Gretchen Mercer, City Clerk City of Canyon City Commission Meeting June 18, 2018 The City Commission of the City of Canyon met in regular session at 5:30 p.m. in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Justin Richardson, Cordell Jones, Roger Remlinger and Paul R. Lyons. Public Comment – Comments from Interested Citizens. No comments were made. Item 6. Update from City Manager. City Manager Randy Criswell gave a brief update on the following: • Drought Contingency Plan / Water Usage • Brush Route • Comprehensive Plan Progress • Xcel Energy Franchise Fee Increase Item 7. Consider and Take Appropriate Action on Ordinance No. 1088, Amending the Code of Ordinances Relating to Special Events with Alcohol To Be Allowed. City Manager Randy Criswell presented Ordinance No. 1088 for consideration. Mr. Criswell explained that in order to deal with the conflict of alcohol being allowed in conjunction with a Special Events Permit and the City of Canyon Ordinance prohibiting alcohol in parks and on city property. Mr. Criswell said with permitted events such as June Jams and the July 4th Celebrations City Commission Meeting June 4, 2018 Page 2 of 3 attendees are allowed to have alcohol within the permit guidelines, so the adoption of Ordinance NO. 1088 would correct the conflict allowing the consumption on city property during a permitted event only. Commissioners asked Chief of Police Dale Davis if he supported the adoption of Ordinance No. 1088. Chief Davis stated he did, that it would make enforcing laws relating to alcohol consumption easier. Chief Davis stated he had researched extensively on how other cities handled events that allowed alcohol and this seemed to be the norm. Mr. Criswell stated that the Commission could expand the Ordinance later to address other city facilities and properties and alcohol consumption. Interest was expressed in furthering the discussion at a later date. After discussion, Commissioner Jones moved, duly seconded by Commissioner Remlinger to adopt Ordinance No. 1088 as presented. Motion carried unanimously. ORDINANCE NO. 1088 AN ORDINANCE OF THE CITY OF CANYON, TEXAS, AMENDING SECTION 96.01(A) CODE OF ORDINANCES RELATING TO CITY PARKS AND BUILDINGS; AMENDING SECTION 98.13 RELATING EVENTS WITH ALCOHOL; AMENDING SECTION 98.15 RELATING TO CONDITIONS OF PERMITS; PROVIDING FOR SEVERABILITY; AND, PROVIDING FOR AN EFFECTIVE DATE. Prior to the 2010 census, the City was approached by the Amarillo MPO and was invited to the table as “ex-officio” members of the Amarillo Metropolitan Planning Organization (MPO). At the time, it was anticipated that the population of Amarillo would eclipse 200,000, hence qualifying it as a TMA (Transportation Management Area). An MPO that serves a TMA, must include local elected officials and officials of public agencies that administer or operate modes of transportation in the metropolitan area. The MPO should review its policy board membership to ensure that these agencies are represented, as appropriate (23 CFR 450.306). However, it has since been determined that an MPO can expand its boundary and membership without becoming or serving a TMA. The Amarillo MPO has determined that it is time to expand its organization and boundary to include Canyon and some of the surrounding area. There has not been an expansion of the MPO boundary in many years, and with the growth the area is experiencing, it opens up greater avenues to receive federal transportation funding for our area. Back in April, the MPO Policy Committee approved the expanded boundary. We have attached a map of the new boundary. Now, to complete the process, the MPO must adopt revised by-laws and membership, and submit a packet to the Texas Transportation Commission and the Governor for approval. Once this happens, the new boundary will take effect and Canyon will be officially included in the MPO. Part of this packet to be submitted to the State, includes an adopted Resolution from the public agency wishing to join the MPO. Resolution 12-2018 has been drafted for this purpose and is attached. The public works department recommends adoption of Resolution No. 12- 2018. After several years of discussions and planning, this project has finally surfaced. Canyon ISD has assessed their needs and have come to us requesting water service be provided to the stadium. This will entail extending our system east, across US 60/87 in the vicinity of the CISD Transportation Facility (bus barn). No longer will the district have to rely on a well and pressure system to provide water during football games. This project will simply install another metered connection for CISD. The City will benefit in a couple of ways. First, it will allow service to be available on the east side of the highway, should further development occur. Lastly, it has always been part of our long range plans to have an alternate distribution line from the Kim Road pump station. This gets us started, get us across the highway, and sets up a point where we can be able to tie all of our main water facilities together in the future. Bids were received and opened on Wednesday, June 13, 2018. We received five bids. Bids were split into two pieces. Project