City Commission Meeting November 21, 2022 The City Commission of the City of Canyon met at 4:30 pm in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Cody Jones, Paul Lyons, and Randy Ray. Commissioner Kelsey Ward was unable to attend. Also present were the following City Staff: City Manager Joe Price, Assistant City Manager Jon Behrens, City Secretary Gretchen Mercer, Planning and Development Director Lucas Raley, Planning and Development Building Official Craig Brown, Police Chief Steve Brush, Police Captain Matt Coggins, Fire Chief Dennis Gwyn, Public Works Director Dan Reese, HR Director Hector Mendoza, Parks and Recreation Director Brian Noel, Water Superintendent Eric Whitten, and City Attorney Chuck Hester. Item 1. Call to Order. Mayor Hinders called the meeting to order at 4:37 pm. Item 2. Invocation. Mayor Pro-Tem Jones gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Ray. Item 4. Approval of the Minutes of the Meeting of November 8, 2022 Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve the minutes of November 8, 2022 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens No comments were made. Item 6. Introduction of Planning and Development Director Lucas Raley. City Manager Joe Price introduced Planning and Development Director Lucas Raley. Commissioners welcomed Mr. Raley. Item 7. Presentation of Lifesaving Awards to Canyon Police Department Corporal Garrett Banes and Patrol Officer Jabril Hill for Their Actions on October 13, 2022. Canyon Police Chief Steve Brush presented lifesaving medals and plaques to Corporal Garrett Banes and Officer Jabril Hill publicly recognizing both for heroic actions of saving the life of a women involved in an auto accident and pulling her from her vehicle that had become engulfed in flames. Commissioners expressed gratitude to Corporal Banes and Officer Hill and commended them for their public service. City Commission Meeting November 21, 2022 Page 2 of 3 Item 8. Consider and Take Appropriate Action on Adoption of Canyon Downtown TIRZ #1 Final Project Plan. Assistant City Manager Jon Behrens presented the final project plan for the Canyon Downtown TIRZ #1. Mr. Behrens said the TIRZ #1 Board met Tuesday, November 1, 2022 and took final action required to move forward and recommend adoption of the final plan to the City Commission. After discussion, Commissioner Ray moved, duly seconded by Mayor Pro-Tem Jones to adopt the Canyon Downtown TIRZ #1 Final Project Plan. Motion carried unanimously. Item 9. Consider and Take Appropriate Action on Chapman Forestry Foundation Grant Acceptance and Update of Canyon Aqua Park (The CAP) 2022 Season. Parks and Recreation Director Brian Noel the Chapman Forestry Foundation had awarded the City of Canyon a grant for $2500 for the purchase and planting of trees. Mr. Noel said the grant allowed the Parks Department to plant 27 trees in the Canyon East Park and Canyon East Parkway. Mr. Noel then gave an update on the 2022 season for The CAP stating more than 41,000 guests were hosted by The CAP with a total revenue of $479,119. Mr. Noel commended The CAP staff for getting the job done even though short staffed. After discussion Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to accept the $2500 grant check from the Chapman Forestry Foundation. Motion carried unanimously. Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to approve the Annual Report for The CAP 2022 Season. Motion carried unanimously. Item 10. Executive Session Pursuant to §551.071 Consultation with Attorney, §551.074 Personnel Matters (EDC Director) and §551.074 Board Appointments (Board of City Development, Canyon Housing Authority, Construction Advisory and Appeals Board, Canyon Area Library Board, Planning and Zoning Commission, Parks Open Space and Recreation Advisory Committee, Zoning Board of Adjustment, Main Street Advisory Board). Mayor Hinders indicated the City Commission would adjourn into Executive Session at 4:54 pm. Item 11. Consider and Take Appropriate Action on Items Discussed in Executive Session. Upon returning from Executive Session at 6:20 pm with the following action taken. Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to reappoint Lyndon Harrison and George Nester for another term to the Board of City Development. Motion carried unanimously. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 25-2022, A Resolution of the City Commission of the City of Canyon Approving Project Funding Agreement Between 806 FIT, LLC and Canyon Economic Development Corporation Relating to Business Expansion in Canyon. Canyon Economic Development Board President Jim Bryan presented Resolution No. 25-2022 for the second and final reading. Mr. Bryan said the CEDC approved project funding of $100,000 for 806 Fit, LLC for business expansion. Mr. Bryan said the CEDC Board held a public hearing October 13, 2022 and received no opposition. After discussion, Commissioner Ward moved, duly seconded by Mayor Pro-Tem Jones to adopt Resolution No. 25-2022 as presented. Motion carried unanimously. City Commission Meeting November 8, 2022 Page 2 of 3 RESOLUTION