City Council Proceedings
The Canistota City Council met Monday, February 7, 2022 at 7:00 PM in the Canistota City Hall Community
Room. City Council Members present: Mayor Justin Engbarth, Donovan O’Donnell, Jamie Miller, Brad Miller,
and Jessica Kerher. Others present: Finance Officer Kathy Townsend, Maintenance Supervisor, Darin
Nugteren, Maintenance Assistant Brandon Dolejsi, Darin Ligtenberg, and Adam Richarz.
Mayor Engbarth called the meeting to order at 7:00 PM
Mayor Engbarth led the Pledge of Allegiance.
The agenda was amended to include a discussion on utility surcharges on a motion by B. Miller, seconded by
O’Donnell, all voted yes, the motion carried.
The proceedings from the last regular Council meeting were approved on a motion by J. Miller, seconded by B.
Miller, all voted yes, the motion carried.
The proceedings from the January 24, 2022, special City Council meeting were approved as presented on a motion
by J. Miller, seconded by Kerher, all voted yes, the motion was approved.
The written report as submitted by the Sheriff’s Office for December and January was approved on a motion by B.
Miller, seconded by Kerher, all voted yes, the motion carried.
Fire Chief Richarz presented the report for the Canistota Volunteer Fire Department. They responded to four
rescue calls along with one fire call in January. The Department still has their older pumper truck for sale. The
Annual pancake feed will be hosted by the Fire Department on Sunday, April 24, 2022 from 9 AM to 1 PM. The
report was approved on a motion by O’Donnell, seconded by Kerher, all voted yes, the motion was approved.
Richarz left the meeting at 7:06 PM.
There was no report from the Canistota Development Corporation.
Nugteren presented the report from the Planning and Zoning Commission. The first reading of ordinances
amending the revised zoning regulations regulating grain bins along with solar panels with a conditional use
permit, will be held at the March 7, 2022 regular City Council meeting.
Darin Ligtenberg, City Engineer updated the Council on the Proposed Phase 3 Infrastructure Improvement Project.
A public hearing regarding the categorical exclusion from the State of SD will be scheduled when all paperwork
with SECOG and the State of SD has been filed. Ligtenberg will be working to finalize bid specifications and filing
with the State for their preliminary review. Bidding the project, work completion, paving the pool parking lot to
bring it and the sidewalk into ADA compliance was discussed. Also, drainage at 7th and Main will be addressed in
the Phase 3 project. Ligtenberg will be exploring cost efficiency along with the life span of asphalt versus concrete
be used in the project area. Mayor Engbarth and Ligtenberg will meet the School Board to discuss parking and
streets around the school.
No one was present for citizen concerns.
Nugteren and Dolejsi presented the maintenance report for the month of January; several complaints were received
about chickens roaming in private yards. City Ordinance prohibits keeping or maintaining any building or
enclosure where fowl are kept unless the City Council grants a special permit. Citizens must meet with the Council
and obtain a permit to house fowl in City limits. One building permit was issued in January. On a motion by B.
Miller, seconded by Kerher, updated cell phones will be purchased for Nugteren and Dolejsi, all voted yes, the
motion carried. The fence around the pickleball court is scheduled to be installed in approximately a week.
Guaranteed Roofing will be in Canistota on Wednesday to replace the roof on the round house. Updating the lights
at the ballfield was discussed. The addition of a picnic shelter/ warming house at Stalting Park was discussed, with
Nugteren gathering cost estimates. Grant opportunities will be explored to offset the cost of the proposed project.
Nugteren will use video to inspect the interceptor sewer line under 7th Ave., which is not scheduled to be replaced
in the Phase 3 Proposed Project. Dolejsi is working on adjusting the speed signs located on the outskirts of
Canistota. A water leak at the round house was temporarily capped until permanent repairs can be done in the
spring. B. Miller, seconded by O’Donnell motioned to approve Mayor Engbarth signing the Solid Waste
Management Program Grant Agreement, all voted yes, the motion carried. The amount the city was awarded is
$6,735.00 or 30% of the projected costs for improvements at the Restricted Use Site. Utility fees/surcharges were
discussed. The maintenance report was approved as presented on a motion by B. Miller, seconded by Kerher, all
voted yes, the motion carried.
D. Ligtenberg left the meeting at 9:10 PM.

Townsend presented the Finance Officer’s report: More information for file back-up for City computers with local
companies is still being explored with more information to be shared at the March 7th meeting. The Council will
convene as the Board of Equalization on Monday, March 21 at 6 PM in the Community Room of City Hall. The
Finance Report was approved on a motion by Kerher, seconded by J. Miller, all voted yes, the motion carried.
Council Reports:
Mayor Engbarth: Hiring both part time summer help in the maintenance department along with lifeguards for the
pool was discussed with the Finance Officer instructed to advertise for help in those departments. Hiring a rubble
site attendant and hours of operation at the restricted use site was tabled until a later meeting. B. Miller motioned,
seconded by O’Donnell to designate Mayor Engbarth as the City’s authorized representative and empower the
Mayor with the authority to sign the Community Access Agreement on behalf of the City, along with all paperwork
associated with the Proposed Phase 3 Improvement Project, all voted yes, the motion carried. The first reading of
Supplemental Budget Ordinance 2022-01 was acknowledged. Mayor Engbarth updated the Council on South
Dakota’s First Gentleman, Bryon Noem’s visit to Canistota. Several businesses were toured along with shooting
hoops at the school. Utility bills and surcharge fees were discussed in relationship to Main St. businesses,
unoccupied dwellings and empty lots with water and sewer utilities available at the property. The city will confer
with SECOG and revisit the discussion at the regular March City Council Meeting. Hiring an engineer to draft a
plan for the replacement of lights and the electrical panel at the ballpark was discussed. No action was taken.

Kerher motioned to adjourn the meeting at 10:10 PM, seconded by O’Donnell, all voted yes, the motion carried.
The next regular City Council meeting will be held at 7 PM on Monday, March 7, 2022 in the Community
Room of City Hall. All are welcome.
