REGULAR CITY COUNCIL MEETING
6: 30 P. M., THURSDAY, AUGUST 20, 2020

Mayor Stokes called the regular meeting of the City Council to order at 6: 30 p. m. on Thursday, August 20,
2020. Mayor led the Pledge of Allegiance followed by a moment of prayer.
Roll was called by Clerk Deb Weichinger. Present were Jerry Adams, Les Covington, Chuck Kristopeit,
Thomas Rupard, Rob Smith, Steve Thompson, Mayor Stokes and City Attorney Jon Abele. Present via
Zoom: Pamela Rowland. Absent: Carr Hill.
APPROVAL OF THE AGENDA: Council Member Covington moved to approve the council agenda,
second by Council Member Thompson and passed unanimously.
PUBLIC COMMENTS ON AGENDA ITEMS: ( limit 3 minutes per person)
Bill Matselboba & Darrell Beason both asked for the trash ordinance to be tabled.
APPROVAL OF THE MINUTES ( July 16, 2020): Council Member Smith moved to approve the council
minutes, second by Council Member Kristopeit and passed unanimously.

FINANCIAL REPORT: Council Member Adams moved to approve the July 2020 financials to be filed for
audit, second by Council Member Covington. Roll call vote passed unanimously.
MAYOR' S REPORT:
Mayor deferred to Council Member Smith reported an angel amongst us. Mary Dewitt -Heunsch was
successful in receiving a $ 31, 000 grant for Fire Department turnout gear. Lighter helmets and suits will
be obtained through this grant.

P & Z / CODE ENFORCEMENT: ( report on file)
Council Member Kristopeit stated there will be a special meeting at 6: 30 pm, Monday, September 14,
2020 at the Omaha Center. This meeting will be open to the public to discuss the cleanup of the Santa
Fe Addition. Council Member Rupard asked Thomas Swiatkowski about a burn out property ( # 20198).
Mr. Swiatkowski stated this would be a new construction; not a remodel, requiring a new construction
permit.
POLICE: ( report on file)
Police Chief Crook recognized Officers B. Buchanan and R. C. Lenex for installing equipment on the new
vehicles.
The city will be saving approximately $ 1, 000 per unit as a result of our officers installing the
equipment on their time. The business who sold the new bumpers to the city at cost is willing to sell the
removed stock bumpers for the city.
STREET DEPARTMENT: ( report on file)
Street Superintendent Kyllo reported an update on the Nioka storm siren. Entergy came and installed the
pool and set the siren on top. There' s an electrical contractor coming August 21, 2020 to run the electric.
Test may be run on third siren.

Ordinance 2020 - 02: An Ordinance to Provide for the Collection and Control of Solid Waste
in the City of Cherokee Village, Arkansas; and for Other Purposes: Motion made by Council
Jerry Adams, second by Council Member Les Covington for Clerk to read Ordinance # 2020 -02 by
title only. Roll call vote passed unanimously. After some discussion, a motion was made by
Council Member Covington, second by Council Member Rupard to approve and adopt Ordinance
2020 - 02 effective January 1, 2021. Roll call vote passed: Ayes: Council Members Adams,
Covington, Rupard, Smith, and Thompson. Nays: Council Member Kristopeit, Rowland. Motion
passed.
NEW BUSINESS:
1. Resolution 2020 - 10: A Resolution to Declare Items Surplus Property and to Remove from
City of Cherokee Village Property Asset List ( 2013 Ford & 2007 Ford): Vehicles are no longer
equipped with useable law enforcement equipment. Items classified as scrap property, to be sold
as is by competitive bid, funds deposited in PD General Account. Motion was made by Council
Member Adams, second by Council Member Covington to approve Resolution No 2020 -10. Roll
call vote passed unanimously.
2. Resolution 2020 -11: A Resolution to Declare Items Surplus Property and to Remove from
City of Cherokee Village Property Asset List ( 2004 Dodge Durango) Vehicle are no longer
useable for departmental purposes. Items classified as scrap property, to be sold as is by
competitive bid, funds deposited in P &Z General Account. Motion was made by Council Member
Covington, second by Council Member Adams to approve Resolution No 2020 - 11. Roll call vote
passed unanimously.
3. Proposed Ordinance 2020 -xx: An Ordinance to Establish Controls Related to Short- Term
Residential Rentals in the City of Cherokee Village, Arkansas ( First Reading) After much
discussion, motion made by Council Member Covington, second by Council Member Adams to
postpone until September 2020 council meeting. Roll call vote passed unanimously.
COMMENTS:
1. Chief Crook stated the 2004 Dodge Durango has been rebuilt completely two ( 2) times. The city
has certainly gotten every dollar out of the vehicle two ( 2) times.
2. Peter Martin doesn' t know what is in the contract the city has with the trash company to know
what he must do to fulfill his obligation. Contract is with the city, not the individual resident.
3. Bill Matselboba asked what the city staff and city council members are getting as a result of the
passage of the trash ordinance ( contract with the trash company). Les Covington stated the $ 60
a quarter the garbage company is picking up the trash. Mayor stated that is true for all of us.
4. Karen Page asked if tiny houses may be a possibility in the Santa Fe Addition.
