And I believe there may be some Old Business. Uh … Leader Mariol. MEMBER MARIOL: Madam President, I wanted to address a few things that came up in uh … Public Speak. The first um … there was a gentleman who spoke about, um … an interaction that he had during a traffic stop COUNCIL PROCEEDINGS JOURNAL 112 JOURNAL PAGE 379 MINUTES OF THE MEETING OCTOBER 7, 2024 um … the Canton Municipal Court covers essentially most of Central Stark County. Um … our Law Department contracts with a lot of villages and townships that while they’re not in the City of Canton um … they use our Law Department as legal uh … representation in Canton Municipal Court. The interaction with the officer did not happen with a Canton Police Officer, it happened with a part-time Magnolia Police Officer. So, outside um … the City of Canton’s Police jurisdiction but being that Magnolia uh … those cases go to Canton Municipal Court. He would have um … came through Canton Municipal Courts. So, I wanted to clarify that. Um … regarding a Community Relations Board, we do have a board currently. If anybody wants information on the membership of that board, it is on Cantonohio.gov website under the Boards and Commissions. So you can see the executive order that created that board and who serves on that board and the length of their term. Um … finally regarding um … traffic stops and a grant that we received for um … increase uh … traffic control um … that is specifically for the highways that go through the City of Canton. So Route 77, Route 30, and Route 62. So, while those go through Wards, the grant is to increase um … traffic safety um … on those main thoroughfares. Good evening, first off I would like to extend my gratitude to City Council for allowing us a few brief moments to speak our minds COUNCIL PROCEEDINGS JOURNAL 112 JOURNAL PAGE 388 MINUTES OF THE MEETING OCTOBER 7, 2024 before promptly ignoring us again. It is truly an honor to witness Democracy at work. Tonight I want to talk about how the city treats its residents … thank you very much. More specially let’s talk about respect or should I say the lack there of. Time and time again when citizens bring up genuine concerns, they’re met with eye rolls, impatience sighs, and condescending smirks. The disrespect is so normalized here it’s almost expected. You want to know what would actually be revolutionary? Showing the people you serve a bit of basic decency. The level of decorum you demand from citizens is somehow higher than what you expect from yourself or the police. We’re expected to stay calm and carry on while being dismissed, yet law enforcement and city officials’ can lose their cool with zero consequences. Which are apparently only reserved for citizens you deem out of line. But even those consequences aren’t applied equally either. I’ve seen it myself. Often when white people raise their voices or use strong language, they’re often brushed off as expressing themselves. But when a black women, my wife, Sierra, shows passion or deviates slightly from your expectations, the reaction is immediate and serve. Rather than holding others to that same standard, you’d soon shut the whole down … the whole meeting down. When a black woman speaks up, suddenly we’re calling for order, threating penalties or worse, calling the cops to arrest them. And we … and we all know who those cops are really protecting. It’s not the people being cuffed for daring to speak out. Let’s be clear, this isn’t about enforcing rules, it’s about selectively enforcing them. The hypocrisy is blatant and it’s not an oversight, its an intentional display of power. Criminalizing black women for speaking out sends a message, to stay in your place. As a white guy, I can’t ignore how disproportionate these consequences are. The penalization, criminalization, and brutality aimed at the black community by city officials’ and the police aren’t just unacceptable, they’re shameful. And yet, you’ll go home thinking you’ve upheld some moral standard. What’s really being upheld here is continued oppression. So, as you sit there comfortably on your high horses, dismissing everything I’ve just said, let me remind you, history doesn’t look timely on those who stay silence or complicit in the face of injustice. I hope you’re mentally prepared for when the history books come for you. Thank you for your time. I suspect you already stopped listening, so. And that I yield. PRESIDENT BATES ALYWARD: Thank you, Mr. Jackson. (applause) Our next speaker is Ms. Skylark Bruce. Ms. Bruce. SKYLARK BRUCE: My name is Skylark Bruce and I live at 2216 Ballinger Avenue Northeast. Today marks one year since Israel went from an oppressor state to a genocidal state. We remember the 41,000 and counting dead Palestinians and the much smaller number of dead Israelis and the creasing number of dead Lebanese people. Please join me in a moment of silence in their honor. (moment of silence) Thank you. We are frequently told that the rules matter, that decorum makes a difference. I would love to be able to tell our community, with sincerity, that they’ll get further if they’re polite. I would love to be able to tell our community in all seriousness, that their message will be heard and acted upon if they keep to a certain volume. As long as they don’t cuss and they’re deferential to city officials. I would love to be able to show off a list of policy changes and life saving measures implemented in the last four and a half years because we advocated in the acceptable way. That justice will happen when you do it this exact one right way. I would love to be able to tell you that Darrell Ross and Ja’ron Nero we’re the last people unjustifiable killed by Canton PD, or that Frank Tyson will be the last. But I can’t. And you can’t. The