PRESIDENT PRO TEM MARIOL: Actually, I was going to do that for my invocation, if that’ll be alright for you? Okay. So, tonight’s invocation will be given by uh … myself. Um … so, as many of you know um … Member Hawk, Ward 1 Councilman, passed away. Um … I have been on Council for twelve years and when I got on he was a huge um … mentor, helped me learn a lot. I know that everybody here has probably experienced that um … I went to see him in the hospital and he wanted to talk about city stuff and it just is a testament to his commitment and his love of this city. He made a huge impact and this Council will not be the same without him. With his impact to the city I will also say that um … as much as he lit up talking about the city, he lit up talking even more about his grandson and um … it was always a nice time to be able to talk about my kids and hear about his grandson. Um … he was very proud of his family, very proud of his daughter and his uh … grandson and I know that they are um … hurting right now. We should keep them in our thoughts and prayers and with all that being said I’d like to have a moment of silence to remember our good friend and Ward 1 Council Member, Greg Hawk. ROGER GATES: (inaudible) My names Roger Gates, my address is 611 Smith Avenue Northwest, Canton, Ohio. PRESIDENT PRO TEM MARIOL: We’re having a little technical difficulties once second. Clerk, if you could take a look at that. ROGER GATES: Looks like the powers not on. Can you hear me? (inaudible) I got to be right on top of it. Cause it won’t pick up back here. I got to hit it, I got to start rapping. (laughter) Alright, anyways I’m here I … I came again tonight to talk about manipulation. Manipulation is toxic in any relationship, anyway you look at it, how you deal with it is where respect and everything comes in. The way that you deal with it is through the laws, the rules, and everything else. We have (inaudible) rules, we have (inaudible) the laws we trying to use them to communicate with you because we still have those rights to be able to do just such. Now, we’re getting resistance from it and that’s fine, but we have the right to be heard. Which it brings me to my second point, I looked at the Census for 2025, do you not realize that we’re almost at a 16% deficit for 2025 and people leaving the county. How much of that is going to be right here in Canton, Ohio? You guys are talking about raising rates and stuff next year, are we going to have the raises because 16% left Stark County again? Or are we going to experience more? You’re driving us out of the city, we can’t afford to live in the city anymore. I ... it’s … it’s getting ridiculous. Now, you speak of spending all of these millions of dollars instead of investing into the community and one of our major people on this board here (inaudible) said he was happy when the 9th Street Steel Plant closed down. That was uh … that … that’s still jobs for here in Canton. (inaudible) if we don’t have them people here, then we don’t have … we don’t have nothing here. What are we going to do? We’re going to survive on a service oriented industry. Is that what we’re going to do? Because it’s not going to work because you have to manufacture something, at least some of our work in economics class. So, my problem is, is that I came here time after time and I told you that we were coming here to try to help. The solutions that I’m giving you are right here in this. Start paying some attention to the community. The elderly can’t just pick up and move COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 88 MINUTES OF THE MEETING FEBRUARY 24, 2025 like many of these young people who can that are exiting Stark County. There’s no pentions anymore so a lot of the elderly does not have the money to be able to do that. Many of the things that you … that are being voted on … most of these people don’t even know what’s going on. The committee meetings are not online, there’s not any kind of … anything about the Committee Meeting. According to the law it’s suppose to be there we have folks that we give information to that work until seven, eight o’clock at night and they go home. They’re elderly, and … and they hang on to everything that we put out there for them to have an understanding of what’s going on from you folks. We do it every week. We talk to people, we’re in the community. The community out here, they’re scared. You guys need to help them. We the people. PRESIDENT PRO TEM MARIOL: Thank you, Mr. Gates. Next up we have Daniel Gates. If you can come to the uh … microphone and give your name and address. Thank you, you have three minutes. DANIEL GATES: (inaudible) Hi, my names Daniel Gates uh … I live in the United States Consitiutional Republic. Um … I’m a firm believer in giving credit where credit is due, so, whoever is responsible for taking all those gang emblems off of the crusiers I … I applaued you, thank you. (applause) It’s gone, now lets work on getting an American flag on that cruiser. That is somethings that we can stand by, we’re not anti-police (inaudible) we’re not anti-law enforcement is what we should say, okay. Because we do respect those that respect the law. Anyone that violates the law should not have any immunity and it states it in the Ohio Consitution already. (inaudible) did not have them. So, you know the um … coalition to end the immunity that’s definitely something that I believe the City Council should stand by. You cannot feel threathen by your police force being you know, A plus . If they’re not A plus then I can see why you’d be worried about any qualified immunity. You saw what happened over in Akron. They’re using qualified immunity for an accident that he did, while not following protocol. That’s not immunity, that’s not what that was used for. That’s for like if a child got shot in the line of duty while he was trying to arrest the robber, that’s what immunity was for … for … for something that was … because this man right here, who’s doing a crime, I had