Whereas, our community recently lost a cherished member, retired Firefighter Matt Decosta, to lung cancer; and WHEREAS, Matt, whose family lives out of the area, was never alone in his final hours, thanks to the tireless efforts of our Plain and Canton firefighters community, who ensured he was accompanied for 120 hours until he passed; and WHEREAS, Captain Eric Dyrlund of the Canton Fire Department selflessly gave his time, away from his own family, to sit with Matt, demonstrating the true spirit of brotherhood that binds our firefighting community; and WHEREAS, Canton Firefighter Ben Lasure, with his deep knowledge of last alarm services, was instrumental in preparing a fitting tribute to Matt, a service attended by approximately 100 current or retired firefighters, a testament to the camaraderie we share; and now therefore be it resolved: That we, the Members of Canton City Council, do hereby commend firefighters Captain Eric Dyrlund and Ben Lasure for going above and beyond their call of duty. Their outstanding service in this time of sorrow exemplifies the true spirit of our firefighting community and the profound sense of brotherhood and camaraderie demonstrated by all the firefighters who attended Matt’s service. Their presence was a powerful testament to the bonds that unite them in service and in grief. Now therefore be it further resolved: That we, the Members of Canton City Council, extend our heartfelt condolences to all who knew and loved Matt. His memory will forever be a part of our communities’ firefighting family. This resolution is a tribute to the unwavering dedication of our firefighters and a reminder of the sacrifices they make every day. Applause. WHEREAS, Beth Wensel has earned the respect and admiration from the City Council, Municipal Court Judges Division and the Community. Beth is a consummate professional who has been a vital contributor to the daily workings of the City Council office. WHEREAS, Beth was hired in the City Council office in January 2015 as an Administrative Assistant V; however, Beth’s length of service to the City of Canton spans 30 years, beginning in 1994 as a Judicial Assistant to Judge Poulos. WHEREAS, During Beth’s tenure working for the City she has served 5 Mayors, 2 Judges, 4 Presidents of Council, 4 Clerks of Council and many Council Members! WHEREAS, Beth was instrumental in helping Council perform well, because she performed well. Thousands of Agendas, Ordinances, Communications, Resolutions, Annexations, Replats, Vacations and Zone Changes have passed over Beth’s desk during her career and we always knew they would be handled competently and correctly. Beth has trained the 2 remaining Administrative Assistants in the Council Office so we know we can rely on them to get the job done, but they must know that they have extremely large shoes to fill; and WHEREAS, Beth and her husband Jerry have 2 adult children, Christopher and Stephanie; 2 grandchildren, Noah and Sadie; and 2 parrots, Woody, the talking parrot and Bella, who does sound imitations! Now therefore be it resolved: That we, the Members of Canton City Council and our Administrative Staff, do hereby recognize and give special tribute to Beth Wensel an outstanding and dedicated City Council and City of Canton employee, who has served with integrity and dignity for the past 30 years. Uh… for those of you who haven’t, you will have three minutes. You can monitor your time on the screens. I’ll give you a ten minute warning in case you’re not looking. And uh… please be conscious of everyone’s time so that everyone can have their opportunity to speak. Okay, out first speaker for this evening is Eric Resnick. Madam President, Leaders, Members… Frank Tyson should be with us tonight. I want it clear that I stand with his family and my neighbors calling on you to do the right thing; independent investigation, transparency, corrective action. I’ve been here before about police matters James Williams, misconduct with the George Floyd protesters. And I’m hoping to see growth this time. Now I’m Jewish and it’s important to say that, and it’s important for you know that, and it’s important for those people out there… to know that, because I am unequivocally opposed to the Zionist Project. And have been for thirty years. I stand with my brothers and sisters who speak out against genocide. The Genocide we all see unfolding in front of us every day. What kind of person can’t call for a ceasefire toward a genocide? What kind of leader can’t call for a ceasefire toward a genocide. Genocide is the crime of crimes. And if you can’t call it out, how can we trust you to protect us? We all know that you’re just a City Council, but