acknowledged. Miller motioned, second by
O’Donnell to approve Resolution 2025-03, all voted yes, the motion carried.
RESOLUTION 2025-03
A RESOLUTION PROVIDING FOR ANNUAL STREET ASSESSMENT-2025
WHEREAS, it is necessary and appropriate to maintain all streets within the City of Canistota; and
WHEREAS, the City of Canistota annually incurs expense to maintain those streets; and
WHEREAS, the City of Canistota may levy annually for the purpose of maintaining and repairing street
surfacing or pavement; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Canistota, as follows:
1. Designation of lots to be assessed. All lots in the City of Canistota fronting and abutting a street
shall be assessed annually on the front foot basis.
2. Amount of Assessment. There shall be levied upon all lots fronting and abutting a street, one dollar
($1.00) per front foot. Front foot means the actual front of the premises as established by the
buildings thereon, recorded title and use of the property, regardless of the original plat.
3. Assessment. The City Finance Officer is directed to add such assessment to the general assessment
against the property and certify the assessment together with the regular assessment to the county
auditor to be collected as municipal taxes for general purposes.
4. Assessment subject to review. The assessment is subject to review and equalization the same as
assessments or taxes for general purposes. This Resolution reflects NO increase in the assessment
cost to property owners.
