MINUTES OF THE CENTENNIAL CITY COUNCIL Special Meeting 6:00 PM Monday, December 13, 2021 A Special Meeting of the City Council was held on this date in the Council Chambers at 13133 E. Arapahoe Road, Centennial, Colorado. A full and timely notice of this meeting had been posted and a quorum was present. 1 Call to Order Mayor Piko called the meeting to order at 7:00 PM. 2 Roll Call Those present were: Mayor Piko Council Member Moon Council Member Turley Council Member Sweetland Council Member Maurer Council Member Sutherland Council Member Holt Council Member Alston Council Member Sheehan Those absent were: None Also present were: Matt Sturgeon, City Manager Robert Widner, City Attorney Elisha Thompson, Deputy City Manager Jenna Campbell, Planner II Michael Gradis, Principal Planner Jeff Cadiz, Finance Director Jill Hassman, Senior Assistant City Attorney Anna Bunce, Traffic Engineer Patrick Fleming, Management Analyst Barbara Setterlind, City Clerk Christina Lovelace, Deputy City Clerk 3 Land Use Cases a Public Hearings - Continued from December 7, 2021; 6:07 PM i ORDINANCE NO. 2021-O-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO APPROVING THE STREETS AT SOUTHGLENN MASTER DEVELOPMENT PLAN, EIGHTH AMENDMENT (PUD-21-0004) Minutes – Special Meeting 12/13/2021 6:00:00 PM Page 2 Council Member Turley moved that Ordinance No. 2021-O-22 consideration of approval of the 8th Amendment of The Streets at Southglenn Master Development Plan (Case No. PUD-21-00004) be approved based on the City Council finding that the major amendment meets all applicable criteria for approval set forth in section 2.3.A.3 of The Streets at Southglenn Master Development Agreement as described in the Findings and Conclusions presented to the City Council Subject to the Following Conditions in addition to those stated in Section 3 of Ordinance No. 2021-O-22: 1. The City and Northwood’s execution and recordation of the letter agreement in substantially the form presented to City Council during the public hearing which commits Northwood to the voluntary condition of: (a) submittal of an application for an ASP for the development of all or a portion of the South Redevelopment Area within 18 months following the City’s final, non-appealable approval of the 8th Amendment of the MDP, and (b) commencing demolition of the existing former “Sears” department store building within nine months of issuance of the first residential building permit; AND 2. The City and Alberta’s execution of an agreement approved by the City Attorney which commits Alberta to the voluntary condition of: (a) analyzing within the City potential solution to improve functioning of the left turn movement from northbound University Boulevard onto Commons Drive and if it is determined that one or more measures should be undertaken to address the issue, (b) fully finding and implementing the selected solution to the satisfaction of the City as apart of the first ASP for development pursuant to the 8th Amendment of the MDP. Council Member Sheehan seconded the motion. With Mayor Piko, Council Member Turley, Council Member Alston, Council Member Holt, Council Member Maurer, Council Member Moon, Council Member Sheehan, Council Member Sutherland, (8) voting AYE, and Council Member Sweetland (1) voting NAY; Absent: 0. THE MOTION Passed. ii ORDINANCE NO. 2021-O-23, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO APPROVING THE AMENDED AND RESTATED MASTER DEVELOPEMNT AGREEMENT CONCERNING THE STREETS AT SOUTHGLENN REDEVELOPMENT PROJECT AND ESTABLISHING VESTED PROPERTY RIGHTS PURSUANT TO ARTICLE 68 OF TITLE 24, C.R.S., AS AMENDED, AND SECTION 12-14-606 OF THE LAND DEVELOPMENT CODE. Council Member Turley moved to approve Ordinance No. 2021-O-23 approving the amended and restated Master Development Agreement concerning the Streets at Southglenn Redevelopment Project and establishing vested property rights pursuant to Article 68 of Title 24, C.R.S., as amended, and section 12-14-606 of the Land Development Code. Council Member Sutherland seconded the motion.
