Uh… when you come up to the uh… podium, if you could please give your name and your address…uh… we will start with… Daniel Gates. DANIEL GATES: Hello my name is Daniel Gates and I live in the United States Constitutional Republic. I have something in my hand here that all of you council members, should, and I hope, recognize. Rule #46, amending Council Rules. The rules and procedure of council may be amended or altered or new rules adopted by Resolution only at any regular meeting of Council, by the vote of two-thirds of all members of Council as defined by Rule #40 (B) (2). That was not done for this supposed rule that Madam President made to dictate… against me. Now we move to Rule #50, Violation of Council Rules. If any member by virtue of his or her conduct or speech violates any rules of Council, the presiding officer shall call the member to order. Or any… another member of Council may raise a point of order. For the purpose of challenging the conduct or speech of the member and calling upon the presiding officer for ruling and... and enforcement of the rules. That was a violation of the rules and not only that the integrity or the courage to do so. To step up at the time and call point of order. She violated my rights and Starr Fear’s rights under the Constitution of the United States. If a member is called to order, he or she immediately cease his or her conduct or speech. Unless permitted by the presiding officer to explain his or her conduct. There was a conflict of interest with the presiding officer at that time since she is in violation of this. The question of point of order does not require a second is without debate and must be decided by the pre… presiding officer by first requesting the member who raised the question to state your point of order. The presiding officer upon hearing the explanation shall decide the point of order. And if the decision is in favor of the member called to order, he or she shall be at liberty to proceed with his or her prior conduct or speech. If the decision is against the member called to order, he or she… shall immediately see such prior conduct or speech. Section D, since there is an official expression of disapproval passed by Council, any member violating Council rules may be censored by the vote of a majority of all members of Council as defined by Rule #40B1. Members are also subject to punishment and exposure as provided by RC 73…1. 45, which that right here the legislative authority of a municipal court were they shall determine its own rules and keep a journal of its proceeding. Now the journal of the proceedings, that all was all left completely out. That is… right there withholding evidence. That was disorderly conduct for sure against the Constitution of the United States. It is also a violation of US code title 18 section 141 and 142. And I hope you guys all have a vote on this. PRESIDENT PRO TEM MARIOL: Thank you, Mr. Gates. Our next speaker is Roger Gates. If you could come to the uh… podium. The beginning I forgot to say, most of you have been here but, uh… there’s a timer up there and everyone has three minutes. ROGER GATES: My name is Roger Gates, I live at 611 Smith Ave NW. Last week, I spoke up just before Madam President decided to violate my son and Starr Fear’s rights. I just talked about them rights that are being violated that you guys feel that aren’t rights. When I said we the people are coming, it’s not a lie. We’re tired of it. We can’t… we can’t survive anymore on this. Alright? if you censor us and we cannot come to you all and be able to speak our minds and be able to tell what we fell and what our communities are feeling, then the City Council has no insight. They have no innovation to see what’s going on. I don’t know whether… any of you lived… I… I’ve lived… I… I… had some things that probably were questionable, but back in the day there wasn’t a such thing as the internet. Now, the one thing I would like to say before I leave here is the two officers that were in here the last week, Madam President put them… men gentlemen at risk on an unconstitutional bases. If she wants to put her own career… on… duress… have at it. Don’t do it to them. I believe that our City Police Department during the right direction with this De-escalation Program. I think it ought to be more than once a year, or once every four years, or once every eight years. The De-escalation Project’s fine, but what about the connection with the community? That’s where you guys are lacking. And hey, respect is earned, it’s not given. Everything we came in here and spoke about that we spoke about five… thirty seconds after I spoke on it last week you guys didn’t listen because it was violated 30 seconds later…thirty… record…. record time. You know whenever I come in here and I talk… I don’t care if I’m ignored, but I ask for… uh…common decency. I treat you guys with the common decency. You know I’m not ignorant, I’m college educated… there you go. But the sys… current system dictates to me that I cannot go to work for the major employers in this county because I was charged a felony for non-payment of child support. I was denied rights because