truth is, that it doesn’t really matter if someone yells and screams, it doesn’t matter if that person presents their concerns in an organized concise matter or if they get up here and share a string of consciousness. It doesn’t matter if they cuss, it doesn’t matter if we only speak for three minutes or less or if we lift up our voices at another time. There are sometimes consequences if someone yells too loud or too long or if you’re black. Any objection in any place, at any time, can mean arrest and charges. Thank you to Destinee Jackson and Sierra Mason for lifting up their recent experiences on this. But it would appear that there’s basically nothing to be gained by following some arbitrary rules of decorum. All stick, no carrot. Tongue policing is just another misdirection. Sure, two officers were fired after abuse of community members this year as they should have been. But, they’re not the officers whose actions resulted in deaths. COUNCIL PROCEEDINGS JOURNAL 112 JOURNAL PAGE 389 MINUTES OF THE MEETING OCTOBER 7, 2024 Those officers got an unscheduled, paid vacation and if police department history repeats itself, they’re up for promotions. I can’t hear you when you say it like that, is not the same as, I hear you and take action when you say it the way that I like it. You know what we call people who love order, for orders sake? First of all I just want to say that public speaking is an incredible fear of mine so I apologize for any misspeaks. Um … with that said we’ve seen a numerous amount of incidents with Canton police abusing their authority and allowing them to do so, you have completely eroded the trust in credibility you have with you constituents. We do not feel that you have our best interest at heart. If you did you would have immediately fired and charged these officers who continued to brutalizes these communities. If you did you would have passed a Ceasefire Resolution that your constituents overwhelmingly expressed to you that they supported. You have the power to set the precedence for what is and what is not acceptable, so please step up and do it. Listen, and I mean actually listen to us, not just pretend. I think it’s important to acknowledge that these are not isolated incidents. Canton police is not the only police department with extreme patterns of violence, this is a deep rooted, systematic issue that is a direct consequence of racism, lack of adequate training and education, and a lack of accountability. If anyone else in the work force kills somebody on the job they would be fired and charged. Why should police be held to a lesser standard than anyone else in the work force? Does it make any sense to have qualified immunity over the same laws that you are suppose to be enforcing? Someone mentioned this a few weeks ago, but by that logic we should all just become cops and start doing whatever we want. You’ve started, started to take small steps in the right direction with firing these officers, however that is nearly a drop in the ocean of change that we need regarding them. These officers, responsible for the deaths of Zach Fornash and Frank Tyson, need to also be fired and charged, instead of essentially giving them a paid vacation. You have two hundred plus years of systematic racism to dismantle and today is as good as any to start. You have the opportunity to be remembered as leaders who championed for changed and made a tangible difference in their citizen’s lives. Please act accordantly. You can be apart of this solution. It’s not fair how we’re all being treated by Canton PD. Um … I actually was in a car accident, December 16th, 2022. I have my evidence um … I’m actually a mother that’s been fighting Stark County CPS for my child for false allegations. I feel like the system is broken. I feel like we all need justice everywhere. Um … families that are broken um … my left leg is swollen because my uh … car crash report was actually in my evidence. I was given a police report from an officer and it matches my crash report and I do have my evidence with me. Um … I’m just … I’m hurt, my mother was actually um … her car … car accident is in my evidence. She’s in a nursing home um … hers was 6/2/2021 when she had the car accident um … I feel like these lawyers are not doing what they’re supposed to be doing. Um … I feel like the system is just, it’s broken. And I think we all need justice because the cops out here … I’ve had a … back in 2022, the year 2022, I was actually almost pushed off the road from … from an officer. I mean I feel like the racial profiling. I mean this is … this is wrong. You know we all have our … they’ve been violating all of constitutional rights. Um … like I said I’ve been fighting for my children since the year 2019 and my charges have been dropped and I’ve actually been double jeopardy, and it’s not right. Um … I feel like families out here that we all need to stick together and stand up for our rights because these cops are doing wrong. And I’m sorry for the families out there that’s lost their loved ones. I almost lost my mother and it was pretty tough for me as it is. But I feel like it just … this system needs to change. October is Domestic Violence Awareness month. Canton, Ohio and America are experiencing domestic violence pandemic. In Canton, in Massillon, the women’s domestic violence shelters are overwhelmed and the resources that they provide are inadequate. Our prosecutors laid down on us, our judges laid down on us, the police laid down on us. The Harriet Tubman moment can only give us Summit County human trafficking. How come Stark County doesn’t have our own human trafficking member board? (applause) Prosecutor Kyle Stone, as handsome as he may be, and a eloquent … an a eloquent speaker voices