City Commission Meeting
July 20, 2023
The City Commission of the City of Canyon met at 4:30 pm in the City Commission Chambers of the
Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in
attendance, Mayor Pro-Tem Cody Jones, Paul Lyons, Robyn Cranmer and Danny Potter.
Also present were the following City Staff: City Manager Joe Price, Assistant City Manager Jon
Behrens, HR Director Hector Mendoza, Communications Director Megan Nelson, Director of Public
Works Dan Reese, Assistant Director of Public Works Chris Enriquez, Director of Planning and
Development Lucas Raley, Assistant Planning and Development Director Craig Brown, Economic
Development Director Stephanie Tucker, EDC Admin Assistant/Project Manager Brittany Bates,
Finance Director Joel Wright, Purchasing Manager Beau Boyer, Fire Chief Dennis Gwyn, Assistant
Fire Chief Vince Whitfill, Chief of Police Steve Brush, Police Captain Matt Coggins, Director of Golf
Casey Renner, Golf Course Superintendent John Haun, Parks Director Brian Noel, Water
Superintendent Eric Whitten, and City Attorney Chuck Hester.
Item 1. Call to Order.
Mayor Hinders called the meeting to order at 4:31 pm.
Item 2. Invocation.
Commissioner Potter gave the invocation.
Item 3. Pledge of Allegiance.
The Pledge of Allegiance was led by Mayor Pro-Tem Jones.
Item 4. Approval of the Minutes of the Meeting of June 19, 2023.
Mayor Pro-Tem Jones moved, duly seconded by Commissioner Cranmer to approve the minutes of
June 19, 2023 as presented. Motion carried unanimously.
Item 5. 2:30 pm Work Session – Budget Work Session
Budget Work Session was cancelled due to funeral of a School Board member being at the same
time.

Item 6. Public Comment – Comments from Interested Citizens.
Gena Richardson – 1205 Brookhaven Canyon, Texas: Ms. Richardson voiced concern about the
animal shelter.
Katie Kirkpatrick – 14560 Canyon Creek Rd: Ms. Kirkpatrick voiced concern over loosing Animal
Control Officer Lisa Cox as well as concern of animal shelter.

Sharon Brown – 1107 14th St Canyon, Texas: Ms. Brown agreed with Ms. Richardson and Ms.
Kirkpatrick and suggested a study committee to consider improvements.
Item 7. Consider and Take Appropriate Action on Resolution No. 30-2023, A Resolution of the
City of Canyon, Texas, Setting a Date, Time, and Place for Public Hearings and
Providing for Notice of Public Hearings in Regard to the Proposed Annexation of
Property Within the Extraterritorial Jurisdiction of the City of Canyon at the Request of
the Lumber Yard, LTD, a Texas Limited Partnership, Acting by and Through the Lumber
Yard Management, LLC, a Texas Limited Liability Company, as General Partner, Acting
by and Through its Managing Members, Rachel Byrd and Danny Byrd.
City Attorney Chuck Hester presented Resolution No. 30-2023 for consideration. Mr. Hester said
the Lumber Yard, LTD is the new owner of the location formerly known as Taylor Brothers Lumber
Yard north of Canyon. Mr. Hester said Danny and Rachel Byrd are managing members of the
General Partner, “The Lumber Yard Management LLC” and requested voluntary annexation of 44
acres in the ETJ for a commercial development of a proposed entertainment venue. Mr. Hester
stated Mr. Byrd, City Manager Joe Price, and city staff have had discussions regarding a cost share
arrangement for city utility services and have a tentative agreement with the Canyon Economic
Development Corporation to facilitate the development. Mr. Hester said a Municipal Service Plan
has been agreed on for utilities allowing the annexation to take place. Mr. Hester said adoption of
Resolution No. 30-2023 would set the annexation calendar in motion with appropriate public hearings
and adoption. City Manager Joe Price clarified there was a 60 day timeline for an annexation to
take place.
After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commission Potter to adopt
Resolution No. 30-2023 as recommended. Motion carried unanimously.

AND THROUGH ITS MANAGING MEMBERS, RACHEL BYRD
AND DANNY BYRD.
Item 8. Consider and Take Appropriate Action on Request from City Staff to solicit Bids for the
Construction of a New Irrigation System and All Associated Improvements at Palo Duro
Creek Golf Course.
Assistant City Manager Jon Behrens presented a request to solicit bids for the construction of a new
irrigation system and improvements at Palo Duro Creek Golf Course. Mr. Behrens said the

replacement of golf course irrigation system has been discussed for several year. Mr. Behrens said
in January of 2021, the Commission approved a plan and fee schedule that would fund the project.
Mr. Behrens stated it would be a year before things could get moving so the consultants said PDC
Golf Course would need to get in line now for the complete project to move forward.
PDC Golf Superintendent John Haun presented a plan proposal to the Commission with a brief
overview of the current situation stating the system in place was constructed in early 70’s and
described all the leak, satellite controller, and valve issues and malfunctions. Mr. Haun said the goal
is to put in a new irrigation system, improve current irrigated areas and expand some areas that get
a lot of play but don’t have adequate irrigation. Mr. Haun said not only would this increase the ability
to play, but would also prevent erosion of topsoil around the golf course.
Dr. Harry Hueston – 3308 Mable Dr. Canyon, Texas: Dr. Hueston spoke in support / Importance of
the upgrade of the irrigation system and associated improvements for Palo Duro Creek Golf Course.
After discussion, Commissioner Cranmer moved, duly seconded by Commission Lyons to authorize
city staff to solicit bids for the PDCGC irrigation system replacement project and all associated
improvements. Motion carried unanimously.
Item 9. Executive Session Pursuant to §551.071 Consultation with Attorney, §551.087
Deliberation Regarding Economic Development Negotiations, and §551.072
Deliberation Regarding Real Property.
Mayor Hinders indicated the City Commission would adjourn into Executive Session at 5:33 pm.
Item 10. Consider and Take Appropriate Action on Items Discussed in Executive Session.
Upon returning from Executive Session at 6:18 pm., no action was taken.
Item 11. Adjourn.
There being no further business, Mayor Pro-Tem Jones moved this meeting be adjourned at 6:18
pm.