of that. It’s a non-violent crime and if you really think about it is non… I had my kids more than I didn’t have them but, yet I still paid my child support because that’s what I thought was right. What we’re lacking in this community is that we had a bunch of teenage girls have a bunch of babies back when and them… then the teenage… then the teenage babies are becoming teenagers their selves. The lack of fathers that didn’t… follow through with they said back then these girls had all these babies and they dump them into the community. The last thing I’m going to leave you guys to think on is to think about this Chapter 13. All these kids are on the streets about 68% of them are all products of the foster care system that dumped them on the street… We the people, thank you. PRESIDENT PRO TEM MARIOL: Thank you, Mr. Gates. Next up is and I apologize if I pronounce your uh… name incorrectly, Jalia Williams? Great thank you. If you could give your address, you have three minutes. JALIA WILLIAMS: 2307 10th St SW Canton, Ohio. I just want to say this real quick before I say what I have to say. Uh… when my father was alive, he was the one helping my mom pay the bills. Nobody else was helping. Not that he is gone, I watch my mother struggle all day… to pay these bills that she has to pay. And yea… I’m about to start my speak. Hello City Council, I am the daughter of James Williams who was killed in front of my face and my two sisters faces on New Year’s Eve. I am still traumatized to this day. It was not fair; I was only nine in the third grade. That night was the worst night of my life. My sisters were scared, my mother was scared… everybody was scared. And the cops had brought us outside with riffles pointing at us. Wouldn’t y’all be scared too? I bet y’all would, but the fact that we didn’t have no shoes on, no socks, or no coat we literally was outside barefooted and it was wet outside. And once we got to that police station… well before we got to that police station they had put me and my sisters in the same car, but then like 10 minutes later had… they had came and separated us. And when brought my dad out… on the stretcher… they had to…they act like he wasn’t COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 71 MINUTES OF THE MEETING FEBRUARY 10, 2025 dead, but we all knew he was dead. And once we got to the police station, they had put us all in separate rooms. They had only checked on my sis… two sisters they did not check on me. I was in that room tearing up, my stomach was hurting like I could feel his gun wounds all over my body. And… I had to ask them for covers and socks and all that. So like 2 hours go by, my momma come get up and we go to our God mom house. And… they next morning, she had told us that he had died. I was so hurt, I sleep in… I slept in his chair for 2 weeks. This will not stop until we get justice for James Williams. We will get justice for my father whether y’all police department like it or not. I really don’t care. Uh… three years go by y’all have not done nothing about it. I… my mother still has that lawsuit against the police department. And… yea I feel like that was very about what y’all did… what they did. They did it because he’s a black man. And I hope y’all know where I’m coming from. Mind you, I am 12 speaking up against all y’all… so yea. PRESIDENT PRO TEM MARIOL: Thank you very much. Our next speaker is Jason Cousins, Jason. JASON COUSINS: My name Jason Cousins uh… 2307… 10th St…. SW Canton, Ohio. Only think I wanted to say is… my little cousin asked me to bring her up her because she knows I keep on trying to… figure out when this supposed to be… resolve. Or when they suppose to… have some type of… help from y’all. You know y’all actually just said this, through courts. Y’all said y’all was gone do something. What y’all waiting on man? Why his kids still suffering? Come on man, if this was one of y’alls kids man this would’ve been resolved probably like 5 or 6 months after this… but man that’s a kid. One day this could be y’all kid, just because y’all back there, they can make a mistake and this do this to y’all family. This y’all police department. Y’all control this, y’all dictate this. So show that y’all dictate it, do right, make people know that y’all behind them, because we the ones who put y’all here. Stop sitting around Canton man acting like y’all police forces not… fucked up. Come on man, do right by people man. It ain’t gone be right when people stop accepting this… because them days come when people stop caring man. Don’t ask for empathy if you can’t give it. That’s all I got to say. PRESIDENT PRO TEM MARIOL: Thank you. (Applause) Next up we have Charla Green. Charla. CHARLA GREEN: Hi, I want to address last week’s meeting. I’m an activist in this community. I also am a business owner. I work and I’m an advocate for the Board of DODD, I have individuals. Just like the young children was in here, I bring… one of my individuals here so she can advocate… for people with disabilities. Last week, I was very disappointed, being, an activist in the community, of the way some of us acted. Everybody here is human, everybody here has a voice, but