Gretchen Mercer, City Clerk City of Canyon City Commission Meeting May 3, 2021 The City Commission of the City of Canyon at 3:30 pm in the City Commission Chambers of the Civic Complex for a Work Session followed by a Regular Meeting beginning at 4:30 pm. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Cody Jones, Paul R. Lyons and Randy Ray. Commissioner Remlinger was unable to attend. Also present were the following City Staff: City Manager Joe Price, Assistant City Manager Jon Behrens, City Secretary Gretchen Mercer, IT Director Shaun Holtman, Director of Communications and Community Engagement Megan Nelson, Assistant Director of Public Works Chris Enriquez, Police Chief Steve Brush, Wastewater Supervisor John Poole, Fire Chief Dennis Gwyn, Business and Community Development Director Evelyn Ecker, Canyon Economic Development Corporation Board President Don Lee, Director of Planning and Development Danny Cornelius, Director of Finance Joel Wright, City Engineer Dwight Brandt, and City Attorney Chuck Hester. Mayor Hinders called the worksession to order at 3:30 pm. Shane Sorenson, Director of Loyalty and Business Development Texas Travel Alliance presented information on the possible creation of a Canyon Visitors Bureau. The City Commission ended the work session at 4:40 pm for a 5 minute break. Item 1. Call to Order. Mayor Hinders called the meeting to order at 4:45 p.m. Item 2. Invocation. Mayor Pro-Tem Jones gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Lyons. Item 4. Approval of Minutes of the Meeting of April 19, 2021. Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve the minutes of April 19, 2021 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens. No comment made. Item 6. Consider and Take Appropriate Action on Update of Governor Greg Abbotts Executive Orders Directed at Slowing the Spread of COVID-19 in the State of Texas. City Manager Joe Price and Assistant City Manager Jon Behrens gave an update on COVID-19. Mr. Behrens said he had contacted Meals on Wheels informing them if they had participants interested in getting the COVID-19 vaccine, the Canyon Fire Department would go to their homes to administer City Commission Meeting May 3, 2021 Page 2 of 5 the vaccine. The Fire Department would also check the batteries on Fire Alarms and other safety alerts in the home. Mr. Behrens stated Casey Stoughton of Amarillo Public Health said she would send a staffer from Amarillo Public Health with the Fire Department to help complete paperwork. Mayor Hinders offered appreciation to Amarillo Public Health and all they have done for the community and said he felt it was very important to get as many citizens as possible vaccinated. Item 7. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 14-2021, A Resolution of the City Commission of the City of Canyon Approving Funding to the Canyon to the Canyon Chamber of Commerce by Canyon Economic Development Corporation Supporting the Annual Independence Day Celebration. Don Lee, President of the Canyon Economic Development Corporation presented Resolution No. 14-2021 for its final reading. Mr. Lee stated the request from the Canyon Chamber of Commerce was for event expenses related to the Annual Independence Day Celebration in the amount of $11,500. Mr. Lee said this funding meets the requirements of the Quality of Life guidelines in that it attracts tourist/visitors with an estimated attendance of 30,000 plus people. Mr. Lee stated the CEDC held a public hearing on April 8, 2021 with no opposition. After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to adopt Resolution No. 14-2021 as presented. Motion carried unanimously. RESOLUTION NO. 14-2021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING FUNDING TO THE CANYON CHAMBER OF COMMERCE BY CANYON ECONOMIC DEVELOPMENT CORPORATION SUPPORTING THE ANNUAL INDEPENDENCE DAY CELEBRATION. Item 8. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 15-2021, A Resolution Approving a Project Funding Agreement Between Canyon Main Street and Canyon Economic Development Corporation Relating to Funding a Twelve (12) Month All-Inclusive Marketing Plan for Canyon. Don Lee, President of the Canyon Economic Development Corporation presented Resolution No. 15-2021 for its final reading. Mr. Lee said the funding was proposed for a twelve month all-inclusive marketing plan for Canyon to be implemented by Canyon Main Street. Mr. Lee stated the plan included digital saturation with 3,360 commercials daily, static boards strategically placed, advertising in the TEXAS program and Discover Canyon. Mr. Lee stated the spring issue of West Texas Travel