NO. 25-2022 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN 806 FIT, LLC AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO BUSINESS EXPANSION IN CANYON. Item 7. Consider and Take Appropriate Action on Request from Aurelio Rivas for the Continued Donation of Water for the Canyon Community Garden Located Between 1st and 2nd Avenue and 18th and 19 Street. City Secretary Gretchen Mercer presented a request from Aurelio Rivas for the continued donation of water for the Canyon Community Garden. Mr. Rivas was present to answer questions. Mr. Rivas said 300 plus residents visit the garden each year. After discussion, Commissioner Ray moved, duly seconded by Mayor Pro-Tem Jones to approve the City of Canyon to continue donating water to the Canyon Community Garden for two years. Motion carried unanimously. Item 8. Consider and Take Appropriate Action on Resolution No. 26-2022, A Resolution of the City of Canyon, Texas Supporting the Application and Acceptance of a FEMA AFG Grant for the Purchase of Self-Contained Breathing Apparatus, and Associated Equipment for the Canyon Fire Department; and Authorizing the Fire Chief to Represent the City in All Matters Pertaining to the Administration of the Grant. Fire Chief Dennis Gwyn presented Resolution No. 26-2022 for consideration. Chief Gwyn stated the current equipment used by the Canyon Fire Department was becoming obsolete. Chief Gwyn said the Fire Department would like to pursue a grant that would provide new equipment that has a tracking system, speaker system in the headgear making it easier to speak and be heard, and other new safety measures built in that would keep fire fighters much safer. Chief Gwyn said a professional grant writer would be hired to write this grant that specializes in grant writing for Fire Departments for approximately $2,000. After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ray to adopt Resolution No. 26-2022 authorizing the Fire Department to pursue the application of a FEMA AFG Grant to replace the current SCBA and associated equipment. Motion carried unanimously. RESOLUTION NO. 26-2022 A RESOLUTION OF THE CITY OF CANYON, TEXAS SUPPORTING THE APPLICATION AND ACCEPTANCE OF A FEMA AFG GRANT FOR THE PURCHASE OF SELF- CONTAINED BREATHING APPARATUS, AND ASSOCIATED EQUIPMENT FOR THE CANYON FIRE DEPARTMENT; AND AUTHORIZING THE FIRE CHIEF TO REPRESENT THE CITY IN ALL MATTERS PERTAINING TO THE ADMINISTRATION OF THE GRANT. Consider and Take Appropriate Action on Resolution No. 27-2022, A Resolution of the City Commission of the City of Canyon, Texas, Prescribing Limitations on Parking or Standing Motor Vehicles or Trailers During Parade to be Held December 3, 2022. Police Chief Steve Brush presented Resolution No. 27-2022 for consideration. Chief Brush stated the adoption of Resolution No. 27-2022 would prevent parking along the parade route for the Christmas Parade December 3, 2022. After discussion Commissioner Ward moved, duly seconded by Mayor Pro-Tem Jones to adopt Resolution No. 27-2022 as presented. Motion carried unanimously. Item 10. Consider and Take Appropriate Action on Presentation of City of Canyon 2022 Strategic Plan Third Quarter Update. Assistant City Manager Jon Behrens presented an update on the progress of the 2022 Strategic Plan. No action, informational only. Item 11. On October 13, 2022 Corporal Garrett Banes responded to a head-on vehicle crash on IH27 at McCormick. Corporal Banes arrived near the same time as deputies from the Randall County Sheriff’s Office. Officer Jabril Hill was off-duty and drove upon the crash scene at around the same time the on-duty officers were arriving and assessing the situation. One of the vehicles involved in the crash was on fire with the fire spreading to the passenger compartment where the driver of the vehicle was unconscious in the seat. Corporal Banes, Officer Hill and the deputies worked together to force entry into the vehicle, removing her from the vehicle and carrying her away from danger. The actions of these officers saved the life of the vehicle driver. Had the officers not taken the action they did, an already tragic crash would have been worse. The City of Canyon and the Canyon Police Department is publicly recognizing Corporal Banes and Officer Hill with the presentation of a plaque and lifesaving medal in recognition of their heroic actions. RECOMMENDED MOTION No action required on this item. City of Canyon AGENDA ITEM 8 AGENDA To: Joe Price, City Manager From: Jon Behrens, Assistant City Manager Date: November 14, 2022 Re: Consider and Take Appropriate Action on Adoption of Canyon Downtown TIRZ #1 Final Project Plan On Tuesday, November 1, 2022, the Board of Directors for the Canyon Downtown TIRZ #1 in the Cole Community Center. All members were present. The Board adopted bylaws, were randomly assigned term lengths, and elected a Vice-Chair. Travis James of TXP and City Manager Joe Price provided the Board with a description of the purpose of the TIRZ. Travis outlined the development of the TIRZ Plan and all the mandatory requirements associated with it. After