City Council Proceedings The Canistota City Council met Monday, March 7, 2022 at 7:00 PM in the Canistota City Hall Community Room. City Council Members present: Mayor Justin Engbarth, Donovan O’Donnell, Jamie Miller, Brad Miller, and Jessica Kerher. Others present: Finance Officer Kathy Townsend, Maintenance Supervisor, Darin Nugteren, Maintenance Assistant Brandon Dolejsi, Fire Chief Adam Richarz, Austin Matthaei, Leonard Matthaei, Bruce Otto, Vivian Lounsbury arrived at 7:15 PM and Darin Ligtenberg arrived at 7:58 PM Mayor Engbarth called the meeting to order at 7:00 PM Mayor Engbarth led the Pledge of Allegiance. The agenda was approved on a motion by O’Donnell, seconded by J. Miller, all voted yes, the motion carried. The proceedings from the last regular Council meeting were approved on a motion by B. Miller, seconded by J. Miller, all voted yes, the motion carried. The written report submitted by the Sheriff’s Office was approved on a motion by B. Miller, seconded by O’Donnell, all voted yes, the motion carried. Fire Chief Richarz presented the report for the Canistota Volunteer Fire Department. They responded to two rescue calls along with one fire call in February. The Department still has their older pumper truck for sale and will list it for sale on Purple Wave. Classes for the firefighters will be held in June. The report was approved on a motion by B. Miller, seconded by Kerher, all voted yes, the motion was approved. Richarz left the meeting at 7:07PM. Nugteren and Kerher presented the report from the Canistota Development Corporation. At the group’s recent meeting, a property on 3rd Ave was discussed along with developing senior duplex housing. Also discussed was the construction of a spec house. The group will ask a representative from the Governor’s Office to attend their next meeting. J. Miller motioned to approve the report as presented, seconded by B. Miller, all voted yes, the motion carried. Nugteren presented the report from the Planning and Zoning Commission. A building permit for storage units has been received. Ordinances dealing with grain bins and solar panels will have a public hearing before the Canistota Planning and Zoning Commission on Monday, March 21st, 2022 at 5:30 PM in the Community Room of City Hall. All are welcome and encouraged to attend. The public hearing on Resolution 2022-04, a resolution authorizing Mayor Justin Lee Engbarth to execute and file an application on behalf of the City of Canistota with the National Park Service through the State of South Dakota Department of Game, Fish and Parks for an LWCF grant to aid in financing the construction of a picnic shelter/warming house in Stalting Park was held. There was no one present either for or against the application and on a motion by B. Miller, seconded by Kerher, the city will proceed with the grant application, all voted yes, the motion carried. The Resolution is printed elsewhere in this issue of the Special. Citizen Concerns: Bruce Otto was present to visit with the Council about the increase in surcharge fees Mayor Engbarth explained the need for the increase came from the State of South Dakota. The State determines the amount of surcharge needed for the city to meet its debt service obligation for the Proposed Phase 3 Improvement project. Otto left the meeting at 7:27 PM. Austin Matthaei visited with the Council about being hired again this summer for a part-time position in the maintenance department. Lounsbury was present to receive an update on the proposed Phase 3 Improvement Project and to visit with the City Engineer. She lives in the proposed project area and wanted an update on how her property will be impacted by the proposed project. The following bills were approved for payment on a motion by J. Miller motioned, seconded by O’Donnell to enter into an agreement with Carbonite for secure backup for computer files in the Finance Office for one year at a cost of $83.99, all voted yes, the motion carried. Canistota City Council will convene at 6 PM as the Board of Equalization on Monday, March 21, 2022; immediately following that meeting, at 6:30 PM., the Council will convene as City Council to review and consider written comments on the proposed request for the release of funds and on the Environmental Impact Statement for the Proposed Phase Improvement Project. The City Council will also hold a public hearing on the amended changes to Planning and Zoning Ordinances in reference to the construction of grain bins and solar panels in Canistota. This public hearing will constitute the first reading of the proposed ordinance amendments. The FO report was approved as presented on a motion by Kerher, seconded by O’Donnell, all voted yes, the motion carried. Austin Matthaei left the meeting at 8:19 PM City Engineer Ligtenberg updated the Council on the Proposed Phase 3 Project, included in the discussion: submitting the plan to the SD Department of Transportation for their review and approval, bid letting, awarding a contract, construction staging, completing the project in stages and the Resolution of Necessity for curb and gutter assessment were all discussed. Ligtenberg also met with Lounsbury to answer her questions and concerns. Lounsbury left the meeting at 8:32 PM. Leonard Matthaei left the meeting at 8:38 PM Ligtenberg left the meeting at 8:49 PM Nugteren and Dolejsi presented the maintenance report for the month of February: four umbrella bases have been manufactured, they will be mounted to the deck at the pool, umbrellas have been purchased to place in the holders. Nugteren and Dolejsi repaired parts of the roof decking on the Round House before Guaranteed Roofing proceeded with the completion of the roof covering. Trees have been ordered for the parks. Nugteren is obtaining cost estimates to have the interceptor sewer line under 7th Ave. videotaped. Dolejsi has been working on adjusting the radar signs. Crack sealing and chip sealing was discussed. Nugteren and Dolejsi have gone over the plans for the proposed Phase 3 Improvement Project with Snyder representatives. Ordering equipment for the Rubble site using the grant money received, was tabled until the April, 2022 meeting. The Maintenance report was approved as presented on a motion by J. Miller, seconded by Kerher, all voted yes, the motion carried. Council Concerns: Mayor Engbarth: B. Miller motioned, seconded by Kerher to approve Supplemental Budget Ordinance 2022-01, all voted yes, the motion carried. The Ordinance is printed elsewhere in this edition of the Special. The First Reading of Ordinance 2022-05 was acknowledged, this ordinance will amend the Municipal Utilities Ordinance with continuing surcharge responsibilities. The Ordinance states that once utility services have been connected and/or provided to a property, the owner(s) of the property shall be responsible for paying any and all surcharges therefor as prescribed by resolution. The second reading of the ordinance will be held on Monday, April 4, 2022 at the regularly scheduled City Council meeting. Because the Canistota Clipper will be combined with The Special, B. Miller motioned, seconded by J. Miller to name The Special as the official newspaper for the City of Canistota, all voted yes, the motion carried. No action was taken on the utility disconnection for account #00005070. J. Miller motioned, seconded by Kerher to proceed with grant opportunities for the development of the picnic shelter/warming house in Stalting Park with an anticipated completion of the shelter/warming house in October of 2022, all voted yes, the motion carried. Nugteren will obtain cost estimates for blue prints for the project. The City of Canistota is accepting applications for lifeguard positions this summer. Action on hiring a rubble site attendant and hours of operation were tabled until the April Council meeting. B. Miller motioned, seconded by J. Miller to approve expenses for D. Nugteren to attend the Rural Water Expo in Rapid City on April 26 and April 27, all voted yes, the motion carried. B. Miller, seconded by Kerher, all voted yes, the motion carried.
