City Commission Meeting – Special Meeting August 15, 2024 The City Commission of the City of Canyon met in regular session at 4:30 p.m. in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance: Mayor Pro-Tem Cody Jones, Robyn Cranmer, and Danny Potter. Commissioner Paul Lyons was unable to attend. Item 1. Call to Order. Mayor Hinders called the meeting to order at 4:31 pm. Item 2. Invocation. Commissioner Cranmer gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Potter. Item 4. Public Comment – Comments from Interested Citizens. City Manager Joe Price expressed sympathy for the family of Dr. Robert Gross upon his passing. Mr. Price shared a letter of accommodation for the Police Officers and Firefighters that responded to the emergency call concerning Dr. Gross. Fire Chief Dennis Gwyn and Police Chief Steven Brush both spoke to the professionalism their departments show on a daily basis. Mr. Price recognized the first responders with a certificate of Exemplary Service. Firefighter Joley Braly Police Sargent J’Taun Sanchez Firefighter Ryan Wall Officer Joshua Barreto Firefighter Erik Gomez Officer Christopher Salinas Firefighter Daniel Bynum Officer Iza Villarreal Commissioner Cranmer expressed thanks to the leadership of both departments and the Firefighters and Officers. City Commission Meeting August 15, 2024 Page 2 of 4 Mayor Pro-Tem Jones stated he wrote the letter because when he witnessed the professionalism and compassion of each of the individuals that responded, he realized how grateful he is that these are the people taking care of his people. Mayor Hinders thanked the First Responders for taking pride in what they do and for caring about the citizens. Commissioner Potter stated he appreciates that each of the First Responders and the huge sacrifices they make every day and he is very grateful. Item 5. City Manager Recognition of Ernie Rojas for 41 Years of Dedication to Canyon Upon His Retirement. City Manager Joe Price and the City Commission recognized Parks Maintenance Worker Ernie Rojas for his dedication to the City of Canyon for 43 years. Mayor Hinders thanked Ernie for making the parks in Canyon beautiful and a place to be enjoyed by all. Item 6. Conduct Public Hearing and Consider and Take Appropriate Action on Ordinance No. 1213, An Ordinance Making Appropriations for the Support of the City of Canyon for the Fiscal Year Beginning October 1, 2024 and Ending September 30, 2025; Providing for the Appropriation of an Interest and Sinking Fund to Pay Interest and Principal on the City’s Indebtedness; Providing for the Adoption of the Annual Budget of the City of Canyon, Texas for the 2024-2025 Fiscal Year; Providing That Expenditures for Said Fiscal Year Shall be Made in Accordance with Said Budget; Authorizing Specific Budget Adjustment Authority to the City Manager; Providing for the Ratification of Budgeted Appropriation Transfers in the 2024-2025 Fiscal Year; Providing a Repealing Clause; Providing a Savings Clause; and Providing for Publication and an Effective Date. The public hearing and adoption of Ordinance NO. 1213 was completed during the August 12, 2024 Commission meeting. Item 7. Conduct Public Hearing and Consider and Take Appropriate Action on Ordinance No. 1214, An Ordinance of the City Commission of the City of Canyon, Texas, Fixing the Ad Valorem Tax Rate and Providing for the Levying of Ad Valorem Taxes for the Use and Support of the Municipal Government of the City of Canyon, Texas for Fiscal Year Beginning October 1, 2024 and Ending September 30, 2025 at the Rate of $0.410110 Per One Hundred Dollars ($100.00), and for Directing the Assessment Thereof; Providing for a Date o Which Such Taxes Become Due and Delinquent Together with Penalties and Interest Thereon; Providing for Repealing, Savings, and Severability Clause; Providing for an Effective Date of this Ordinance; and Providing for the Publication of the Caption Hereof. Purchasing Manager Beau Boyer presented Ordinance No. 1214 for consideration. Mr. Boyers gave a brief overview of the proposed tax rate. After discussion, Commissioner Cranmer moved duly seconded by Mayor Pro-Tem Jones to approve the proposed 2024 Maintenance and Operations tax rate of $0.37635. Motion carried unanimously. Gretchen Mercer, City Clerk City of Canyon AGENDA ITEM 6 AGENDA To: Joe Price, City Manager From: Joel Wright, Director of Finance, and Beau Boyer, Budget & Purchasing Manager Date: August 12, 2024 Re: Consider and Take Appropriate Action on Ordinance No. 1213 Adopting the FY 2024-2025 Operating Budget ONLY NEEDS TO BE CONSIDERED IF THE BUDGET IS NOT ADOPTED MONDAY AUGUST 12, 2024 During this regular meeting of August 12, 2024, the Commission will hold the required public hearing and introduce Ordinance 1213. All statutory requirements pertaining to the municipal budget process will be met after the conclusion of the Public Hearing. Upon final passage of Ordinance 1213, along with the subsequent ratification vote of the budget because of the increase in budgeted property taxes revenue of $567,943, the City of Canyon’s Operating Budget for the fiscal year beginning October 1, 2024 and ending September 30, 2025 will be complete. Justification for Property Tax Increases: 1) $250,233 - Increase to meet voter-approved annual debt service requirement. 2) $195,038 – Existing General Fund full-time employee merit salary increases. 3) $112,090 – 3 new firefighter positions for half the year. 4) $ 32,226 – required increase in General Fund full-time employee retirement contributions. 5) $ 25,920 – increase for firefighter retirement contributions (volunteer incentive). 