SPECIAL BOARD OF CONTROL
Meeting Minutes
A Special Board of Control meeting was held Tuesday, November 22, 2022 at 10:30 AM in the
Mayor’s Conference Room. Board President, Mayor Bernabei called the meeting to order at
10:31 AM. Director of Public Service John Highman was present. Director of Public Safety
Andrea Perry was excused. Board Secretary Katie Wise was also present.
Visitor present was Doug Foltz, Director of Parks and Recreation.
The following items were for review/approval by the Board of Control:
11/22/2022 - Minutes
1. Ordinance 7/2022
Enter into Change Order No. 2 with The Shelly Company for the Cleveland Ave.-2nd St. NW Onesto
Streetscape Project, GP1362 in order to delay the project through the winter months, resulting in a new
project completion date to May 6, 2023 for the Engineering Department.
Discussion: No discussion.
Motion: Mayor Bernabei made a motion to approve the above referenced change order.

2. Ordinance 7/2022
Award and enter into a construction contract with Stanley Miller Construction Company in the amount of
$253,095.20 for the East Tuscarawas Streetscape Project, Phase 1, GP1250 for the Engineering
Department.

3. Ordinance 268/2022
Enter into a professional services contract with Burgess & Niple, Inc. in an amount not to exceed
$49,700.00 for the preliminary study and detailed design preparation for the installation of a variable
frequency drive at the Northeast Water Treatment Plant for the Water Department.

4. Ordinance 166/2022
Enter into a Design Build contract with Turf Alliance, LLC in the amount of $2,300,000.00 utilizing ARPA
funds for the Willig Field Upgrade Project pursuant to the design-build selection process per ORC 153,
which complies with the state competitive bidding requirements, for the Parks and Recreation Department.
Discussion: Director Highman stated that Turf Alliance, LLC was the company that completed field #2 at
Thurman Munson Stadium. Director Foltz added that they were very happy with the quality of work that
they performed on the field at Munson. They are able to meet the projected timeline for the Willig Field
project as they are able to start work this winter.

5. Ordinance 255/2022
Enter into Change Order No. 2 with The Shelly Company (A.K.A. Central Allied Enterprises, Inc.) in the
amount of $288,864.89 for the Cleveland Ave. NW Water Main Replacement Project, in order to install
services via open-cut excavation and extend the completion date to May 15, 2023, resulting in a new
contract amount of $2,454,626.89 for the Water Department.

6. Ordinance 7/2022
Enter into Change Order No. 1 with Noble Environmental Specialty Services, LLC in the amount of
$2,360.00 for the Sugar Creek Water Treatment Plant Lagoon Cleanout, Removal & Disposal of Sludge due
to additional removal and disposal which exceeded contractual sludge depths, resulting in a new contract
amount of $79,360.00 for the Water Department.