concerns about domestic violence increasing and that justice is required. But is his battle cry with us or just clout chasing for social media likes. The United States of America Incorporated, is a pyramid structure. They believe in the trickledown theory. I am COUNCIL PROCEEDINGS JOURNAL 112 JOURNAL PAGE 391 MINUTES OF THE MEETING OCTOBER 7, 2024 here to tell you that this mean spirit, cruel, lose of respect for women and humanity is indeed starting at the top and trickling down into our homes. It is almost like the United States of American is slipping back into women’s suffrage and that a group of men and women are under the spell of (inaudible). I don’t know the English equivalent to that word. It’s a German word meaning that you are seeking enjoyment and uh … pleasure from other peoples pain, misery, and suffering. Women everywhere are getting our lives and bodies beaten in sports, in the streets, in crossing our boarder, in Hollywood, in radio, in every aspect of every arena ... PRESIDENT BATES ALYWARD: Ma’am … RANAE ULRICH: And in our homes. PRESIDENT BATES ALYWARD: Ma’am your time is up, if you could wrap up. Thank you. RANAE ULRICH: Okay, yes. When a women must reach for a police officer for a show of force, we are then being re-victimized and there’s a lack of justice. PRESIDENT BATES ALYWARD: Okay, yeah. (applause) Our next speaker is Ms. Cassandra White, Ms. White. Oh, I’m sorry, I’m sorry, no it’s Sierra um … I skipped you. It’s Sierra Mason. I’m Sorry. I … I’m sorry Sierra, go ahead. SIERRA MASON: Sierra Mason, 2110 Market Avenue North. No disrespect to Frank Morris, frankly I do wish him a speedy recovery as well, but once again we honor an official who is recovering; however, there was not wish for good health or recovery for victims Kieven Convers or Jamir McElroy who are victims of the police department that you fund. Who is supervising these officers? Who is supervising their training? There’s no clear answer of that online, the community wants to know what’s going on with their training lately. And re … in the past few years, there’s been a multitude of incidents and a lack of successful investigations. So, who is training these officers? Who is making sure that the training is getting to them. That they’re actually doing the training and that it’s not just some online course that they’re able to skip through like we were when we were 15 and 16 getting our first job at McDonald’s. When officers show up to calls they’re not deescalating the scene, they come in more amped up than the suspects that they’re arresting. Often being rude, lacking human decency. The community does not feel safe calling the police department. In many cases of emergency, because they’re fear … fearful they will end up worse than what it was before they called the police at all. Madam President, you’ve shown immense disrespect, not only to the disabled community, but also to the family of Frank Tyson. You rudely interrupted the brother of Frank Tyson and claimed that you understood what they were going through, which you don’t. You lack empathy more than most of your colleges, you’re snarky, not funny, and unable to control your meeting. I’m wondering if you were briefed with how well the meetings went when somebody else was in your seat. (inaudible) Lastly, telling your citizens you’re done, multiple times, while rolling your eyes is not how I would expect a public office … official to conduct themselves. Andrea Perry, the Safety Director, last week you left the public speaks meeting and end of City Council Meeting with a plethora of emotions. I can only imagine that you felt a bit of … a bit attacked maybe we can say, even triggered. This is a natural response COUNCIL PROCEEDINGS JOURNAL 112 JOURNAL PAGE 392 MINUTES OF THE MEETING OCTOBER 7, 2024 to somebody, who has been called out multiple times, publicly, without being able to say anything. As an active community member I understand the importance of remaining unbiased however, your body language and the way that you carry yourself during public speaks has lacked human decency, empathy, and frankly compassion for your community. There are many states that’ll … there are many things that all of you guys could take to make your community not only feel safe, but feel welcomed during public speaks. There are many people online who want to be here but literally chose not to be here because they know that they’re not going to be heard. I didn’t even expect so many people to talk about the miscon … the mis … the unprofessional conduct tonight, but frankly I’m glad so many have. It’s shown time and time again that you guys need to really refresh on your professional development, (inaudible) development, and frankly, go over your policies. PRESIDENT BATES ALYWARD: Thank you, Ms. Mason. (applause) Okay, now Ms. Cassandra White. I’m sorry. CASSANDRA WHITE: Alright Cassandra White, 816 2nd Street Southeast. Um … I don’t think I need an introduction unless y’all weren’t paying attention, my name is Cassandra White and I’m Zachary Fornash’s mom. I’m here tonight to discuss the body cam footage that was released last week. It was the incident on August 25th, 2024 involving a 911 call about a white male chasing a black man with a gun. Canton police department pulled up to a house with a white man on the porch, with two holstered guns and knives in his boot to check to see if he was the man in question. I’m not here to discuss if everything that happened that day was right or wrong, but to point out some facts from that day. What I observed was an America citizen detained and striped of his second amendment rights for matching a vague description. No guns were pulled at the suspect, no screaming at him saying they were going to shoot him. A