A is the City’s portion and Project B is the CISD portion. The low bid was submitted by Amarillo Utility Contractors, of Amarillo. The total amount bid for both parts was $432,270.00, of which the City’s portion will be $304,680.00. The plans are for the City to administer the entire contract and be reimbursed by CISD for their portion. Funding for this project will come from the remaining water bond funds. An award recommendation letter and bid tabulation from the engineer is attached. A sketch of the project area is also attached. The public works department concurs with the Engineer in recommending that the bid of Amarillo Utility Contractors be awarded for this project in the total amount of $ 432,270.00. We’ve been working with CISD for quite a while to explore options to get Kimbrough Stadium on City water. City Engineer Dwight Brandt has designed the project, and in just a few minutes, we’ll be recommending you award the contract for that project. The costs to each entity have been determined based on the bids, and CISD will pay their portion. We will sign the contracts and administer the project, so it is in order for the City to have an Intergovernmental Local Agreement with CISD to memorialize the arrangement. The Agreement is attached. It is staff’s recommendation that the Intergovernmental Local Agreement be approved. City of Canyon  INTERLOCAL AGREEMENT BETWEEN CITY OF CANYON AND CANYON INDEPENDENT SCHOOL DISTRICT 1. Parties: This Agreement is made by and between the City of Canyon (“City”), a home rule municipal corporation in Randall County, Texas, and Canyon Independent School District (hereinafter referred to as “Canyon ISD”) pursuant to the authority granted by the “Texas Interlocal Cooperation Act,” Chapter 791 Texas Government Code providing for the cooperation between local governmental entities. In consideration of the premises and the mutual promises contained herein, the parties agree as follows: Recitals 2. Authority: 2.1 This Agreement is made and shall be performed under the authority of Chapter 791 of the TEXAS GOVERNMENT CODE, The INTERLOCAL COOPERATION ACT. Each party required to pay for services, labor or material under this Agreement with regard to governmental functions and services or administrative functions shall make such payments from current revenues available to the paying party in an amount which reasonably and fairly compensates the party providing labor or materials or performing the service under this Agreement. 2.2 The governing bodies of each party find that the subject of this contract is desirable and necessary for the benefit of the public and that each party has the legal authority to perform and to provide the governmental function which is the subject matter of this contract. 3. Purpose: 3.1 Canyon ISD intends to extend water service from the City of Canyon’s public water supply to the Kimbrough Stadium Sports Venue east of U.S. 87 in north Canyon. Interlocal Agreement Page 1 7/5/2018  3.2 Canyon ISD has requested that the City bid the water distribution system improvements to be paid by Canyon ISD as a part of the overall project to be undertaken by the City in cooperation with Canyon ISD. 3.3 Bids were opened on June 13, 2018, as is reflected on the attached bid tabulation sheet identified as Exhibit “A” to this agreement. NOW THEREFORE: 4. Terms: 4.1 The Canyon City Commission will consider and act upon award of a bid for the project at its meeting on July 9, 2018. Canyon ISD board will consider and act upon this agreement at its meeting on July ___, 2018. Canyon ISD has agreed to abide by the bid as awarded by the City. 4.2 Canyon ISD shall pay the cost of Base Bid Project B as shown on the attached Exhibit “A” after award of the bid. 4.3 The City shall pay the cost of Base Bid Project A as shown on the attached Exhibit “A” after award of the bid. 4.4 Canyon ISD shall be responsible for constructing all on site improvements to furnish water service to its facilities located on Kimbrough Stadium in addition to the cost of Base Bid Project B. 4.5 All costs normally paid by developers such as water taps and service lines shall be at the cost of Canyon ISD. Water provided to the school land by City shall be metered and billed at the usual rates approved by the City Commission of the City of Canyon annually and published in City Ordinances setting such rates. 4.6 No sanitary sewer service will be provided by City until additional development in the area results in wastewater mains being located in proximity to Kimbrough. City shall not be obligated to install waste water mains to serve only the school site. Interlocal Agreement Page 2 7/5/2018  4.7 This Agreement shall be effective when approved by the governing body of Canyon ISD and the City of Canyon. 5. Duration: This Agreement provides for a permanent extension of the infrastructure for water service from the City of Canyon’s public water supply to the above-described facilities of Canyon ISD. IN WITNESS WHEREOF, the parties hereto have entered into this Agreement pursuant to authorization of their respective governing bodies on the date set forth below opposite the signatures of their authorized representatives.
