MINUTES OF THE CENTENNIAL CITY COUNCIL Regular City Council Meeting 7:23 PM Monday, July 12, 2010 A Regular Meeting of the City Council was held on this date in the City Council Chambers at 13133 E. Arapahoe Road, Centennial, Colorado. A full and timely notice of this meeting had been posted and a quorum was present. 1. Call to Order Mayor Noon called the meeting to order at 7:23 PM. 2. Roll Call Those present were: Mayor Noon Council Member Dindinger Council Member Gardner Council Member Bosier Council Member McClellan Council Member Anderson Council Member Miller Council Member Weidmann Council Member Moon Those absent were: None Also present were: Jacque Wedding-Scott, City Manager Bob Widner, City Attorney Dave Zelenok, Director of Public Works Richard Lewis, Program Manager – Operations Elisha Thomas, Assistant to City Manager Dawn Priday, Director of Finance Gary Wilson, Long Range Planning Manager James Clanton, Management Analyst Wayne Reed, Director of Planning and Development Jacob Eigner, Youth Commissioner Patty Putfark, Senior Records and Information Management Clerk Brenda Madison, City Clerk 3. Pledge of Allegiance; 7:25 PM Mayor Noon led the Pledge of Allegiance. 4. Public Comment; 7:27 PM Donald Gregg, 6610 S. Olathe Street, recommended Council look at the Arapahoe County Planning Commission minutes from 1990's regarding the Sunset Community sound wall. Phillips Circle, stated she favored a new Willow Creek sound wall. Mark Reuter, 8088 S. Quince Circle, stated he favored sound wall upgrades. 5. Scheduled Presentations (None) 6. Consideration of Communications, Proclamations and Appointments (None) CONSENT AGENDA Council Member Weidmann moved approval of CONSENT AGENDA. Council Member Bosier seconded the motion. With Mayor Noon, Council Member Dindinger, Council Member Gardner, Council Member Bosier, Council Member McClellan, Council Member Anderson, Council Member Miller, Council Member Weidmann, Council Member Moon voting AYE, and (None) voting NAY; Abstain: 0; Absent: 0. THE MOTION Passed. 7. Consideration of Ordinances on First Reading a. ORDINANCE NO. 2010-O-18: AN ORDINANCE APPROVING THE ACQUISITION OF A FIFTY PERCENT (50%) UNDIVIDED INTEREST IN THAT CERTAIN PROPERTY IDENTIFIED IN THE INTERGOVERNMENTAL AGREEMENT REGARDING PARKER JORDAN OPEN SPACE PROPERTY DATED JUNE 21, 2010, AND ACCEPTING TITLE TO SUCH PROPERTY 8. RESOLUTION NO. 2010-R-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, AUTHORIZING THE MAYOR TO SIGN A LETTER OF OPPOSITION TO THE FEDERAL PUBLIC SAFETY EMPLOYER- EMPLOYEE COOPERATION ACT OF 2009 (S. 3194) WHICH WILL BE OFFERED AS AMENDMENT 4174 TO THE DISASTER RELIEF AND SUMMER JOBS ACT OF 2010 (H.R. 4899) Mayor Noon presented Resolution No. 2010-R-69; 7:39 PM. Council Member Weidmann moved approval of RESOLUTION NO. 2010-R-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, AUTHORIZING THE MAYOR TO SIGN A LETTER OF OPPOSITION TO THE FEDERAL PUBLIC SAFETY EMPLOYER-EMPLOYEE COOPERATION ACT OF 2009 (S. 3194) WHICH WILL BE OFFERED AS AMENDMENT 4174 TO THE DISASTER RELIEF AND SUMMER JOBS ACT OF 2010 (H.R. 4899). Council Member Bosier seconded the motion. Council Member Weidmann moved to call for question. Council Member Moon seconded. With Mayor Noon, Council Member Gardner, Council Member Weidmann, Council Member Moon, Council Member Miller, and Council Member Bosier voting AYE, and Council Member Anderson, Council Member Dindinger, Council Member McClellan voting NAY; Abstain: 0; Absent: 0. THE MOTION FAILED, (Super-Majority needed to pass). Council Member McClellan moved to table the discussion. A friendly amendment was made to include if not voted on by the State Senate on Thursday, July 15, 2010, then Council could have both sides come to Council to give presentations. Council Member Dindiner seconded motion with amendment. With Council Members Moon, Dindinger, Gardner, McClellan, Anderson voting AYE, and Council Members Bosier, Miller, Weidmann and Mayor Noon voting NAY, the motion with the friendly amendment PASSED. ii. RESOLUTION NO. 2010-R-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, OPPOSING PROPOSITION 101 AND AMENDMENTS 60 AND 61 Mayor Noon presented; 8:15 PM. Council Member Moon moved approval of RESOLUTION NO. 2010-R-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, OPPOSING PROPOSITION 101 AND AMENDMENTS 60 AND 61. Council Member Weidmann seconded the motion. The Centennial City Council Meetings are audio streamed live on the City’s Web site. Public Comment The Public Comment section offers an opportunity for any citizen to express opinions or ask questions regarding City services, policies or other matters of community concern that are not part of a scheduled public hearing. Citizens will have three minutes for comments if they are speaking as an individual, or five minutes if speaking on behalf of a group or organization. These time limits were established to provide efficiency in the conduct of the meeting and to allow equal opportunity for everyone wishing to speak. An immediate response should not be expected, as issues are typically referred to City staff for follow-up or research and are then reported back to Council and the individual who initiated the comment or inquiry 5. Consideration of Land Use Cases (None) Given the quasi-judicial nature of land use cases, we wish to advise the applicant, members of the public and press that in order to provide due process to the applicant and the public, the City Council is only allowed to consider communications that occur during the public hearing and matters set forth in the record. Consequently, City Council Members cannot engage in conversations about any land use applications before the hearing or during a break from the hearing. The purpose of this restriction is to ensure a fair, unbiased process and to allow the City Council to make an impartial, objective decision on the case.