situation deescalated by patience and a man handed back his guns and not placed in a body bag. What I heard the officer say, “I’m only trying to deescalate the situation, since you walked around with a gun we’re going to have a problem. We are only given minimal information when we get calls. I could understand if you … would have been worked up if we would have pulled up on you with guns pointed at you.” Maybe these two officers should teach the training courses. The 911 calls that happened on these days, that all the other victims of Canton died or injured, those officers did not show up in that mindset. They came guns pointed at victims, knees to backs, bullets through fences, letting dogs lose, and kick and complying uh … kicking a complying citizen. So what is the difference between all those? To me that shows the racism … racism and lack of proper training in your police department. It shows based on a minimal information they’re given, the neighborhood they’re called to, and the color of their skin is how they handle the situation. Now I know you all are thinking, my son is white, yes he was but do you all know how many people that have told me that Zachary had no change because of the neighborhood that he was in and because his hood was over his head. If the officers that … ha … have been in excessive force cases took a minute before rushing to judgement to analyze the situation, maybe we wouldn’t be here today. Last time I checked we all bled the same blood and deserve to be treated same in all aspects of life. Nothing will ever bring these men back but we could all work together for change and accountably. Because I don’t know about you but I don’t want to see another mother plan a funeral at the hands of a Canton police officer. Justice for Zach Fornash and justice for Frank Tyson. ROGER GATES: Alright, first of all I’d like to start this off with, that the separation of church and state is not meant that we are allow to bring (inaudible) into the government. It was meant to keep the government out of our churches. With that being said that is a fundamental right amongst all of us as American people. That is what our country was founded on whether you’re Muslim, whatever, we still have one God. With that being said I’m going to move on to a little situation about my son and I’m going to leave it at this. I … I’m going to do my homework on our Community Review Board. I do not have the knowledge to be able to apply my wisdom to it yet. (Jolanda Jackson yells from audience) That’s exactly it I want to see … I want to see what you’re offering. That’s what I want to see. I want to see what’s coming to us, we the people, everybody. This is for us as well I’d like you guys to read. As I was told by public officials’ that our rights are not being violated, okay. I want you to refer back to 2020 Gates verses the State of Ohio. You want a carbon copy of what just happened to my son? You got it. This is five times, not once, not twice, not three times. Five times. Five. Now, if you can justify that to me and tell me that his rights were not violated, then I’ll bow down and I will apologize to you a thousand percent. Do your homework. We the people are coming and were demanding these answer. Tactical training for our police officers is leading to this, and it’s not just here. It’s textbook across the border, across the nation. The people … we the people movement is coming and you know what them folks in Appalachia, they got it a thousand percent right. Are you our FEMA or are you part of we the people? (laughter from audience) DANIEL GATES: Can we move it back a little? My name is Daniel and I’m from the United States Constitutional Republic. Mr. Mayor I have a question for you, am I allowed to cook a chili and come over to the Harter Heights uh … community town meeting? What happened to unity and transparency? So, are you dividing us neighborhood by neighborhood now? Are those the people who are going to comply? Are those the people who aren’t going to object? Are those the people who are going to invest, are those the people who are voting for your Hall of Fame city because it doesn’t effect where they’re located at because they match the suburb area that you want to zone the entire city for? I don’t want to be California, if I wanted to be California I’d live in California. Somebody have an answer, if I may come? Because I would really like to compete. I think I could make a good chili. Point of order. I asked a question. PRESIDENT BATES ALYWARD: We … we don’t … you know that. We don’t respond but continue. As my father said it has happened to me five times and I’ve been told that these are not (inaudible) of the facts of everything that happened that day. We have video evidence of everything that happened that day, of officer (inaudible) in the streets. Um … the Internal Affairs tells me personally through phone call that one of ya’ll, one of y’all requested for that officer to be here specifically. That was his words, you can call me a liar but I ain’t a liar. Alright. Now the other thing I want to talk about is that there is slander going on my name now. There’s slander. Right on you guys public page which I am not worded specifically in the police report. But you go on the Canton city page, and look my name up, I’m the first one that comes up as the disrupter of … of the public speaks section of the public speaks that day. Okay, but it was my time, it was my time how can I interrupt my own time? And … and furthermore if I wanted to interrupt my own time I can. It’s the First Amendment. You, Madam President, you interrupted my time. I didn’t find a disruption from any of these people out here that’s standing behind me or with me because we are the people. We the people.