this resolution carries weight. Our Congresswoman knows, our Senators know, our the White House knows and the care what you think, especially in an election year. Leader I learn you’re justification for not passing it, even though there are probably enough votes to pass it… when I heard… when I heard you I thought well I’ve see… heard this before. And I had because that statement that you made was not part of this council. It was a talking point from the National League of Cities Conference that the Cleveland Council, President Blain Griffin had just been on Idea Stream talking about his role in drafting. I suppose you bored it, but the truth is most of the city’s involved on creating that statement including Griffin’s Cleveland… have… have reversed themselves and passed resolutions, because it’s the right thing to do. The numbers are now around one hundred and fifty including our neighbors Akron and Cleveland. Don’t make Canton the outlier. Look we are now at 34,488 deaths in Gaza. 70% are children, 14,500 of them are children. That’s like half of this city vaporized. One of the greatest crimes against humanity any of us have ever seen. 77,643 are seriously wounded, that’s more… PRESIDENT BATES AYLWARD: Ten seconds... ERIC RESNICK: …then the population of this city. Our brothers and sisters come here week after week just to ask you to do the right thing. What in the… *Buzzer* … world are you waiting for. So now they found three mass graves uh…upwards of two to four hundred people in each of them. Uh… these people they found bond with zip ties, a lot of them in their hospital gowns… buried alive some of them with uh… IV still inside of their arms as well too. Uh… Cleveland with Case Western University, Yale, Harvard, MIT, the upper echelon of education is going against this. So why can’t we do that. We need to get ahead of this. Uh… and you guys remembered what happed at Kent State. Some of you are old enough to know you… know what happened. Uh… isn’t time to get ahead of this? We don’t need just a ceasefire at this point, we need to divest from Israel. I’m asking the City to divest from anything that has to do with Israel. They are a bad bet, a bad investment, and a bad look for this country. I thought that the US doesn’t negotiate with terrorist. No, we directly fund them. 34,454 innocent people mostly women and children and 77,575 injured. The leader of all this and his war cabinet have had arrest warrants issued by the ICC. The World Court is requesting that these people be arrested. What makes you think that US Officials aren’t next. The world is changing and the world is not going to bullied anymore. Our students are speaking and we need to listen to them. The man that passed away that was murdered, Frank Tyson, the other day. You know where I seen that exact move on, not just George Floyd, but the IDF does that to children in Palestine. This is systematic. Who do you think trains out police officers in the United States? The IDF the Israel... the Israelis. Please put out a resolution that well divest from any Israelis bonds or anything that ties us to these… evil… evil… evil… people. Respectable Council Members and fellow citizens Aslam O Alikum, peace be with you. It’s great to hear the Informal Resolutions, the dedication, the joy, achievements. Unfortunately, those of you that know me I’ve been coming here my speak is not going to be about that. I wish it was. I will be speaking again about the genocide in Gaza about what’s going on and also the current situation that is on everybody’s mind about Frank Tyson. My sincere condolences to the family of Frank Tyson and other sno… and other souls snatched away. Not by a criminal, not by forgiven power, but the very people sworn to protect. By a knee on his back, a body pressed down, the air choked from his lungs. They heard the cries I can’t breathe but they… they didn’t listen. Don’t they understand that this isn’t just a phrase but a primal plea? A desperate gasp for life itself? The US Department of Justice recommend police department to move… to move individuals off their stomachs as soon as they are handcuffed to minimize the risk of potential exophasia. Which can… which can has been fatal in hundreds of other cases in recently history. Our city needs a revolution. Not of violence, but of justice. We need legislation with teeth, with consequences. If an officer uses excessive force, steals a breath from man begging for it, they should be held accountable. Fired, charged, stripped of their badge anything less is a slap in the face to the man’s memory. To the dignity of every black person in this city. We will breathe life onto justice even if the system