the presentation the Board approved the adoption of the Canyon Downtown TIRZ #1 Final Project Plan. The Board of Directors have now taken all of the action necessary for them to move forward. At this time the final action for the City Commission is to adopt the Downtown Tax Increment Reinvestment Zone Project and Financing Plan dated October 28, 2022, which will replace the Preliminary Plan which was previously adopted. This final plan has been updated with actual property values from this past year as opposed to forecasted values. Board members terms are: Chair Randy Ray, Chris Matthews, Jim Bryan – one-year terms to expire Dec. 2023 Paul Lyons, Nikki Sams, Bob Robinson, Mickey Foster – two-year terms to expired Dec. 2024 It is staff’s recommendation that the Commission adopt the Canyon Downtown TIRZ #1 Final Project Plan. Overview In November 2021, the City of Canyon, Texas (“City”) by ordinance (Number 2021-1147) approved the creation of Tax Increment Reinvestment Zone One ("TIRZ #1") consisting of approximately 124 acres of land in the Downtown area. TIRZ #1 was created to fund a portion of infrastructure and maintenance costs associated with redeveloping Downtown Canyon. In 2022, Randall County (“County”) agreed to participate in TIRZ #1 through an interlocal participation agreement. TIRZ #1 has a 25-year lifespan. Purpose of a Tax Increment Reinvestment Zone A tax increment reinvestment zone (“TIRZ”) is a tool that local governments can use to finance needed improvements and infrastructure within a defined geographic area. These improvements usually are undertaken to promote the viability of existing businesses and to attract new commercial enterprises. The cost of eligible improvements is repaid by the contribution of future tax revenues by each taxing unit that levies taxes against the property. The additional incremental tax revenue that is received from the affected properties is referred to as the tax increment Figure 1: How the Tax Increment is Calculated City of Canyon, Texas – Downtown Tax Increment Reinvestment Zone| October 2022 1 Each taxing unit can choose to dedicate all, a portion, or none of the tax revenue that is attributable to the increase in property values due to the improvements within TIRZ. Each taxing unit determines what percentage of its tax increment, if any, it will commit to repayment of the cost of financing the public improvements. The statutes governing tax increment financing are located in Chapter 311 of the Tax Code. Existing Tax Increment Financing Districts in the City of Canyon There were no existing TIRZs in Canyon at the time of creation. According to state law, cities with less than 100,000 residents may not create a new TIRZ if the total appraised value of taxable real property in the proposed reinvestment zone and in the existing reinvestment zones would exceed 50.0 percent of the total appraised value of taxable real property within the city and its industrial districts. In addition, a TIRZ may not be created if more than 30.0 percent of the property in the proposed new TIRZ (excluding publicly-owned property) is used for residential purposes at the time of designation. TIRZ #1 complies with these state rules. Purpose of this Document This document is designed to meet the legal requirements of designating a TIRZ and to provide guidance for the TIRZ Board that has been established to manage TIRZ #1. The sections and subsections of this report correspond the required sections outlined in Chapter 311 of the Texas Tax Code. Texas Tax Code allows the governing body of the municipality or county that designated the TIRZ to amend the plan and extend the term of the zone after notice and hearing in the manner provided for the designation of the zone. Any changes to this plan will need to be documented and approved by the TIRZ Board and City of Canyon. Existing Zoning and Land Use Guidelines Applicable to TIRZ #1 Existing City of Canyon land use, zoning guidelines, and policies apply to all properties within the city limits. Taxing Jurisdictions Applicable to TIRZ #1 The TIRZ #1 is located within the following taxing jurisdictions: • City of Canyon • Randall County • South Randall County Hospital District • Canyon Independent School District Proposed Changes in Master Plans, Zoning Ordinances, and Building Codes There are no anticipated changes to the master development and zoning ordinances. Relocation of Displaced Persons This plan currently does not call for nor anticipate the displacement and relocation of persons for the proposed projects. By law, business personal property values are excluded from TIRZ. • Inflation & Appreciation Rate – The inflation rate used for construction costs and the value of improvements is 2.5 percent per year. • Net Present Value – The net present values of the tax increment were calculated at a discount rate of 5.0 percent. • Future Development Patters – To provide an order of magnitude estimate, TXP has conservatively assumed $100,000 per year in new taxable real property value will be built. Downtown Tax Increment Reinvestment Zone| October 