PLANNING AND ZONING COMMISSION REGULAR MEETING August 9, 2017, 6:00 PM 13133 E. ARAPAHOE ROAD MINUTES 1. CALL TO ORDER Chair Sutherland called the meeting to order at 6:01 PM. 2. ROLL CALL Those present were: Chair Sutherland Commissioner Beatty Commissioner Cohen Commissioner Griffis Commissioner Hart Commissioner Larimer Commissioner Sims Commissioner Suhaka Commissioner Urtz Also present were: Jill Hassman, Assistant City Attorney Derek Holcomb, Deputy Director of Community Development Lisa Gajowski, Recording Secretary a. Alternate Selection for Voting Purposes 3. UPDATES a. Trails and Recreation Plan Update (Jenny Houlne) Jenny Houlne, Senior Planner, and Chris Geddes of Design Workshop, presented. 4. CONSENT AGENDA Commissioner Griffis moved approval of the CONSENT AGENDA. Commissioner Suhaka seconded the motion. With Commissioners Cohen, Griffis, Hart, Sims, Suhaka, Urtz and Chair Sutherland voting AYE and none voting NAY; the motion was approved by a vote of seven (7) AYE and none (0) NAY. a. EXECUTIVE SESSION Chair Sutherland moved to go into Executive Session Pursuant to C.R.S. §24-6-402(b) to receive legal advice concerning processes and considerations for variance applications. Commissioner Sims seconded the motion. With Commissioners Cohen, Griffis, Hart, Sims, Suhaka, Urtz and Chair Sutherland voting AYE and none voting NAY; the motion was approved by a vote of seven (7) AYE and none (0) NAY. The meeting recessed to Executive Session at 6:36 PM. The meeting reconvened at 7:02 PM. 6. LAND USE APPLICATIONS/PUBLIC HEARINGS a. Lincoln Executive Center Airport Influence Area Variance Request, LU-17-00161 Derek Holcomb, Deputy Director of Community Development, presented. Carolyn White of Brownstein Hyatt Farber Schreck, presented on behalf of the applicant. Brian Mott, of IBC Holdings and the applicant presented. Chair Sutherland opened the public hearing. Steve Rogers, 6253 S Lima Way, spoke in opposition. Tamara Hunter Maurer, 4283 E Weaver Place, spoke in support. Dylan Heberlein of the Arapahoe Airport Authority, spoke in opposition. Riaz Gopolani, 6224 S Kenton Way, Englewood spoke in opposition. Carolyn White responded to public comments. There being no one else present wishing to speak, Chair Sutherland closed the public hearing. Commissioner Sims moved that Case Number LU-17-00161, Lincoln Executive Center Airport Influence Area Variance, be recommended to City Council for conditional approval based on the finding that the application meets at least one criteria for approval set forth in Section 12-14-803.C of the LDC, as outlined in the staff report dated August 2, 2017. And I further move: That City Council consider requiring the following condition on the approval of the variance: Minutes – Planning and Zoning Commission August 09, 2017 Page 3 1. That a specific note, substantially similar to the following, and approved by the Director and City Attorney, be included on any future plat and/or site plan approved for the subject property: “The property within this [Plat/Site Plan] was granted a variance from the requirements set out in Division 3-9 of the LDC, Airport Influence Area, in City Case No. LU-17-00161. As a condition of approval of the variance the applicant agreed to utilize certain construction measures to reduce the expected interior noise level on every noise-sensitive use and/or residential dwelling unit in any proposed future development to 45 DNL or less.” Commissioner Cohen seconded the motion. With Commissioners Cohen, Griffis, Hart, Sims, Urtz and Chair Sutherland voting AYE and Commissioner Suhaka voting NAY; the motion was approved by a vote of six (6) AYE and one (1) NAY. 7.
