City Council Proceedings The Canistota City Council met Tuesday, September 6, 2022 at 5:00 PM in the Canistota City Hall Community Room. City Council Members present: Mayor Justin Engbarth, Donovan O’Donnell, Jamie Miller, Jessica Kerher; and Brad Miller. Others present: Finance Officer Kathy Townsend, Maintenance Supervisor Darin Nugteren, Maintenance Assistant Brandon Dolejsi, and Dave Miller, Canistota Volunteer Fire Department. Mayor Engbarth called the meeting to order at 5:00 PM Mayor Engbarth led the Pledge of Allegiance. The agenda was approved as presented on a motion by J. Miller, second, by Kerher, all voted yes, the motion carried. The proceedings from the last regular Council meeting were approved as presented on a motion by B. Miller, second by O’Donnell, all voted yes, the motion carried. J. Miller motioned, second by Kerher to approve the proceedings from the August 8, 2022 special meeting, all voted yes, the motion carried. D. Miller presented the Canistota Volunteer Fire Department report; the department responded to two fire calls and eight rescue calls. The Fire Department participated in the August Block Bash with the kids having fun with the volunteer fire-fighters. Kerher motioned, seconded by O’Donnell to approve the report, all voted yes, the motion carried. Miller left the meeting at 5:06 PM. No report was received from the Sheriff’s Office for the month of August. The second reading of Appropriations Ordinance 2022-09 was held with J. Miller motioning, second by Kerher, to approve the Appropriations Ordinance as presented, all voted yes, the motion carried. The Ordinance is printed elsewhere in this issue of The Special. There was no report from the City Engineer. Canistota Development Corp did not have a report. Nugteren presented the Planning and Zoning Report: Two new construction building permits were submitted for August. Nugteren has explored funding for generators for both City Hall and the Maintenance shop, he is gathering estimates and will coordinate the application with SECOG. SECOG will be sponsoring a meet and greet on Wednesday, September 7th, 2022 for City Officials and employees. The report was approved on a motion by Kerher, second by B. Miller, all voted yes, the motion carried. Brad Sherer arrived at the meeting at 6:55 PM Nugteren presented the August maintenance report: there have been several reports of barking dog nuisances, several live traps have also been set around town. Tires have been replaced on the Chevy pickup. Solar powered gates for the rubble site were discussed with Dolejsi & Nugteren updating the Council on their recommendation and on a motion by O’Donnell, second by Kerher, a gate from Apollo Brand will be purchased at an approximate cost of $2,153.00, all voted yes, the motion carried. Several new basketballs have been purchased for use at the City Park. The medical building has been repainted. MAP Engineering will look at the ballpark lights on Thursday to do an inventory of what is currently in place and what is needed to upgrade the lights. The pool has been winterized, damage was found on the diving board and on a motion by B. Miller, second by J. Miller, the damaged board will be replaced with an aluminum diving board, all voted yes, the motion carried. The fence and aeriation at the lagoon are being addressed. Street paving and patching have been completed by Clark Paving. Crosswalks have been painted on Main Street. Nugteren is talking with TM Rural Water to increase our usage contract, along with the City getting water from a different TM Rural Water tower, Nugteren will bring updates from rural water to the next meeting. Kerher motioned, second by B. Miller to approve the report as presented, all voted yes, the motion carried. At 7 PM, Mayor Engbarth opened the Public Hearing for the first reading of Ordinance 2022-11 Amending Planning and Zoning Regulations regarding VRBO’s in Canistota. No one was present either for or against the proposed ordinance. The second reading will be held on Monday, October 3, 2022 at the next regular Council meeting. Under Citizen Concerns: Sherer met with the Council to inquire about nuisance properties, including vehicles parked on private property, grass and weeds, and barking dogs. Mayor Engbarth gave an update on nuisance properties and his conversation with the code enforcement officer. Sherer also asked for an update on the start date of the Phase 3 Improvement Project, he was informed the project will begin in the Spring of 2023. Sherer left the meeting at 7:29 PM Megan Hofer arrived at the meeting at 7:30 PM. Hofer updated the Council on the closing events at the pool, the triathlon was a first-year success with six participants with three volunteers assisting Hofer with the events. Medals and tee shirts were provided to participants. The year end pool party was also very successful with over 100 people enjoying pizza and swimming. Hofer also implemented water aerobics one night a week which was very well attended; this maybe extended to two nights a week in 2023. The new umbrellas and chairs were appreciated by lifeguards. Pool parties and movie nights with glow sticks were also discussed. Hofer left the meeting at 7:45 PM. Kerher motioned, seconded by J. Miller to reimburse lifeguard certification at the actual cost of the certification to those lifeguards who submit to the Finance Office a copy of their payment receipt, all lifeguards must complete one summer of employment to be eligible to receive the first half of reimbursement. Upon successfully completing the second year of employment, the last half of reimbursement will be issued to the lifeguard, all voted yes, the motion carried. Council Concerns: Mayor Engbarth: Kerher motioned, second by O’Donnell to approve the agreement between the City of Canistota and SECOG for administrative services in the amount of $20,000.00 for the Phase 3 Improvement Project, all voted yes, the motion carried. There were no concerns or updates recommended to the Rental Agreement between the City and CHS for the rental and maintenance of the Sports Complex. The contract will be submitted to the school for Mrs. Ortman’s signature. B. Miller presented a sealed bid he received for the City owned property on 2nd Ave. After much discussion, the bid was declined. Mayor Engbarth will follow up with the bidder. J Kerher has received complaints and concerns about the barking dogs in her neighborhood. O’Donnell had no concerns J. Miller had no concerns. J. Hoiten arrived at the meeting at 8:20 PM O’Donnell motioned at 8:20 PM to enter into Executive Session for Personnel per SDCL1-25-2-1, second by Kerher, all voted yes, the motion carried. Mayor Engbarth declared Executive Session over at 8:25 PM with the Council convening in open session. B. Miller motioned, seconded by Kerher to adjourn the meeting at 8:25PM, all voted yes, the motion carried. The next regular City Council meeting is 7:00 PM, Monday, October 3, 2022in the Community Room, at City Hall. All are welcome to attend.