Host published a double page Canyon ad and it is placed in state travel centers across Texas as well as hotels. Mr. Lee said the plan also included a new website and mobile app for Canyon Main Street and new pole banners for 4th Avenue and 23rd Street for around 90 poles. Mr. Lee said total funding requested was $79,600 with funds disbursed from the CEDC Marketing Account that is specifically intended for promoting Canyon. Mr. Lee said the CEDC held a public hearing on April 8, 2021 with no opposition for the project funding. City Commission Meeting May 3, 2021 Page 3 of 5 After discussion, Commissioner Ray moved, duly seconded by Mayor Pro-Tem Jones to adopt Resolution No. 15-2021 as presented. Motion carried unanimously. RESOLUTION NO. 15-2021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN CANYON MAIN STREET AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO THE CANYON MAIN STREET MARKETING CAMPAIGN 2021. Item 9. Consider and Take Appropriate Action on Resolution No. 22-2021, A Resolution of the City Commission of the City of Canyon, Texas, Amending the City of Canyon’s Fiscal Principles and Policies. City Manager Joe Price and Director of Finance Joel Wright presented Resolution No. 22-2021 for consideration. Mr. Wright stated the Fiscal Principles and Policies provides guidelines for planning and directing the City’s day to day financial reporting, budgeting and management of cash, expenditures and debt management controls. Mr. Wright stated the policy is reviewed and updated as needed for clarity and compliance of the day-to-day financial operations. After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve Resolution No. 22-2021 amending the City of Canyon Fiscal Principles and Polices as presented. Motion carried unanimously. RESOLUTION NO. 22-2021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS, AMENDING THE CITY OF CANYON’S FISCAL PRINCIPLES AND POLICIES. Item 10. Consider and Take Appropriate Action on Resolution No. 23-2021, A Resolution of the City Commission of the City of Canyon, Texas, Amending the City of Canyon’s Comprehensive Fund Balance and Cash Reserve Policy. City Manager Joe Price and Director of Finance Joel Wright presented Resolution No. 23-2021 for consideration. Mr. Wright stated the purpose of the policy was to establish a key element of the financial stability of the City by setting guidelines and parameters for budgetary fund balance and an assigned reserve fund. Mr. Wright said unassigned fund balance is a key element to the financial stability of the city through set guidelines for budgetary fund balance and assigned reserve fund. Mr. Wright said currently, the Investment Policy has some aspects of a fund balance policy and staff has created a standalone Comprehensive Fund Balance and Cash Reserve Policy as recommended by the Government Finance Officers Association (GFOA). After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve Resolution No. 23-2021 amending the City of Canyon Comprehensive Fund Balance and Reserve Policy as presented. Motion carried unanimously. City Commission Meeting May 3, 2021 Page 4 of 5 RESOLUTION NO. 23-2021 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS, AMENDING THE CITY OF CANYON’S COMPREHENSIVE FUND BALANCE AND CASH RESERVE POLICY Item 11. Consider and Take Appropriate Action on Contract for Randall County to Assess and Collect Ad Valorem Taxes for the City of Canyon. Finance Director Joel Wright presented an updated contract for Randall County to assess and collect ad valorem taxes for the City of Canyon. Mr. Wright stated the only change was updating the signature by Christy Dyer as Randall County Judge. After discussion, Commissioner Ray moved, duly seconded by Mayor Pro-Tem Jones to approve the contract between the City of Canyon and Randall County for Randall County Tax Assessor- Collector to assess and collect ad valorem taxes for the City of Canyon as presented. Motion carried unanimously. Item 12. Consider and Take Appropriate Action on March 31, 2021 Financial Report by Finance Director Joel Wright. Finance Director Joel Wright presented the Financial Report for consideration. After discussion Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve the Financial Report as presented. Motion carried unanimously. Item 13. Consider and Take Appropriate Action on March 31, 2021 Investment Report by Finance Director Joel Wright. Finance Director Joel Wright presented the Investment Report for consideration. After discussion Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve the Investment Report as presented. Motion carried unanimously. Item 