to do this in the line. Okay? Not because this guy over here. That’s not how that works. They can’t just … otherwise you are encouraging the law enforcement. Like … like Madam President siccing the police on me to do something that they do not want to do but they know that their job, their livelihood and their money is at jeopardy. That is a problem. You are now encouraging officers to break the law. You’re giving them a way to do it but we all know that there’s been bad cops from the beginning of policing. To be honest with you, policing goes back to the slave days, when they were going after slaves. The Sheriff had the jurisdiction (inaudible). The slave drivers had the authority over policing, that’s why we say we do not agree with the police we agree with law enforcement. I don’t want to have to called the Sheriff’s down here, they don’t like me. (inaudible) but whoever did that, I greatly appreciate that. We say no to gangs in Canton, bottom line. Whether it be the police gangs or the street gangs we don’t need no gangs around here it only creates more problems, it drives out the populate which is already decreasing because of the raise (inaudible). (inaudible) Gates for Ward 1. (applause) PRESIDENT PRO TEM MARIOL: Thank you. Next up we have Justin Nicely, if you could come to the uh … microphone and give your name and address. You have three minutes. JUSTIN NICELY: First I want to say (inaudible). My names Justin Nicely, Canton Hall of Shame, I stay in Massilion, Ohio. I’m here today to publicly call out Safety Director Andrea Perry, our Chief of Police John Gabbard, Law Director Jason Reece, Interal Affairs Officer Shackles, Prosecutor Katie Gilbert, Bailiff Jack Jones, Bailiff Lindsey Trent, Bailiff Dan Yeager, Bailiff Butterfield, many … many Canton City Police, Officers all of being guilty against crimes against the public and record destruction, evidence tampering, conspiracy to charge violations of the U.S Code (inaudible). Now that package I gave you that you have infront of you is the 9-1-1 dispatch from October 23rd, 2023 when myself (inaudible) of Ohio (inaudible) child (inaudible). Came here to set an appointment with Andrea Perry. Andrea Perry decided to call 9-1-1, claiming COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 89 MINUTES OF THE MEETING FEBRUARY 24, 2025 my name is Kevin Mullaly and creating a disturbance but then have us ambushed by eight officers. Execpt the (inaudible) and my caseworker are going to say otherwise. What you also have is a copy of the disposition of the words from the Interal Affairs Officer Shackles, who’s very much involved in what took place. Yet with the investigating officers of the matter confirming (inaudible) and Chief of Police to be here November 7th, 2023, where I was engaged for no reason and forcibly removed out of the building even though both the Chief and I.A Shackles where told to inform the bailiffs of my set appointment. And the point lastly that is that the copy of the formal records request that was time-stamped, received by your officer November 9th, 2023, two days after November 7th attack. Nobody said I was asking for the city lobby footage, the police lobby footage, officer body camera footage of all officers involved of all incidences. Personal inquires where made for this footage on November 18th , December 11th , December 21st of 2023 and January 2nd of 2024, where I was attacked again! And this time charged, we’ll get to that later. Follow along with me here as it states right there on that I. A. report from Officer Shackles that inquiry wasn’t made for the footage until January 8th from Lindsey Treat. To which it states, the November 7th copy for which couldn’t be located because it’s past the 34 day retention period (inaudible). Now, how’s this even making any sense when I got the footage from the city lobby October 23rd , 2023 sitting right here. Now, you’re saying the city lobby footage of November 7th couldn’t be located because it’s past the 34 day retention period but that’s two days after I put in for records request but, three weeks prior this footage was. Someone make it make sense. Now, either someone is lying or y’all are just trying to cover up what the hell you did. (inaudible) Now when is the city lobby footage … where’s the city lobby footage from November 7th? When am I going to get it? When is the standard operating procedure for the investigating officers to be the one that was involed with the original attack in the first place that set me up. You guys are talking about we have grevience proceedures, no we don’t. Every time we try you guys intervene, you don’t know they laws, you don’t know the Ohio Director Laws that prevent us from being able to even go about basic proceedures. When does it end? When am I … (inaudible) PRESIDENT PRO TEM MARIOL: Thank you, Mr. Nicely. Next up we have, David Kerestes. David you can come to the uh … microphone, give your name, address, and you have three minutes. DAVID KERESTES: David Kerestes, 626 Market Avenue. I guess he asking when he’s going to get some help but see I, many years ago, back in the 90s, had my daughter beaten by (inaudible). I was blamed for that and the court never really did anything because it wasn’t me but he got away with it. I went to Lieutenant Bosley about being threatened by this guy everytime I dropped my daughter off. That didn’t help. This was after Lieutenant Swank, who was the patrolman, who was harassing me and he hurt his dog, Bear, right down here by that Canton Park when his face bounced off the cage. Okay? You people have been harassing the community clear back into the 70s, okay. And it’s going on to this day. Jim Riddell and … and Lieutenant Swank they get the dog, they hurt they K9 and then I was (inaudible). Ain’t that (inaudible). And Jim Riddell, the one that got kicked off for unethical conduct in the car. Well he’s a Air Marshall. Chief Wainuski, the guy that wrote there was no incendiary device in my truck and there was pointed out by Jeff