it’s how we use our voice and how we talk to people. Last week was unacceptable for me to have to hear the yelling and the screaming and acting like wild animals. We are not going to get nowhere acting like that and carrying ourselves… the way that was demonstrated last week. She was upset, she was crying, she had a behavior. Children being here with their parents, I don’t care who it is, it was uncalled for. I don’t have to scream at nobody on this panel to get my point across to them. They are humans just like us. And if we want… we cannot say we want justice, we want peace and if we’re out here not setting examples, in our community and public places; because I can tell you this if it was somebody else of color that acted that way, they would’ve been slammed on the ground. They would’ve been miss handled, because that was not the way to act. Even if… if you… even if you feel she was in the wrong or you didn’t get your point across, or justice you still have to carry yourself with dignity and respect. And respect not just them, but the other people in the room as well. It was very nasty and I thank Canton City Police, I will give you a round of applause because you did handle it… with the little dignity. You didn’t attack the man, you didn’t knock him on the ground, you just stood there and let that woman get yelled at. We don’t know what she’s going through. Everybody’s human and it’s a way... I can get my point across with our screaming and yelling at these people. They are humans and they are adults. And… and yes I have lot of issues. I have been on this… at this… platform, standing right here and I have addressed my issue, but I still give respect. In order to get respect, you have to respect other people. Yes, a lot of things don’t go our way, yes we have to wait, and… COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 72 MINUTES OF THE MEETING FEBRUARY 10, 2025 and let me say we put a lot on these… on our council. Our council people is not Washington DC. This is for the City of Canton, Ohio, Stark County. PRESIDENT PRO TEM MARIOL: Thank you…. thank you for your comments. CHARLA GREEN: Thank you. PRESIDENT PRO TEM MARIOL: Next up we have, Zachery Percy, Zachery. ZACHERY PERCY: Hi my name is Zach Percy. I reside at 114 East Summit St. in Alliance. My name is Zach Percy. I reside at 114 East Summit St. in Alliance. And I’m here for the homeless and recovery addicts like me. I’m from Alliance which is why I’ve had so much difficulty finding the tools that I need for recovery. It has been exhausting work finding the right help for me. We shouldn’t potentially have to bury ourselves deeper because we are scared to admit these things, after all that’s the hardest part. This help needs to be advertised in a way everyone from all walks of life can see it and use it to find… help and better themselves. Thank you. PRESIDENT PRO TEM MARIOL: Thank you very much. Our next speaker is Starr Fear. Starr if you could come to the uh… podium, thank you. STARR FEAR: Hi my name is Starr Fear of 221 Dueber Ave NW. So, as we can all see Madam President is not present… kind of sad you know... Uh… I would like to say first off… that was real childish, Madam President. You know I used to fight with my mom… you know. Altercation after altercation it’s kind of like that with her, Madam President. I felt like I was having a fight with my mom. Kind of funny honestly, but… the thing… that… kind of bugged me tonight is you guys are adults and they needed to be treated with respect. Okay, they get as much respect as they give to us. They get as much respect… as I’ve received from Frank Morris. He’s giving a lot of respect to everybody who shows up here. And I appreciate you Frank Morris for that exact reason. Now, as… you all know, I was one of the people who got skipped. Now, I would’ve been on with it if you were just skipped and placed at the end, but no she completely abolished our freedom of speech. You know, I feel very emotionally distressed because I personally… have people anxiety. I do not like talking to people. Right now I’m shaking because… I have a bunch of eyes on me. You know, it’s kind of ridiculous how she pulled that card. Now, my question is… was this politically motivated? Madam President, did you know Daniel Gates is running for Ward 1? Did you know that? Sure seems like you did, his ballots already in. There is… some issues there, but we will figure it out in the end. We the people, have blessed weekend. PRESIDENT PRO TEM MARIOL: Thank you. Okay our next speaker is Justin Nicely, Justin. JUSTIN NICELY: Good evening, Justin Nicely. The Canton Hall of Shame, Community Advocate, Single Father of four, I live in Massillon. Uh… I’m hearing a lot of people equal respect and everything else along those lines, but yet I’m not hearing anything as far as you know… people… let me rephrase that. I’m hearing everyone talk about respect for the Council, I’m hearing respect for our city leaders, and respect for you know their positions, and they hard job that they have, but what I’m not hearing is the fact of what caused people to sit there and give that disrespect in the first place. Where was