2022 9 Section 4 – Finance Plan Project Overview & Costs TIRZ #1 will provide support for catalytic infrastructure and economic development projects that will facilitate the redevelopment of properties within Downtown Canyon and the surrounding area. Public infrastructure investment is required to redevelop the Downtown and surrounding area. This is the priority spending focus of TIRZ #1. Additional infrastructure and enhancement projects are included in the project plan if the resources are available. In addition, other projects might be added to the list as future development projects and related opportunities present themselves. The anticipated project costs are divided into major categories. Based on the revenue forecast, it is anticipated that most these expenses will occur within 3 to 5 years of the TIRZ being established. Duration of the Zone The total duration of TIRZ #1 is 25 years. The baseline year is 2021. It is scheduled to terminate on December 31, 2046, (including collection of the 2046 increment in calendar year 2047 and any related matters to be concluded in 2047). Method of Financing Project Costs All project costs will be paid through the contribution of incremental property taxes collections. The City of Canyon and Randall County will contribute a portion of incremental tax revenue to the zone. Estimated Time when Related Costs or Monetary Obligations Incurred The TIRZ will reimburse developers and pay for projects as funds become available. It might also take the TIRZ multiple years to accrue funds required for a project or to repay a developer. Estimated Amount of Bonded Indebtedness It is anticipated that financial transactions by the TIRZ are to be on a cash only basis and to the extent only that funds are available. However, if the resources become available to issue debt, the TIRZ #1 Board may recommend to the City of Canyon. that it is appropriate to issue TIRZ debt if the Tax Increment Fund can make such payments. The TIRZ Board is under no obligation to issue any notes or debt. Economically Feasible The TIRZ Board reviewed the TXP forecasts and model assumptions. It was determined that the TIRZ would generate sufficient revenue to pay for the Project Plan. Therefore, the City of Canyon, Texas – Downtown Tax Increment Reinvestment Zone| October 2022 10 financial forecasts are reasonable and its assumptions appear to be sound. The project plan is economically feasible. Implementation of the Project Plan The Canyon City Commission at all times shall have and retain paramount authority to direct the actions of the TIRZ #1 Board in connection with the administration of the Plans, and in that regard the Board shall have only the powers and authority granted to it from time to time by the City Commission. Eligible Project Costs & Categories 1. Parks & Streetscape Enhancements This category includes gateway features, linear parks, corridor landscaping, public plazas, etc. 2. Infrastructure Improvements This category includes water, sanitary sewer and storm water improvements, roadway and street intersection enhancements, public transportation, relocation of aboveground utilities, public sidewalks, public safety facilitates, and related right of way. This category includes eligible expenditures for design and engineering. 3. Economic Development Grants It is anticipated that economic development loans or grants might be made to assist in implementing the project plan. The City, with advisement from the TIRZ Board shall have the authority to establish and administer economic development programs, including but not limited to grants and loans, authorized under Chapter 380 of the Texas Local Government Code. Should such loans or grants be made, it will be done with the intent to fulfill the public purposes of developing and diversifying the economy, eliminating unemployment or underemployment, and developing or expanding transportation, business, and commercial activity in the TIRZ. 4. Developer Reimbursement for Public Improvements The TIRZ Board will seek to enter into agreements as necessary with other owners of undeveloped property in the Zone for the repayment of costs associated with infrastructure that benefit the Zone such as streets, water and sewer improvements, open space improvements, landscaping, flood control, and any other public projects that benefit the Zone. These projects will be evaluated and approved on a case-by-case basis. A developer will typically apply for and be authorized by the TIRZ and City of Canyon for TIRZ improvements, then fund and build the improvements. Upon completion and acceptance of the work by the City, the developer will be reimbursed with TIRZ funds if and when they are City of Canyon, Texas – Downtown Tax Increment Reinvestment Zone| October 2022 11 available. TIRZ payments are made based on available increment and other conditions set forth in project development agreements. Private developers must enter into a development agreement with the TIRZ if they desire the public sector to share in the costs of infrastructure improvements required for their projects. Reimbursement priorities and the method of apportioning available increment will be described in the development agreement. Each development agreement is unique. Accordingly, the nature and extent of support from the TIRZ may change over time as the area becomes more developed. 