City Council Proceedings The Canistota City Council met Monday, October 3, 2022 at 7 PM in the Canistota City Hall Community Room. City Council Members present: Mayor Justin Engbarth, Donovan O’Donnell, Jamie Miller, Jessica Kerher; Brad Miller arrived at 7:55 PM. Others present: Finance Officer Kathy Townsend, Maintenance Supervisor Darin Nugteren, Maintenance Assistant Brandon Dolejsi, Ariel Niehaus, Micci Schmidt, Brad Preheim representing the Vermillion Basin Water Development District, SEFP Representative Heather Broehm, and from the Canistota Volunteer Fire Department, Dave Miller. Mayor Engbarth called the meeting to order at 7:00 PM Mayor Engbarth led the Pledge of Allegiance. The agenda was approved as presented on a motion by Kerher, second, by J. Miller, all voted yes, the motion carried. The proceedings from the last regular Council meeting were approved as presented on a motion by J. Miller, second by Kerher, all voted yes, the motion carried. Kerher motioned, second by O’Donnell to approve the proceedings from the September 19, 2022 special meeting, all voted yes, the motion carried. The written report from the Sheriff’s office for the month of August was approved as presented on a motion by J. Miller, second by Kerher, all voted yes, the motion carried. D. Miller presented the Canistota Volunteer Fire Department report; the department responded to three fire calls and two rescue calls. The Fire Department will participate in activities at CHS for Fire Prevention week. Kerher motioned, seconded by O’Donnell to approve the report, all voted yes, the motion carried. Miller left the meeting at 7:05 PM. There was no report from the City Engineer. Nugteren, Kerher and Broehm presented an update from the Canistota Development Corporation. The group is interested in developing the city lot on Second Ave with proceeds of the sale of a proposed home to be used to reimburse the city for the cost of the lot. Different options are being explored as to the type of housing for the development of the lot. Pamphlets and flyers were also discussed as being effective tools to promote the opportunities available in the City of Canistota. The report was approved on a motion by J. Miller, second by O’Donnell, all voted yes, the motion carried. Nugteren presented the Planning and Zoning Report: Three building permits were issued in September; Nugteren is exploring the opportunity for a grant for infrastructure mitigation. O’Donnell motioned to approve the report as presented, second by J. Miller, all voted yes, the motion carried. Citizen Concerns: Ariel Niehaus was present to discuss her plans with the Council to have chickens in City limits. Niehaus has met all conditions of the contract and on a motion by J. Miller, second by Kerher, the permit was approved for Mayor to sign, all voted yes, the motion carried. Brad Preheim was present to discuss cities in McCook County becoming part of the Vermillion Basin Water District. The District supports municipalities along with rural land owners for conservation opportunities. Rural Water Districts are also benefactors of grant opportunities through the Water District. The option for McCook County to become part of the Vermillion Basin Water District is on the November ballot. Preheim left the meeting at 7:33 PM. H. Broehm updated the Council on the work SEFP is doing in assisting prospective businesses in our area with licensing and start-up information. She will attend the local CDC meetings to guide the group in funding, housing and business opportunities that may affect Canistota. Broehm left the meeting at 7:54 PM. Nugteren presented the September maintenance report: several live traps have been set around town to reduce the cat population along with raccoons and possums. The new gate for the rubble site has arrived and will be installed in September. The grandstand at the ballpark is being painted. Heiman Fire Equipment has completed the annual inspection of our extinguishers. There are two different spellings for Stalting Park. The original deed indicated the spelling as “Stalting”, this is the way signage will be addressed. Estimates for concrete to replace the dugout that was damaged in the May 12th Derecho was discussed. On a motion by J. Miller, second by O’Donnell, Dolejsi will attend the West Nile Conference in Aberdeen on October 18th , 2022, all voted yes, the motion carried. Three bleachers for the Ballpark Complex will be purchased on a motion by J. Miller, second by O’Donnell at an approximate cost for the three bleachers of $15,000.00, all voted yes, the motion carried. A replacement radar sign will be purchased to replace the one damaged in the May 12 Derecho at an approximate cost of $3,270.00 on a motion by Kerher, second by J. Miller, all voted yes, the motion carried. Nugteren will order signage for the pool, Stalting Park, Rubble Site and other areas around the City on a motion by Kerher, second by J. Miller, all voted yes, the motion carried. Several safety features have been installed at the City water tower. Nugteren will bring cost estimates for a snow plow blade to the November Council meeting. The maintenance report was approved as presented on a motion by Kerher, second by O’Donnell, all voted yes, the motion carried. The following bills were approved for payment including the approval to pay the Xcel Energy invoice along with the Northwestern Energy billing upon arrival to avoid penalties and late fees on a motion by J. Miller, second by Kerher, all voted yes, the motion carried. The two late billing invoices will be included in the November Claims Listing. The finance officers report was approved as presented on a B. Miller motion, second by O’Donnell, all voted yes, the motion carried. Council Concerns: Mayor Engbarth: The first reading of Supplement Budget Ordinance 2022-14 was reviewed and acknowledged. No action was taken at this time on Ordinance 2022-11; the Council requests clarification from the City Attorney before reviewing and considering the second reading of the Ordinance at their regular November 7, 2022 meeting. J. Miller motioned, second by B. Miller to approve Resolution 2022-13, Annual Front Foot Assessment with NO increase, all voted yes, the motion carried. The Resolution is printed elsewhere in this edition of The Special. Halloween was briefly discussed, Tee shirts for City Staff were discussed. B. Miller motioned, second by Kerher to hold the Annual City- Wide Free Fall Dump Days on Saturday November 5, 2022 and Saturday November 12, 2022, all voted yes, the motion carried. A formal request was received from the Canistota Development Corporation to purchase the City owned property on Second Ave. On a motion by O’Donnell, second by B. Miller, the City Attorney will draw up the necessary paperwork to transfer the property to the CDC with the condition that the CDC will reimburse the City $12,000.00 after the property is developed and sold, J. Miller voted yes, B. Miller voted yes, O’Donnell voted yes, Kerher abstained, the motion carried. Changing the meeting time of City Council meeting was discussed and on a motion by Kerher, second by O’Donnell, Canistota City Council Meeting in November and December will begin at 6 PM, all voted yes, the motion carried. B. Miller discussed delinquent utility billings J Kerher thanked Nugteren for maintaining the gravel on 7th Ave O’Donnell has received concerns about the pickleball court in Stalting Park, the park is a work in progress. J. Miller had no concerns. Kerher motioned, second by J. Miller to adjourn the meeting at 9:15 PM, all voted yes, the motion carried. The next regular City Council meeting is November 7, 2022 at 6 PM in the Community Room, at City Hall. All are welcome to attend.