6) $ 49,545 – Unreimbursed School Resource Officer (SRO) position costs. 7) $ 36,401 – Court Bailiff positions costs previously paid by Special Revenue Fund. 8) $ 27,500 – Safe Streets for All grant match. 9) $304,207 – Reduced budgeted Sales Tax revenue. The proposed major fund expenditures in the FY 2024-2025 Operating Budget total $26,875,121. This amount includes personnel costs, service operations, capital improvements, capital projects, and equipment purchases. The proposed budget has an $845,178 increase in budgeted expenses compared to FY 2023-2024. Staff recommends Commission’s ratification of the Proposed Budget for FY 2024-2025 regarding the property tax increase. City of Canyon AGENDA RECOMMENDED MOTION: 2 separate motions - 1 on Budget Adoption and 1 on the Ratification of the Budget – due to the increase of property taxes): 1) I move that Ordinance 1213, making appropriations in support of the general operation of the City of Canyon for the year beginning October 1, 2024 and ending September 30, 2025, be adopted on final reading.” “RECORD VOTE REQUIRED” 2) Texas Local Government Code 102: Adoption of a budget that will require raising more revenue from property taxes than in the previous year requires a separate vote of the governing body to ratify the property tax increase reflected in the budget. Transfer of appropriations budgeted from one account classification to another account classification within the same department. 2. Transfer of appropriations budgeted from one department or activity to another department or activity within the same fund. SECTION 6. That, all provisions of the ordinances of the City of Canyon, Texas, in conflict with the provisions of this Ordinance be and the same are hereby repealed and all other provisions of the ordinances of the City of Canyon, Texas, not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 7. That, if any word, sentence, paragraph, subdivision clause, phrase or section of this Ordinance be adjudged or held unconstitutional, illegal, or invalid, the same shall not affect the validity of this Ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal, or unconstitutional. SECTION 8. That, this Ordinance shall become effective after its publication, and the City Secretary of the City of Canyon, Texas, is hereby directed to publish in the Official Newspaper of the City of Canyon, Texas, the Caption, and Effective Date of this Ordinance as required by Section 52.013, Texas Local Government Code. The current tax rate is $0.39286 per $100 valuation which consists of a maintenance and operations (M&O) rate of $0.37907 per $100 valuation and a debt service (I&S) rate of $0.01379 per $100 valuation. Thus far these rates have generated an actual total amount of $4,413,509 in fiscal year 2023-2024. Staff is proposing adoption of a combined tax rate of $0.41011 per $100 valuation for the 2024 tax year. The proposed tax rate consists of a maintenance and operations (M&O) rate of $0.37635 per $100 valuation and a debt service interest and sinking fund (I&S) rate of $0.03376 per $100 valuation. The proposed tax rate is more than the no-new-revenue tax rate of $0.36660 as calculated in accordance with the provisions of the current Property Tax Code, and this thus a tax rate increase. In 2024 Market Values of property increased by 9% and Taxable Values increased by 10% as compared to the 2023 tax year. The proposed tax rate would generate a 13% increase in budgeted property tax revenue in the 2024-2025 fiscal year as compared to the 2023-2024 budget. One public hearing on the tax rate will be required, and the tax rate can be adopted at the conclusion. If a tax rate is not adopted following the public hearing, an announcement prior to adjournment must be made of the date, time and place at which the vote to adopt the tax rate will take place. This later meeting must be held no later than August 22, 2024. [HOLD PUBLIC HEARING] RECOMMENDED MOTION: Tax Rate Approvals: City council must separately approve the maintenance and operations component and the debt service component of the tax rate. TEX. TAX CODE § 26.05(a). 1. I move to approve the proposed 2024 Maintenance and Operations tax rate of $0.37635. 2. I move to approve the proposed 2024 Interest and Sinking tax rate of $0.03376. Tax Rate Adoption: The vote on the ordinance setting the tax rate must be a record vote and must be approved by at least 60 percent of the members of the city council. TEX. TAX CODE § 26.05(b). 3. That, the findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. Ordinance 1214 Page 1 of 4 SECTION 2. That, there is hereby levied and ordered to be assessed and collected for the Maintenance and Operations of the municipal government of the City of Canyon and to provide an Interest and Sinking Fund for the Fiscal Year 2024-2025, upon all property, real, personal, and mixed within the corporate limits of said City on January 1, 2024 subject to taxation, a tax of $0.410110 on each one hundred dollar ($100.00) valuation on said property, said tax being levied and apportioned to the specific purposes hereinafter set forth: a. For the maintenance and operations support of the general government (General Fund), $0.37635 on each $100.00 of taxable valuation of property; and, b. For the Interest and Sinking Fund, $0.03376 on each $100.00 of taxable valuation of property. c. THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR’S TAX RATE 1. 0F d. THE TAX RATE WILL EFFECTIVELY BE RAISED BY 13.1 PERCENT AND WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY APPROXIMATELY $43.51 2. 