Gretchen Mercer, City Clerk City of Canyon City Commission Meeting June 4, 2018 The City Commission of the City of Canyon met in regular session at 5:30 p.m. in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Justin Richardson, Cordell Jones, Roger Remlinger and Paul R. Lyons. Also present were the following City Staff: City Manager Randy Criswell, Assistant City Manager Chris Sharp, City Secretary Gretchen Mercer, Public Works Director Dan Reese, Safety Director Tony Lawson, Utility Superintendent Eric Whitten, Parks and Recreation Director Brian Noel, Code Enforcement Inspector Stan Barnard, and City Attorney Chuck Hester. Item 1. Call to Order. Mayor Hinders called the meeting to order at 5:32 p.m. Item 2. Invocation. Commissioner Jones gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Remlinger . Item 4. Approval of Minutes of the Meeting of May 21, 2018. Mayor Pro-Tem Richardson moved, duly seconded by Commissioner Remlinger, to approve the minutes of May 21, 2018 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens. No comments were made. Item 6. Update from City Manager. City Manager Randy Criswell gave a brief update on the following: • Comprehensive Plan • North Sewer Project • Brown Road Wells • 15-Minute Parking on Square • Sealcoating • CAP Receipts for First Weekend Opened (May 26-29) Item 7. Consider and Take Appropriate Action on Resolution No. 10-2018, Enacting Ordinance No. 892, Prohibiting Parking along Designated Parade Route on July 4, 2018. City Manager Randy Criswell presented Resolution No. 10-2018 and Resolution No. 11-2018 together. Mr. Criswell stated both were adopted annually to prohibit parking along the parade City Commission Meeting June 4, 2018 Page 2 of 3 route and give the Canyon Chamber of Commerce Management rights over areas involved in the July 4 celebration. After discussion, Mayor Pro-Tem Richardson moved, duly seconded by Commissioner Lyons to adopt Resolution No. 10-2018 as presented. Motion carried with Commissioner Remlinger and Commissioner Jones abstaining. RESOLUTION NO. 10-2018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON PRESCRIBING LIMITATIONS ON PARKING OR STANDING MOTOR VEHICLES OR TRAILERS DURING PARADE TO BE HELD JULY 4, 2018, IN THE CITY OF CANYON. Item 8. Consider and Take Appropriate Action on Resolution No. 11-2018, Designating the Canyon Chamber of Commerce as Having Authority to Manage and Coordinate All Activities on the Downtown Square and Conner Park for the July 4 Celebration, July 4, 2018. Mayor Pro-Tem Richardson moved, duly seconded by Commissioner Lyons to approve Resolution No. 11-2018 as presented. Motion carried with Commissioner Remlinger and Commissioner Jones abstaining. RESOLUTION NO. 11-2018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS, GRANTING EXCLUSIVE MANAGEMENT RIGHTS TO THE CANYON CHAMBER OF COMMERCE OVER THE DOWNTOWN SQUARE, CONNER PARK AND PUBLIC AREAS IN AND AROUND THESE AREAS DURING THE ANNUAL FOURTH OF JULY CELEBRATION, JULY 4, 2018 Item 9. Executive Session Pursuant to §551.071 Consultation with Attorney, and §551.074 Personnel Matters (City Manager’s Contract). Mayor Hinders indicated the Commission would adjourn into Executive Session at 5:54 p.m. Item 10. Consider and Take Appropriate Action on Items Discussed in Executive Session. Upon returning from Executive Session at 7:18 pm, no action was taken. Item 11. Consider and Take Appropriate Action on Meeting Dates for July and August 2018. City Manager Randy Criswell said Mayor Hinders had already indicated he would not be available August 16 and July 13, 2018. After discussion, the Commissioners agreed to hold the regular meeting June 18, 2018 and include discussion of meeting dates for July, August and September. There being no further business, Mayor Pro-Tem Richardson moved this meeting be adjourned. ______________________________ Gary Hinders, Mayor ATTEST: ________________________________ Gretchen Mercer, City Secretary REGARDING ITEM 7 AGENDA To: Mayor and City Commission From: Randy Criswell, City Manager Date: June 18, 2018 Re: Consider and Take Appropriate Action on Ordinance No. 1088, Amending the Code of Ordinances Relating to Special Events with Alcohol To Be Allowed Ordinance No. 1088 has been prepared to deal with the issue of alcohol when allowed in conjunction with a Special Events Permit. The concern that has been expressed is that our Ordinances prohibit alcohol in parks, but we have events like June Jams and the upcoming July 4th Celebration, where attendees are allowed to have alcohol. Staff felt this was a conflict that needed resolution, so we have worked with Chuck to compile an Ordinance to address it. If it is the wish of the City Commission to expand this ordinance to further address the legal use of alcohol on or in public property, we can discuss that at a future date if directed. It is staff’s recommendation that Ordinance No. 1088 be adopted. City of Canyon  1 ORDINANCE NO. 1088 AN ORDINANCE OF THE CITY OF CANYON, TEXAS, AMENDING SECTION 96.01(A) CODE OF ORDINANCES RELATING TO CITY PARKS AND BUILDINGS; AMENDING SECTION 98.13 RELATING TO EVENTS WITH ALCOHOL; AMENDING SECTION 