MINUTES CITY OF CHEROKEE VILLAGE, ARKANSAS REGULAR CITY COUNCIL MEETING 6: 30 P. M., THURSDAY, JULY 16, 2020 CHEROKEE VILLAGE CITY HALL Meetings are video recorded) Mayor Stokes called the regular meeting of the City Council to order at 6: 30 p. m. on Thursday, July 16, 2020. Mayor led the Pledge of Allegiance followed by a moment of prayer. Roll was called by Clerk Deb Weichinger. Present were Les Covington, Chuck Kristopeit, Thomas Rupard, Rob Smith, Steve Thompson, Mayor Stokes and City Attorney Jon Abele. Present via Zoom: Jerry Adams & Pamela Rowland. ( Ward 2, Position 1 is vacant). APPROVAL OF THE AGENDA: Council Member Rob Smith moved to approve the council minutes, second by Council Member Les Covington and passed unanimously. PUBLIC COMMENTS ON AGENDA ITEMS: ( limit 3 minutes per person) APPROVAL OF THE MINUTES ( June 18, 2020): Council Member Rob Smith moved to approve the council minutes, second by Council Member Thomas Rupard and passed unanimously. CORRESPONDENCE: A card from the Hollaway family thanking Officers Tines, McBride and Buchanan for all the assistance in the call( s) for help Friday - Monday, June 26 — 29, 2020. A card was received from Mary L Davis stating her appreciation in the search for LeeRoy to the CVPD and CVFD. FINANCIAL REPORT: Mayor stated revenue stream is running about 2 ' / z% less than last year through the end of June. Council Member Rob Smith moved to approve the June 2020 financials to be filed for audit, second by Council Member Chuck Kristopeit. Roll call vote passed unanimously. MAYOR' S REPORT: Fire rating for the community has dropped from a 5 to a 4; will help with insurance premiums. Police department has purchased two ( 2) new trucks, currently being outfitted. He would like to work with S. I. D. and American Land to clean up areas with condemned properties, specifically spoke of Santa Fe Addition. Ordinance 2020-: An Ordinance to Provide for the Collection and Control of Solid Waste in the City of Cherokee Village, Arkansas; and for Other Purposes Clerk read proposed ordinance in full. Council Member Thompson addressed talking points ( source document on file) regarding the proposed trash ordinance. Council Member Rowland asked for clarification on: ( 1) Section 9, item ' B ", why are we allowing tenants being responsible for trash collection if we are addressing homeowners with this ordinance; ( 2) Section 14, will city be collecting? Council Member Thompson explained the city will designate the trash collector to collect the fee. ( 3) Section 13, would like to see stricken from the ordinance on a fairness issue who will not have a weekly need for trash collection. Council Member Kristopeit agreed. ( 4) Asked if Mayor could negotiate a senior discount. Council Member Thompson stated if a property is unoccupied for 30 or more days, a homeowner can have garbage, similar to having water and electric turned off until the residence is occupied again. Council Member Rowland' s issue is in how this will affect rental properties. Council Member Thompson stated looking at item # 9 in the talking points; to be addressed in a rental ordinance to provide for water and trash monthly to be included in the property rental fee( s). Mayor stated water and electric rates varies unlike a fixed trash rate to be in the rent. City Attorney Abele suggested leaving the language in the garbage ordinance as it is written; obligation of owners of the rental property to pay the garbage be addressed in the rental ordinance. Council Member Adams asked why businesses are not included as well. Council Member Thompson stated the business permit process for 2021 will be asked to prove existing contract for garbage service as part of their permit. Mrs. Rowland conveyed comments of people who she' s spoken with this are bad timing financial as a result of this COVID pandemic. Council Member Kristopeit asked if the $ 16. 70 fee amount in Section 10, would require an amendment to this ordinance, City Attorney Abele stated any future rate increases would be addressed by resolution. Council Member Rowland asked Mayor if he would speak with the garbage company to ask about any senior discount. Mayor stated his note reflects he will be asking the garbage company about senior discount and sharing amongst neighbors who have very little garbage. NEW BUSINESS: 1. Mr. Ewers, 14 Iroquois Dr, expressed concern about water runoff from the parking lot of the new Dollar General store to be built across the street from his residence. 2. Carlton ( Carr) Hill, candidate to fill vacancy of Ward 2, Position 1. Mr. Hill has lived in the village for 14 years, teaches English and coaches football at Highland High School. Main objective is to represent the youth in the area. Mayor asked if Mr. Hill has done any volunteer work: Village Pride. Council Member Adams asked if registered voter and if Mr. Hill will run for the seat in November? Yes. Council Member Smith motioned, to appoint Mr. Hill to fulfill the vacancy of Ward 2, Position 1, second by Council Member Thompson. Roll call vote passed unanimously. COMMENTS: 1. Darryl Beason has lived in the village since 1963. Mr. Beason stated he is currently paying for garbage collection; asked about fees in section 13 in the garbage ordinance. Council Member Covington explained this is not a second fee. 2. Bill Matselboba resident for 15 years would like to see the trash ordinance on the ballot in November. 3. Laura Mashburn now has the deed for 1 Mohave Dr. and would like to continue remodeling. Council Member Covington asked if the raze and removal can stay in place, just not be executed.