1F SECTION 3. That, the taxes assessed and levied hereby are payable any time after the approval and publication of this Ordinance, and not later than January 31 of the year following the year in which the taxes are assessed. The penalties and interest provided herein shall accrue after January 31 of the year following the year in which the taxes are assessed. However, if the entire taxes due as provided herein are paid in full by January 31 of the year following the year in which the taxes are assessed, no penalty or interest shall be due. SECTION 4. That, a delinquent tax shall incur the maximum penalty and interest authorized by Section 33.01, Texas Tax Code, to-wit: a penalty of six percent (6%) of the amount of the tax for the first calendar month it is delinquent, plus one percent (1%) for each additional month or portion of a month the tax remains unpaid prior to July 1st of the year in which it becomes delinquent. Provided, however, a tax that is delinquent on July 1st of the year in which it becomes delinquent shall incur a total penalty of twelve percent (12%) of the amount of the delinquent tax without regard to the number of months the tax has been delinquent. A delinquent tax shall also accrue interest at a rate of one percent (1%) for each month or portion of a month the tax remains unpaid. 1. Texas Tax Code, Section 26.05 (b)(1)(A) 2. Texas Tax Code, Section 26.05 (b)(1)(B) Ordinance 1214 Page 2 of 4 Taxes that remain delinquent on July 1st of each year in which they become delinquent shall incur an additional penalty of twenty percent (20%) of the amount of taxes, penalty and interest due; such additional penalty is to defray the costs of collection as authorized by Section 6.30, Texas Property Tax Code. All taxes shall become a lien upon the property against which assessed, and the Randall County Tax Assessor Collector as the collector for the City of Canyon is hereby authorized and empowered to enforce the collection of such taxes according to the Constitution and laws of the State of Texas and ordinances of the City, and shall by virtue of the tax rolls, fix and establish a lien by levying upon such property, whether real, personal, or mixed, for the payment of said taxes, penalty and interest, and, the penalty and interest collected from such delinquent taxes shall be apportioned to the General Fund of the City. SECTION 5. That, taxes are payable at the office of the Randall County Tax Assessor-Collector. The Randall County Tax Assessor-Collector shall have available all rights and remedies provided by law for the enforcement of the collection of taxes levied under this Ordinance. SECTION 6. That, the tax roll, as presented to the City Commission, together with any supplements thereto, is hereby accepted. SECTION 7. That, the City Commission held a public hearing to obtain comments and recommendations from Canyon taxpayers, ratepayers, residents, businesses, and other interested persons specifically on the City’s proposed ad valorem (property) tax rates for Fiscal Year 2024-2025. In compliance with the Truth-in-Taxation requirements, the required public “Notice of 2024 Tax Year Proposed Property Tax Rate of City of Canyon” was published in the Canyon Newspaper on August 7, 2024 and the notice was published on the City of Canyon Internet Website’s Homepage. The required public hearing on the proposed 2024 ad valorem (property) tax rate for the City of Canyon was held by the City Commission on August 15, 2024 at Canyon City Hall located at 301 16th Street, Canyon, TX 79015. SECTION 8. That, all provisions of any ordinance in conflict with this Ordinance are hereby repealed; but, such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent prosecution from being commenced for any violation occurring prior to the repeal of the ordinance. Any remaining portions of conflicting ordinances shall remain in full force and effect. Ordinance 1214 Page 3 of 4 SECTION 9. That, should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City hereby declares that it would have passed this Ordinance, and each section, subsection, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional or invalid. SECTION 10. That, this Ordinance shall become effective immediately from and after its passage. PASSED, APPROVED, AND ADOPTED, on this the 15th day of August 2024, at a regular meeting of the City Commission of the City of Canyon, Texas, which meeting was held in compliance with the Open Meetings Act, Tex Gov’t Code, §551.001, et.seq. at which meeting a quorum was present and voting. When appraisal values increase, the NNR tax rate should decrease. Voter Approval Tax Rate (VATR) The voter-approval tax rate is the highest tax rate that a taxing unit may adopt without holding an election to seek voter approval of the rate (with some exceptions for cities with a population below 30,000). It is intended to include a 3.5% increase to the NNR M&O Tax Rate and provide for necessary debt service. Section 26.075 Tax Rate When calculating their VATR, Special Taxing Units include an 8% increase to the NNR M&O Tax Rate, as opposed to the 3.5% used for cities. However, when deciding when an adopted tax rate can be petitioned for an election, Texas Tax Code 26.075 allows for cities with a population below 30,000 to use the greater of this Special Taxing Unit rate or the VATR if the VATR is below the De Minimis Rate. De Minimis Rate Cities with a population below 30,000 may adopt a tax rate above the VATR but below the De Minimis Rate without automatically requiring an election. However, voters could petition to hold an election. The De Minimis Rate is calculated by adding the NNR M&O Rate, the I&S Rate for debt service, and the rate that will raise $500,000.