14. Initial Budget Discussion for 2021-2022 and Presentation of Budget Calendar. City Manager Joe Price presented the proposed calendar for the 2021-2022 Budget and discussed the timeline for presenting and adopting the budget for 2021-2022. No action required. Presentation only. We Contracted with Randall County Election Administration for our May 1, 2021 General Election. They did a Great job as usual and are to be commended on the professionalism and efficiency of their staff. The Cavass is the official tabulation of the election results that includes early voting, votes cast on Election Day and Absentee Ballots (if applicable). Resolution No. 24-2021 for the Official Canvas of the May 1, 2021 General Election and the Unofficial Cumulative Report provided by Randall County Election Administration is provided. It is the recommendation of staff that Resolution No. 24-2021 be adopted approving the Election Result for the May 1, 2021 General Election. WHEREAS, on this the 10th day of May, 2021, came to be considered by the City Commission the canvass of the returns of the General Election for the purpose of electing persons to serve as Mayor Place 1 and Commissioner Places 2, 3, 4, and 5 to the resident qualified electors of the City held on May 6, 2017; WHEREAS, the Randall County Election Administrator that reported said Election has duly made the return of the results thereof, and said returns have been duly delivered to the City Commission; WHEREAS, the City Commission finds and declares that the meeting at which this Resolution is considered is open to the public and complies with the open meetings act; and WHEREAS, there were cast in said election 47 absentee votes as shown in the official election results submitted by the Randall County Election Administrator and lawfully submitted to the City Commission of the City of Canyon, Texas, and filed with the City Secretary of said City; and WHEREAS there were cast in said election 406 early votes as shown in the official election results submitted by the Randall County Election Administrator and lawfully submitted to the City Commission of the City of Canyon, Texas, and filed with the City Secretary of said City; and WHEREAS there were cast in said election 245 election day votes as shown in the official election results submitted by the Randall County Election Administrator and lawfully submitted to the City Commission of the City of Canyon, Texas, and filed with the City Secretary of said City; and WHEREAS, the City Commission has canvassed the returns of said election and it appears from said returns, duly and legally made, the Combined Absentee Voting, Early Voting and Election Day Voting Accumulated a total of 698 votes resulting in the following: Mayor Place 1 Gary Hinders 626 Commissioner Place 2 Cody Jones 612 Commissioner Place 3 Paul R. As per the City of Canyon Charter, “The Commission shall elect a Mayor-Pro Tem who shall act as Mayor during the absence or disability of the Mayor, and if a vacancy should occur, shall become Mayor until the next regular election. We will have a sheet of paper at your place and you can write down your nomination. We will go with the majority. In the case of a tie, we will go with a show of hands. City of Canyon  PROCLAMATION FOR MENTAL HEALTH MONTH Whereas, mental health is essential to everyone’s overall health and well-being; and Whereas, all Americans face challenges in life that can impact their mental health, especially during a pandemic; and Whereas, prevention is an effective way to reduce the burden of mental health conditions; and Whereas, there are practical tools that all people can use to improve their mental health and increase resiliency; and Whereas, mental health conditions are real and prevalent in our nation; and Whereas, with effective treatment, those individuals with mental health conditions can recover and lead full, productive lives; and Whereas, each business, school, government agency, health care provider, organization and citizen share the burden of mental health problems and has the responsibility to promote mental wellness and support prevention and treatment efforts; and Now, therefore, we do hereby proclaim May 2021 in the City of Canyon as: “MENTAL HEALTH MONTH” And call upon the citizens, government agencies, public and private institutions, businesses, and schools in the City of Canyon to commit our community to increasing awareness and understanding of mental health, the steps our citizens can take to protect their mental health, and the need for appropriate and accessible services for all people with mental health conditions.