98.15 RELATING TO CONDITIONS OF PERMITS; PROVIDING FOR SEVERABILITY; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission finds it to be in the public interest to clarify and further define the use or possession of alcohol on City property or public rights of way under the control of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS; SECTION 1: Section 96.01(A) of the Code is amended to provide as follows: “The possession or consumption of alcohol is prohibited in City parks or buildings except as permitted in Sections 98.13 and 98.15 of this Code.” SECTION 2: Section 98.13 of the Code is amended to provide as follows: Any event providing for alcohol sales or consumption shall have a valid permit or license to sell or serve alcoholic beverages issued by the Texas Alcoholic Beverage Commission and shall follow all TABC rules and regulations associated with the permit. (Ord. 1021, sec. 2, passed 3-23- 15) “At any such event the event sponsor shall designate an area for the use of members of the public who elect to bring their own beer or wine to the event and do not purchase beer or wine from the licensee. Members of the public of lawful age may bring beer or wine to special events provided that no glass containers are permitted and no alcohol consumption is permitted in the Canyon Aquatic Park or on playgrounds.” SECTION 3: Section 98.15 of the Code is amended to provide as follows:  2 In addition to other requirements set forth herein, the applicant shall furnish suitable evidence of his or her intention and ability to comply with all conditions included in event application and this chapter. (Ord. 1021, sec. 2, passed 3-23-15) “Events having an attendance of 100 persons or less shall require one off duty police officer to work security. Events of more than 100 persons in attendance shall require two off duty officers. The event sponsor shall pay the cost of the security officer or officers assigned at an hourly rate per officer that is set by the Chief of Police. The Chief of Police shall have discretion to waive the security requirement. The hours of consumption by members of the public is 12:00 Noon to 11 PM. In the event of drunken, unruly or disorderly conduct by event participants, the City Manager or his designee may immediately revoke the permit and order the ejection of all event participants from the area. SECTION 4: Severability. If any provision, section, subsection, clause, or the application of same to any person or set of circumstances for any reason is held to be unconstitutional, void or invalid or for any reason unenforceable, the validity of the remaining portions of this ordinance or the application thereby shall remain in effect, it being the intent of the City Commission of the City of Canyon, Texas in adopting this ordinance, that no portion thereof or provision continued herein shall become inoperative or fail by any reasons of the unconstitutionality of any other portion or provision. SECTION 5: Repealer. All ordinances, parts of ordinances, resolutions, and parts of resolutions in conflict with this ordinance are hereby repealed to the extent of conflict with this ordinance. SECTION 6: Effective Date. This ordinance shall become effective immediately. INTRODUCED AND PASSED by the City Commission of the City of Canyon, Texas on the 18th day of June, 2018. Gretchen and Chris have compiled a calendar final three summer months, showing the dates that will be required for adoption of the budget. Based on the previous meeting and these calendars, it looks like our summer/budget meeting dates will be: July 9 – regular meeting July 23 – regular meeting, Record Vote on maximum tax rate August 6 – Public Hearing on Tax Rate August 20 – Public Hearing on Tax Rate September 10 – Adoption of Budget and Tax Rate Those days are basically set, so the only item you really need to decide upon is when you want to have the budget presentation and workshop. The chief appraiser prepares and certifies to the tax assessor for each county, municipality, April 30 and school district participating in the appraisal distrcit and estimate of the taxable value. May 15 Deadline for submitting appraisal records to ARB July 20 Deadline for ARB to apprice appraisal records July 25 Deadline for chief appraiser to certify rolls to taxing units Certification of anticipated collection rate by collector Calculation of effective and rollback tax rates July 20 72-hour notice for meeting (Open Meetings Notice) July 23 Meeting of governing body to discuss tax rate Publish Notice of 2015 Tax Year Proposed Property Tax Rate for City of Canyon. Use the ad that will correspond to the proposed tax rate; if the proposed rate is at or below the effective tax rate, then use the shorter ad. Use the longer ad if the proposed rate will exceed the effective tax rate. This ad must be published by September 1st and 7 days before July 31 public hearing. It needs to be one quarter page or larger, the headline must be 24-point or larger, and it must not be published in the legal section. You must also post the notice on your website no later than September 1st and keep it posted until you have adopted.