Vancouski. Then he’s over at the library investigating the fire there and they cover up and get rid of him and now he’s a detective in Navarre. The last person to do any time for any crime was Sam Buroni when my dad turned him in. He was renting off of Rick Shuring out of (inaudible) Barber Shop when he went to jail. You people have been affiliated since the 70s. Now, in 1967 (inaudible) had me burn his house at 617 Delton St. I was five years old, he almost killed me, okay. I was an American Veteran of our country. Sam Perzon and Mick Mckinney were selling dope out of Hector’s … right next to Hector’s Ammico in 1977, when I worked there. And who represented my father … and helped him? FBI Fred Sturges when he chucked him under a bus. You people have been pagen (inaudible). Now I look in to drugs, in 1906 the Food And Drug Administration was created. Okay, these drugs are causing your cerebral cortex to dissolve and you have no con … cognitive thought anymore, okay. I got hit in the head at the Massillon Jail turning in Jason (inaudible) for forty key’s of meth. That’s what happened to me, okay. But you have been dirty your whole life and so 1906 (inaudible) in the back that people are putting cocaine, heroin COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 90 MINUTES OF THE MEETING FEBRUARY 24, 2025 and all these drugs into the food of the American population, Canada, all of it. We’ve been poisoning the brains of these civilian population for a long time. But um .. first I want to let you guys know … I know you’re aware that I’m a … I’m a write in candidate now for Canton City Council- At- Large. After I saw Bill Smuckler on there I was like (inaudible). The reason why we can’t get the … the … the black community can’t get nothing done in this room that we want, because we keep voting for people that don’t look like us. We were taught to disgard the change but vote for people that don’t look like us. Putting them in office, so of course they’re not going to address our issues. I mean we have a few up here but I say it should be a couple more up here to (inaudible). But the photo I just sent you around is uh … the North East Community Center now, and I also put in there the little uh … what … what I sugguest should go into that building and the other photo is uh … I think that’s (inaudible). But these buildings in the black community are empty I mean put … put a food something (inaudible) food or soul food, something for these young people to want to get up in the morning and come to a class where they can learn plumbing, where they can learn some kind of trade to bring in to their to … to start a company or something. These robots that Elon Musk created is not going to be able to do certain things. We need help from the city to open up these buildings I just gave you photos of and let’s utilize what we already have instead of building. Like I said, when they build the addition to uh … Crenshaw, I wish they would have just extended it up to that Community Center and tried to utlize it. I mean you could have cemented the pool in there and used … we can still cement the pool in there and use that building, for something but I have more next week and John re … remember you told me about something about helping with jobs. First I want to start off with a quote ”When you see something that is not right, not fair, not just, you have to speak up. You have to say something, you have to do something” That’s John Lewis. This our last Monday at City Council (inaudible) I listen (inaudible) our issues we’ve had. I want to tell you too, I want to say thank you for listening to us. Even though you might have not came to those table to work with us, we notice what you’re doing the de- escalation training. We notice that one of those officers got fined and we also have been noticing that there’s more police training involved and guess what Officer Sharpe’s back in the community. We seen him that day y’all had We Believe in Canton. The very first one y’all had, y’all made sure that Officer (inaudible) got there and I want to tell y’all thank you. That meant a lot. So I know you’re listening. I know you just not going to sit at a table with us but I know you hear. And I know (inaudible) over someone trying to cut you off but I’ve never seen (inaudible). You’re the first black women sit in your position that you sit in in the City of Canton. I know it’s hard, every black woman, even without that title, it’s hard to be this. So, I appreciate what … what you did for listening, working with us, doing what you need to do. I appreciate you. But I … I think you need to here that. From another black women, we appreciate you sis. Alright, next … next thing coming down here to the uh … Committee Review Board. We didn’t have one in December. They can’t have one because they can’t get a quorum. But this is our Community Review Board about the police here. Now I’ve been quite for (inaudible) and learning. I don’t want y’all (inaudible) because I’m not. Another subject is I want to know how … how is these people getting all these buildings? I’ve seen Stark Fresh, Stark Mart, uh … and also Ohio Deli getting … building properties, for one dollar. I want to know how you’re doing that. I have documentation going to you County Commissioners seeing that the land bank is not available for us. I’m going to (inaudible) I don’t need y’all help I just need y’all (inaudible) some of these properties that people are getting for a dollar because what do you want? Hundred and fifty? Ten dimes? Four quarters? Any nickles? I got it all. (laughter) What’s up? That’s all man. You know I’m never coming down here on no grrrr, that’s not me. I’m melanated and educated so I know what I’m doing without y’all, you understand what I’m saying? I just want to know that this information is available to us that we can utilize ourselves. Because I know Akron’s Land Bank, you can see it on the internet. I can’t find y’all’s. It’s nowhere to be found not even the county’s.
