SPECIAL BOARD OF CONTROL
Meeting Minutes
The Special Board of Control meeting was held Tuesday, September 12, 2023 at 11:00 AM in
the Mayor’s Conference Room. Board President, Mayor Bernabei called the meeting to order at
11:02 AM. Director of Public Service, John Highman was present. Director of Public Safety,
Andrea Perry was excused. Board Secretary Katie Wise was also present.
There were no visitors present.
The following items were for review/approval by the Board of Control:
9/12/2023 - Minutes
1. Ordinance 21/2023
Enter into an amendment for the Subaward Grant Agreement with Foxy Few, LLC which utilized
$200,000.00 in APRA funds for environmental remediation and demolition of the Calvary Presbyterian
Church building, clearing and greening of adjacent parcels located at 1515 Shorb Ave. NW. This
amendment allows for the remaining approximately $25,000.00 to be used towards playground equipment
and other related items for outdoor recreational use.
Discussion: Mayor Bernabei asked if this takes care of any legal issues with the amendment. Katie Wise
indicated that the amendment paperwork was prepared by the Law Department.
Motion: Mayor Bernabei made a motion to approve the above referenced amendment.
Director Highman seconded.
Vote: 2 yeas 0 nays Motion carried.
2. Ordinance TBD
Ordinance 120/2023
Enter into Change Order No. 2 with Wenger Excavating, Inc. in the amount of $306,142.92 for the Colonial
Blvd. NE Project, GP1206 due to unsuitable subgrade material, sanitary sewer repair and additional piping,
resulting in a new contract amount of $4,522,375.24.
Discussion: Mayor Bernabei asked about the status of this project. Director Highman mentioned that
Enter into Change Order No. 2 with Wenger Excavating, Inc. in the amount of $306,142.92 for the Colonial
Blvd. NE Project, GP1206 due to unsuitable subgrade material, sanitary sewer repair and additional piping,
resulting in a new contract amount of $4,522,375.24.
Discussion: Mayor Bernabei asked about the status of this project. Director Highman mentioned that
everything but the final paving will be done this fall.
Motion: Mayor Bernabei made a motion to approve the above referenced change order.

Vote: 2 yeas 0 nays Motion carried.
3. Ordinance 62/2022
Enter into Change Order No. 2 & Final with Wenger Excavating, Inc. for a cost reduction in the amount of
$131,692.01 for the Harvard Ave. Waterline Replacement Project, in order to close out the project, resulting
in a new contract amount of $1,716,949.09.
Discussion: Mayor Bernabei asked what the boundaries are for this project. Director Highman explained
that part of this project was in the NW Market Heights area. It includes the area west of Logan Ave. which
covers 35th St., 34th St., 33rd St. and Frazier. The area east of Logan Ave. will be done next year. All of
Market Heights will be completed in 2024.
Motion: Mayor Bernabei made a motion to approve the above referenced change order.
Director Highman seconded.
Vote: 2 yeas 0 nays Motion carried.
4. Ordinances 124/2021 & 5/2022
Enter into Change Order No. 2 & Final with Wenger Excavating, Inc. for a cost reduction in the amount of
$212,390.22 for the Canton South Waterline Extension Project Phase 2 and Phase 3, in order to close out
the project, resulting in a new contact amount of $4,945,441.43.
Discussion: No discussion.
Motion: Mayor Bernabei made a motion to approve the above referenced change order.
Director Highman seconded.
Vote: 2 yeas 0 nays Motion carried.
