MINUTES CITY OF CHEROKEE VILLAGE, ARKANSAS REGULAR CITY COUNCIL MEETING 6: 30 P. M., THURSDAY, SEPTEMBER 17, 2020 CHEROKEE VILLAGE CITY HALL Meetings are video recorded) Mayor Stokes called the regular meeting of the City Council to order at 6: 30 p. m. on Thursday, September 17, 2020. Mayor led the Pledge of Allegiance followed by a moment of prayer. Roll was called by Clerk Deb Weichinger. Present were Jerry Adams, Les Covington, Chuck Kristopeit, Thomas Rupard, Rob Smith, Steve Thompson, Mayor Stokes and City Attorney Jon Abele. Present via Zoom: Pamela Rowland. Absent: Carr Hill. APPROVAL OF THE AGENDA: Council Member Kristopeit requested adding a report on the meeting regarding Santa Fe Addition. Addition will be at the end of the other reports. Council Member Smith moved to approve the amended council agenda, second by Council Member Covington and passed unanimously. PUBLIC COMMENTS ON AGENDA ITEMS: ( limit 3 minutes per person) APPROVAL OF THE MINUTES ( August 20, 2020): Council Member Smith moved to approve the council minutes, second by Council Member Adams and passed unanimously. CORRESPONDENCE: None FINANCIAL REPORT: Mayor reported our September revenue is solid. The S. I. D. monies received is the highest seen in his time as Mayor. Council Member Covington moved to approve the August 2020 financials to be filed for audit, second by Council Member Kristopeit. Roll call vote passed unanimously. MAYOR' S REPORT: Mayor reported monitors will soon be installed in the courtroom for public to view reports in council packet at a cost of $ 1700. The clinic that has been doing the drive through testing for COVID 19 will also be doing flu shots. DEPARTMENT REPORTS: ANIMAL CONTROL: ( report on file) Spray / Neuter clinic scheduled September 28 — October 1st COMMUNITY SERVICE: ( report on file) Limited inmates due to COVID for community service. DISTRICT COURT: ( report on file) FIRE: ( report on file) P & Z / CODE ENFORCEMENT: ( report on file) Attorney Jon Abele stated request to approve resolution to authorize collection of costs on Lot 2, Block 24, Chickasaw 4th Addition ( 75 Algonquin Circle) be removed due to property being certified to the state. Notice of hearing: Attorney Jon Abele asked council to approve resolution to collect for raze and removal of Lot 1, Block 24, Chickasaw 4th Addition along with fines and fees. Mayor asked for a motion to approve resolution. Council Member Smith moved to adopt resolution to collect costs for raze and removal, seconded by Covington. Roll call vote passed unanimously. Resolution to Authorize the Collection of Costs for the Razing and Removal of a Nuisance on the Property Lot 1, Block 24, Chickasaw 4th Addition 73 Algonquin Circle) to Cherokee Village Subdivision, Sharp County, Arkansas ( Glenn and Betty Siefker, owners). This will be Resolution 2020 - 12. POLICE: ( report on file) City of Cherokee Village, Regular City Council Minutes of September 17, 2020 STREET DEPARTMENT: ( report on file) Mayor announced all Street Department employees are in quarantine. An employee' s spouse was exposed to COVID. All employees will return to work September 21, unless someone else tests positive. Council Member Kristopeit reported Council Member Carr Hill, who lives in the Santa Fe Addition, is establishing a neighborhood watch program and Council Member Pamela Rowland offered to help fundraising for playground equipment. Council Member Jerry Adams announced Village Pride and King- Rhodes will be doing the roadside cleanup on Saturday, October 3`d from 9 AM to noon. OLD BUSINESS: 1. Proposed Ordinance 2020 -xx: An Ordinance to Establish Controls Related to Short- Term Residential Rentals in the City of Cherokee Village, Arkansas; Imposing a Penalty for the Violation of this Ordinance; and for Other Purposes: Clerk read the motion in its entirety. After noting grammatical errors to be corrected, motion was made by Council Rob Smith, second by Council Member Les Covington to approve the first reading. Roll call vote passed unanimously. NEW BUSINESS: 1. Proposed ORDINANCE 2020 -03: An Ordinance Defining and Limiting Conditions for Open Burning Within the City Limits of the City of Cherokee Village, Arkansas; Providing for Enforcement; Declaring an Emergency to Exist; and for Other Purposes: Clerk read the motion in its entirety. After some discussion, grammatical errors were noted to be corrected and to add the verbiage in # 5 of #2 onto # 1 ( Notification must be given to the city fire department prior to the intended burning of yard waste). Council Member Les Covington made a motion, second by Council Member Jerry Smith to approve first reading of proposed ordinance with noted changes. Roll call vote passed unanimously. Council Member Rob Smith moved to suspend the rules and waive the requirement that an ordinance be read three times on three different days for our consideration of Ordinance # 2020 -03, and that the ordinance be brought up for final passage by this council without the necessity of reading the ordinance in its entirety; second by Council Member Steve Thompson. Roll call vote: Ayes: Adams, Covington, Kristopeit, Rowland, Smith, and Thompson. Nays: Rupard. Motion passed. Motion by Council Member Smith, second by Council Member Covington to adopt as amended. Roll call vote: Ayes: Adams, Covington, Kristopeit, Rowland, Smith and Thompson. Nays: Rupard. Motion passed. Motion by Council Member Thompson, second by Council Member Adams to implement the emergency clause of Ordinance # 2020 -03. Roll call vote: Ayes: Adams, Covington, Kristopeit Rowland, Smith, and Thompson. Nays: Rupard. Motion passed. Ordinance # 2020 -03 will take effect immediately. 1. Resolution No 2020 -13: A Resolution to Annually Certify the City of Cherokee Village Property Tax: Resolution to Annually Certify the City of Cherokee Village Property Tax was read in its entirety by the Clerk. Motion was made by Council Member Smith, second by Council Member Kristopeit to approve A Resolution to Annually Certify the City of Cherokee Village Property Tax. Roll call vote passed unanimously to pass Resolution 2020 -13. City of Cherokee Village, Regular City Council Minutes of September 17, 2020  2. Street Department —Staffing Request: The street department is requesting council approval to hire full time, with benefits, Darryl Knuckles. Mr. Knuckles has 12 years experience with heavy equipment. Motion was made by Council Member Smith, second by Council Member Covington to approve. Roll call vote passed unanimously. 3. Short Term Special Use Permit 2020 -02 + 2020 -03: Highland Elks Lodge No. 2539, Turkey Shoot, October 3, 2020 + November 7, 2020 at 15 Elks Lodge, Cherokee Village, AR. Motion to approve both Turkey Shoot temporary special use permits made by Covington and second by Thompson. Motion passed unanimously. 4. Short Term Special Use Permit 2020 -04: Cherokee Village Lions Club, Annual White Can Days, October 1, 2020, 7: 00 AM to 9 AM at corner of Iroquois and Okmulgee.
