Strother Murray-ndinga, Theodore Nollert, and Erik Valera Absent 1 - Louie Rivers Approval of Agenda Announcements Petitions Approval of Minutes 1. 9.19.23 Meeting Minutes [23-0695] Planning Commission is asked to review and approve the minutes of the September 19, 2023, meeting. Theodore Nollert made a motion, seconded by Geoffrey Green, to approve the September 19th, 2023 Meeting Minutes. The motion was carried by an 6-0 vote. New Business 2. Administrative Minor Subdivision Review - Agree Chapel Hill NC [23-0696] LLC Planning Commission is asked to act in its administrative capacity to review and consider approval of this minor subdivision application. Options for action include (1) approval, (2) denial, (3) or referral to the Town Council if the application is deemed to be a major subdivision. Theodore Nollert made a motion, seconded by Jon Mitchell, to approve the Resolution A approving the Agree Minor Subdivision. The motion was carried by an 8-0 vote. 3. Gateway Conditional Zoning Application [23-0697] Planning Commission is asked to review this Conditional Zoning Application and provide a recommendation regarding approval of the application and its consistency with the Comprehensive Plan to the Town Council by October 6, 2023. Geoff Green moved, and Jonathan Mitchell seconded, a recommendation that the Council find that the proposed Gateway Conditional Zoning District Application is consistent with the Comprehensive Plan. The motion passed 7-1. Page 2 of 4 Planning Commission Meeting Minutes October 3, 2023 Yeas: Elizabeth Losos (Chair), Wesley Mcmahon (Co-Chair), Geoff Green, Chuck Mills, Jonathan Mitchell, Theodore Nollert, and Erik Valera Nays: Strother Murry-Ndinga Jonathan Mitchell moved, and Theodore Nollert seconded, a recommendation that the Council deny the Gateway Conditional Zoning District Application as an amendment to the Zoning Atlas and included a matrix as a supplement to their recommendation. The motion passed 7-1. Yeas: Elizabeth Losos (Chair), Wesley Mcmahon (Co-Chair), Chuck Mills, Jonathan Mitchell, Strother Murry-Ndinga, Theodore Nollert, and Erik Valera Nays: Geoff Green Adjournment Next Meeting - October 17, 2023. Should any member of the Body or any member of the public fail to observe this charge at any time, the Chair will ask the offending person to leave the meeting until that individual regains personal control. Should decorum fail to be restored, the Chair will recess the meeting until a genuine commitment to this public charge is observed.