tries to choke it out. The time for action is now. As my brother here mentioned already, mass graves situation is… is the truth is out. The truth has a way of finding its way to those who seek it. And right now the youth of this country are outrage by the genocide, the investments in the genocidal regime of (inaudible) because they have found the truth. I’m hoping you have also found your way to the truth and will have courage to stand on the right side of history. We are not asking this local governing body for something it is incapable of doing. I’ve been a resident of this city for thirty years. I’m born and raised here. Tuscarawas County I was born and I’m sick to my stomach. This is not the way we are. I say where did out humanity go? We’re losing our humanity. We’re losing our humanity by big dollars, bug money. Zionism is big money… big cooperate money. And it’s taking the life out of us. It’s draining out cities, it’s draining out people, it’s draining our community. This money over to a foreign country. It should be right here. Helping our schools, helping our police departments, make… fixing our roads all throughout country. Our infrastructure in this nation is being sent over to Israel. This has got to end. This is the American people’s money. It’s their tax dollars. It’s what the American people labor for everyday and go to work. It’s your tax dollars. It should stay here. It’s got to end. Zionism is an evil concept. If you look at the history of Zionism right from its origin it’s got to end. I’m very sorry… I’m sick to my stomach. And when I saw the video of what happened to Mr. Tyson… I wept… I wept. None of our people here in Canton, Ohio. My brothers and sisters should be treated in such a manner. They’re human beings. We’re losing our humanity. I’m an old man. I sit in a wheelchair and I wept for all of us. It’s got to end… no more we’ve got to take our humanity back and realize that we are one people. All one people, one blood, one humanity, not divided be race, color, creed, religion, nothing… by gender… nothing. We’re human beings let us find out humanity back, please. Thank you. If you could please give us your name and residential address for the record thank you. JOSEPH BUTTS: Good evening, my name is Joseph Butts my address is 1400 Sherrick Rd SE. Uh… obviously we’ve all heard what everybody has to say about Mr. Tyson. About what’s going on in Israel and it’s heartbreaking. None of this should be happening in our community (inaudible). And uh… Mayor Sherer put the word in my mind for this conversation that’s going to take place. It’s called empathy. Mr. Tyson was not shown that empathy when he was put… (inaudible) in a position that hasn’t been taught in thirty years bin police officer training. Twenty years ago we stop doing it completely. And we sent (inaudible) set him up to check him. And then in 2020 we saw what happened, live stream for everybody to see. And we acted with emotion and anger. This time we need policy. This time we need actual change in resolutions from this body, Mayor’s office and anybody else that can. To put a (inaudible) on the ability on what these police officers are able to do to our citizens… citizens of our country. Day in and day out. Mr. Tyson may have been breaking the law, Mr. Tyson (inaudible) neither of them are punishable by death. I’m sorry that I need to be in front of you guys standing here today. I do not want to be up here for another time. Listen to your citizens, listen to members of the city, attend Town Hall meeting. The Urban League is having a Town Hall meeting on the subject of Frank Tyson this Wednesday at Mount Olive. I don’t see any reason that none of you should miss it. You should be there. This our community. As for our brothers and sisters of Palestine, we know you’re City Council we know that when you pass something is a piece of paper or a plague. It’s nothing really crazy like you know President Biden is going to be like alright lets change something, but what we can do is stand up for those citizens as well. Instead of just standing up for one group of people when something goes we need to stand up for the entire community together. Now I do appreciate the visibility that the Mayor’s office has had. And City Council has had in recent events and programs around the city. We are make strides as a city to move forward when stays in the same place. Yet, we won’t be progressive enough to tell Israel to stop killing children. It is time that we step and be the Hall of Fame city that we’re supposed to be and show the rest of the country what we’re supposed to be as a community. PRESIDENT BATES AYLWARD: Thank you, sir. Um…I’ve come before you