5. Non-Project Costs It is not possible to quantify other non-project costs at this time, other than to say that they are anticipated. However, these costs should not exceed TIRZ #1 revenue less other costs delineated in the project plan. Consultants, engineers, surveyors, and other costs incurred not related to the other categories and other unforeseen costs are included in this category. 6. Administration & Implementation The City will support the TIRZ administration with staff personnel. This support shall include keeping and maintaining the records of the Zone, accounting services as the Zone Board may request, and other administrative support. In addition, other eligible operations costs under this project category would include contracting for professional services as requested by the Board (ex. engineering firm, land planning, or other technical support). The administrative operations and maintenance costs are estimated at $10,000 per year. Future Eligible Projects The TIRZ Board may deem other public improvements necessary for the development of the TIRZ. If it is determined that additional public improvements are required, such improvements will be incorporated as amendments to the Project Plan in accordance and conformity with applicable law requiring the approval of the City Commission. City of Canyon, Texas – Downtown Tax Increment Reinvestment Zone| October 2022 22 AGENDA ITEM 9 AGENDA To: Joe Price, City Manager From: Brian Noel, Parks Director Date: November 14, 2022 Re: Consider and Take Appropriate Action on Chapman Forestry Foundation Grant Acceptance and Update of Canyon Aqua Park (The CAP) 2022 Season. Chapman Forestry Foundation The Chapman Forestry Foundation awards grants for up to $2500 annually for the purchase and planting of trees. In 2020 the City of Canyon Parks Department applied for a $2500 Chapman grant to offset the cost of the new trees to be planted in Canyon East Park. The Department completed the necessary paperwork and the tree project was inspected by Texas Forestry personnel in late December. In early November the City received a $2500 grant check from the Chapman Foundation. Our department has received this grant on multiple occasions and will continue to apply for these funds on an annual basis. These funds assisted in the purchasing of trees planted in Canyon East Park this fall as a part of our renovation project in the park. At this time staff would ask that you accept the $2500 grant check from the Chapman Foundation. Canyon Aqua Park (The CAP) Update At the CAP we wrapped up our sixth season in August. This season was one of record revenues, increased repair costs and staffing struggles. We hosted over 41,000 guests, which was a record and an increase of 2680 from 2021. Average daily attendance was 605 over the 69 days the park was open. Total revenue was $479,119, which included $103,695 in concession sales. Season pass sales increased over $10,000 from 2021. We added five new 10x12 cabanas this year and rented them for $25 per session. The cabanas included a table, four chairs and two loungers. Each cabana provides shade with side curtains. The cabanas were very well received and were rented over 500 times this summer. As the park ages we have proactively and also out of necessity, begun to make repairs to the facility to maintain it. Prior to opening the park, the slides were caulked and their condition was evaluated. Based on our findings, we have budgeted for professional repainting and maintenance work to be performed on the slides in the Spring of 2023. Due to some caulk failure we needed to make some repairs to the north wall of the kids play area. We chose to make these caulk repairs immediately after closing the park instead of going through another winter of damage caused by freezing and thawing. This repair work was unplanned, but was City of Canyon AGENDA approved and did cause the maintenance budget to be exceeded. One pool motor failed this season and needed significant repairs. Prior to opening for the 2023 season, we plan to replace all of the netting in the park and replace a significant portion of the caulking in the concrete deck seams. This Spring we caulked the slides and had an examination of the slide condition. We budgeted for repainting and maintenance in this year’s budget. Included in our yearly maintenance this year we had some wall repair and motor repair. The failure of the caulk allowed for freeze/thaw behind the north wall of the kids play area. One of our motors had to be repaired after it failed. We are planning on adding a few more features in our POS system this year and developing the use of the online account usage by our season pass holders. This is in an effort to save the credit card fees. We will once again offer a Black Friday sale this year.