my respect when Jim Jones beat the hell out of me when I was trying to get a records request to find out who the hell the bailiffs where, who originally attacked me on November 7th. When the Chief of Police, Chief Gabbard himself set an appointment to be at this building, November 7th at 11:00 am and was attacked. You set me up to be attacked… what part of this don’t y’all understand? Where was my respect when I.A. Shackles called me the night prior to confirm I was coming to the damn appointment and then attacked me anyway. Both the conversations where both the Chief and I.A. Shackles and they were told that they contention with the City Bailiffs. Why did I have to personally do y’alls COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 73 MINUTES OF THE MEETING FEBRUARY 10, 2025 job and go talk Mike Kochera and get a complete overhaul on our City Building as far as the treatment we got and the concerns when we walked in this door. It went from ,who they hell are you here to see, what’s your name, let me see your ID, you can’t go to this floor, to how are you doing today, can we be of assistance, that’s the respect that we’re supposed to get in the first place. Why the hell do I have to do your job to get it? Same thing as why I had to come up here and defuse that situation with your officers. That gentleman right there out to be commended. Him and his partner when he came up here, didn’t try to go hands on, didn’t try to get stop bullcrap tactics that Ms. Bates damn well wanted. If Ms. Bates gotten her way, Daniel Gates would’ve been thrown on the floor, neck broken and y’all would’ve have another damn lawsuit for another damn personal injury of claim. I’m mean aren’t y’all capped out on your settlement limits? How many more people are you going to hurt? How many kids are you going to orphan and take their damn fathers away? I’m out here trying to fight to put fathers back in the home. Where the hell are y’all at helping me on that? Sure the hell tried to kidnap my kids, not once, twice, three damn time… because of your bullcrap assumptions. So all you up base your principle and your foundation off of. As far as who the hell someone is, what they’re doing, and why, but yet you don’t understand the contention. And then you have you conglomerates over here, critiquing the victims as far as why they have contention for you in the first place. You understand how stupid y’all sound with that crap and how ga… and how much gas lighting it is? And you understand that the form of psychological abuse? We already get victimized, why the hell you want to keep doing it more? Time and time again I’ve come here and I begged every single damn one of you to come to the table, explain your actions, let’s talk about finding ways and reasoning to where… to what happened to me and my family, never happens to anyone else again. Next up we have David Kerestes, David. DAVD KERESTES: David Kerestes uh… Canton, Ohio, 626 Walnut. Uh… here tonight I holding my hand an article uh… from December 10th “Judges Are Accountable.” This would be they US Attorney General William B. Saxbe in 1974. In another attack… on the concept of rehabilitation of criminals, has dispense some good advice to citizens. Containing that a jury should be called to account, if he has a terrible batting average. Saxbe said citizens should keep a record of how judges handle criminals. We agree with Saxbe’s contention of accountability of judges, but believe something more needs to be said about the idea rehabilitation of criminals. Rehabilitation, is not a slick scheme dealing easily with criminals. When it works properly it turns out productive tax paying individuals in the mainstream of American life… instead of repeat offenders. As citizens we should check on the performance of judges as well as other public officials or the judicial system as a whole. Judges are elected to do a job. If they’re not living up to the responsibility of law, they should be replaced. In another reference to rehabilitation Saxbe said, “It’s discouraging that we can’t do this job as well as we used too now that we have spread our resources we don’t… do… a very good job.” This is US Attorney General 1974. But we are going to have to take a hard look at the whole thing, if we want to straighten it out. The I looked into other law in the supreme court, Dread Scott vs Sandford, year 1857, was a landmark decision in United States Supreme Court held the US Constitution did not extend American citizenship to people in black decent. The Volstead Act was repealed on December 5th of 1933. This would be our Morality Act. And then when I look at Roe vs. Wade in 1973, you gave people the right to murder children. And as I move forward marijuana is schedule one controlled sub… substance violation in the United States in a… in a violation of federal and many states are selling this. It’s a substance schedule one violation of federal law. Which brings me to section 2332B Terrorism Transcending National Boundaries and it covers the acts that violate US and state law. Skylark. COUNCIL PROCEEDINGS JOURNAL 113 JOURNAL PAGE 74 MINUTES OF THE MEETING FEBRUARY 10, 2025 SKYLARK BRUCE: My name is Skylark Bruce and I live a 2216 Bollinger Ave. NE. Alexis Fornash has been trying to get her deceased husband, Zachery Fornash’s belongings back from the Canton Police Department. She’s been told no, she’s been laughed at, and most recently her calls have just been ignored. And that’s not okay. Today in the Repository we read a story titled “Canton Police Giving More Training to Help De-escalate Volatile Encounters.” I will now identify some of the propaganda embedded here. In 2020, I and other members of this community said, “The Canton Police officers, should be trained in de-escalate and doing the escalation well, should be rewarded in the department.” It’s 4 years later then what we asked for, but hey it is something. The scale of de-escalation is important to everyone who work wi… with the public. Store clerks, restaurant servers, bank tellers, everyone who has worked these types of jobs had needed to de-escalated a situation. When the employee is someone who carries a gun and a badge, the importance is greatly heightened. In the Frank Tyson’s case, in the… James Williams’s case, and Zachery Fornash’s case, the officers did not even attempt to de-escalate. And that is not absolutely not okay. So, if officers actually do this training into practice often, it can save lives. But that is only one piece of it. Officers must be rewarded in the department for successful de- escalation. And property discipline when they don’t. It’s both a department culture and department leadership issue. We see evidence of the culture problem in the courtroom, when officers packs a courtroom and support of officers Burch and Schoenegge. We see evidence of leadership problem when Chief Gabbard fails to acknowledge that anyone in CPD has every messed up on anything. And insist that he is proud to be associated with these murders and abusers. So if Gabbard refuses to provide moral, effective leadership for CPD it falls to the Mayor and it falls to Council to be the leaders that you were elected to be. You could pass very specific legislation about what is and what is not acceptable behavior for CPD officers. You could deny the department of new funds until the Union is on board with enforcing said legislation. You were put into office to do good for this city, not to puff your ego or do favors for wealthy people. The question is have you developed your backbones yet. Justice for Frank Tyson and Zachery Fornash and James Williams, Black Lives Matter. PRESIDENT PRO TEM MARIOL: Thank you. Next up we have and I… might pronounce the last name incorrect. Uh… Keith… is it Docket? KEITH DOUTHETT: My name is Keith DOUTHETT and I currently reside at 2215 Tuscarawas Canton, Ohio. And…I (inaudible) you guys got me baffled here, I don’t understand. I’ve been trying to obtain the uh… demolition list for Canton, Ohio because we have nonprofit that uh… she goes in and rehabs a lot of these properties and provide the families that ordinarily wouldn’t qualify for mortgages for various reasons. We can talk about that later, but I’m just I’m lost. I don’t understand why were… why it’s such a secret we got… we got 4 million dollars uh… that just been allocated through a grant for demolition funds, but nobody has a demolition list? I’ve been trying desperately uh… to maybe work around some of the folks that are what we consider gatekeepers, but at the end of the day the bottom line is uh… I still haven’t heard anything. I’ve waited for our legal counsel to get back with me. I made the call… haven’t heard anything back. Uh… the day he said he would be in, he was out for whatever reason I don’t know… health reasons for whatever. But at the end of the day the bottom line is I have not heard anything. And uh… I’m curious so if you… somebody help me out with that… what’s the secret? Why wouldn’t you want me to go in and rehab these properties that are currently eye soars, crime havens? Why wouldn’t you want me to save the tax payers… thousands of dollars as far as having to tear them down, well you have grant money but we know where that comes from? At the end of the day the bottom line is uh… I’m still curious so somebody could you help me maybe… maybe at this time you can… give me uh… helping understanding why… why we don’t have a list. Our how they’re telling me that don’t even have a list of demolition where they’re doing riding just tearing houses down? I don’t know, I’m all ears. I have senior citizens in Ward 9, that are looking anywhere from to 400 to 800 dollars per year added on to their property tax. And that is factoring in their homestead discounts. It’s ridiculous. I don’t know here they came up with the numbers. Just on my street alone they evaluated a house next to me, which I’m proud to say I completely restored… $20,000.00 lower than my own house. My house increased by 125 percent. And I don’t know who did it, I don’t know if they contracted with Ray Charles and Stevie Wonder, but they didn’t look… at the properties. It’s ridiculous, it… it’s completely unfair. We have… people in our community that are struggling to make ends meet and to hit people over the head like this is absolutely absurd. Thank you.