guys on many occurrences, many times. I don’t know how many times I gotta come to you, but…I don’t know how many more bodies you guys got to collect in order to start listening. Obviously you’re starting to see the crowds are getting a little bit bigger. Obviously you’re starting to see more people are starting to be a little bit more enraged. Condolences to the family of Frank Tyson. What happened to him is abominable. Shame. And it could have been preventable had y’all listened to me prior. Now, you guys are full of assumptions. You’re full of your rhetoric and your…and your bull crap policies. And that’s what you have as a police force. You don’t have…you don’t have law enforcement. You have policy enforcement. You have a bunch of people that are wearing badges, costumes, uniforms running around here and policing the public. Not advocating for ‘em, not knowing (Inaudible) that they’re supposed to be enforcing. I guarantee that I can go to about 90% of your department and not any of them could sit there and list even the first five…first fi…five minutes of (Inaudible). Like under the First Amendment, five freedoms entitled to me. You guys can’t even…I guarantee half of your Council…and the problem is, the reason why I know you’re not listening is cause I see right over here, your Safety Director, the main ones that are sittin’ here, that need to be listening, on their cell phones. They’re over here on their pads writing crap down. They’re over just blowing us off. What’s it gonna take? What’s it gonna take for you guys to hear what it is that we’re saying that you guys need drastic reform in everything as far as from the top down. Let’s start with your Safety Director, Andrea Perry… PRESIDENT BATES AYLWARD…No, we are not going to start with any individual or you will removed. I mean, for God’s sake here’s my story…2019 I’m getting raided by the Canton City Police Department on a bull-crap accusation, talking about I’m under the influence of methamphetamines. Problem is here, I got a drug test from that day stating otherwise. Nobody wanted to listen. Then, my children are trafficked, not to one, not to two, three difference cities in New York. SKYLARK BRUCE: My name is Skylark Bruce and I live at 2216 Bollinger Ave. NE. Frank Tyson should be alive right now. At a town hall in 2020, then Captain, now Chief, John Gabbard, said it was abhorrent to watch George Floyd be murdered by police. Now, Gabbard has a chance to do right in a very similar case, in his jurisdiction. On August 16, 2020, then Mayor Tom Bernabei, said that Canton Po…Canton Police’s policies were then updated to match the 8 Can’t Wait standards to stop the worse cases of police brutality. Unless CPD has changed since then, the officers involved in Tyson ‘s death on April 18th, broke multiple policies and should be prosecuted accordingly. These are the six of the 8 Can’t Wait standards that are applicable to how these CPD officers behaved: #1) Ban choke holds and strangle holds. What else would you call it when an officer kneels on someone’s neck for eight minutes; #2) Require de-escalation. The officer moved immediately to physically restrain Mr. Tyson. Common de-escalation techniques can include respecting personal space, choosing not to touch someone who isn’t actively harming anyone and listening to their concerns. There was zero attempt to do any of these things. Also, Mr. Tyson may have just been injured in a car crash. A simple, “are you hurt”, “can we get you help” may have gone a long way; #3) Require warning before deadly force. At no point did the officers warn Mr. Tyson that grave harm could come to him. In fact, Mr. Tyson repeatedly warned them of the risk that they posed to him. How many times did we hear him repeat, “They’re going to kill me”; #4) Exhaust all alternatives before deadly force. After the officers wrestled Mr. Tyson to the floor and handcuffed him, this would have been an excellent time to sit him up, bring in EMTs and/or remove him from the building. But no, the officers did none of these; #5) Duty to intervene. Multiple officers were present besides the officer who used his knee in a deadly manner on Mr. Tyson. Any of them could have said, “No, we’re taking this too far.” Their silence speaks to a culture of callousness in the Canton Police Department; #6) Require use of force continuum. This basically means officers should not use more force than needed in a given situation. Given that Mr. Tyson told them that he was having trouble breathing, that he was worried about his own imminent death, and that he stopped responding long before the officers bothered to check on him, this says far more force was used than necessary.
