Zygarowski Shane Brooks MINUTES August 31, 2015 The following are the minutes of a public hearing held Monday, August 31, 2015 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Roy, Laflamme, Zygarowski, Krampits, Brooks Also Present Dan Garvey (Associate City Solicitor), Captain Mark Galarneau (Fire Prevention), Councilor McLellan, Steve Fredericks (City Engineer), Jeff Neece (Superintendent DPW), Bob Liswell (IT Project Manager), Michelle Santerre (GIS Coordinator Planning Department) Lee Pouliot (Director Planning Department) The meeting was called to order at 6:30 PM. In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. ITEM #1 Application for a Transient Venders License to sell various items at Downtown Chicopee:Center, Exchange, Springfield, and Front Streets for the Chicopee Downtown Block Party event to take place Saturday, September 12, 2015 from 12:00 PM – 11:00 PM. Final list of vendors to be provided License Committee at August meeting. Applicant Lee Pouliot 274 Front Street Chicopee, MA 01013 Lee Pouliot submitted an updated map and vendor list. Lee Pouliot stated that the perimeter is set for access points around the area and will be gated. Councilor Roy asked what is the financial arrangement with the vendors. 1 Lee Pouliot answered that there is no fee per vendor for this event, it wasn’t appropriate for the grant that’s funding the bulk of this event. The goal was to attract as many vendors as we could this time around. Councilor Laflamme asked why there was no report from the Police Department. Lee Pouliot stated we’ve had two Public Safety meetings with the Police and Fire Departments and the Chief was comfortable with what we were proposing and what he needed to provide for the event. Councilor Laflamme stated for the record; the Police & Fire Departments are all involved. Lee Pouliot stated yes Bob Liswell stated that at the Public Safety meeting the Chief of Police stated he was in favor of this. Councilor Zygarowski asked if the Police will be monitoring the beer tent. Bob Liswell stated yes. There will be four detailed Police Officers at this event. The drinking will only be allowed within the perimeter. There might be thirty five hundred attendants in a day. Everyone that made the Public Safety meeting has been very helpful and we’re up to date with the Fire Prevention. Fire Department 1. Applicant and all vendors will be required to read, understand, and abide by all applicable codes and regulations including but not limited to 527 CMR 1.00 Massachusetts Comprehensive Fire Safety Code, 780 CMR, Massachusetts State Building Code; MGL Chapter 148, Fire Prevention. 2. Access for emergency vehicles will be maintained at all times. 3. All permits and licenses shall be acquired prior to the start of the event. 4. All tents will meet applicable codes and have fire resistance rating tag attached. 5. All required inspections shall be scheduled as required to maintain compliance with applicable permits, licenses, codes and regulations. 6. Fire detail may be required at the discretion of the Fire Chief. Planning Department No concerns Engineering Department None concerns Councilor Zygarowski motioned to approve – Councilor Roy 2nd the motion Committee vote 5 – 0 favorable ITEM #2 Application for an amendment to Service Station License at 363 Burnett Road for issuance of an open-air parking, replacement of diesel canopy and pumps, and reconfigure two driveways for Pride Convenience, Inc. , 363 Burnett Road. Applicant Robert Bolduc 246 Cottage Street Springfield, MA 01104 Mr. Bolduc was present at the meeting. Councilor Roy asked how many of these trucks after fueling are able to be stacked before they exit. 2 Mr. Bolduc answered we can stack four trucks after they fuel. Jeff Neece asked if the scale was used primarily for the drivers who check their load weights and not for any regulatory use. Mr. Bolduc answered that’s correct. Councilor Brooks asked how will the truck driver understand and know what stacking path is feasible for him to take, how will it be marked off. Mr. Bolduc stated that there will be arrows and we will put signs up also. Councilor Roy stated there’s a three choice option here instead of all being inclusive as we get into different issues with this service station. Steve Frederick stated that some of the trucks cannot make option one viable at all so they need to do some other type of maneuvering option. My interest on the data was on the egress side because he is fueling about fifty percent quicker with these new pumps. Most trucks should be able to get out. Councilor Krampits stated if you have multiple options to choose from I think it will just confuse people. Councilor Laflamme stated he would like to pass option three set with signage. Mark Galarneau agreed that option three will work. Truck drivers will govern their own way as time goes on. I don’t see a big issue. Mr. Bolduc stated that exiting has never been a problem because we have one truck exiting every two minutes and it takes five minutes to break through the traffic. Councilor Roy stated that this is something we maybe have to modify in the future but until we implement it now we won’t know the status. Councilor Zygarowski asked if the Fire Department, Engineering Department and DPW were in agreement with option three and all Departments were in agreement. Additional Restrictions  6 foot tall white vinyl fence from A to B on map (near Burnett Road) as shown on map  Asphalt to be sloped to prevent water flow into neighbor’s yard in same area  No truck trailers left without tractors attached (in parking area)  Clear signage for entrances and exits  Fire, DPW and State and Federal regulations apply  Must meet engineering regulation for drainage and water flow  Post idle signs at parking entrances  Must meet planning department requirements  “Addendum to 363 Burnett Road site plan for Pride” option 3 to be implemented with signage. Plan is signed by Chairman  Loop through scale turnaround area  Onsite parking to be monitored 24 hours per day  Approved plan is signed and dated 8/31/15  Plan dated 5/22/15 revision 2  Screening of residential use property between C and D as marked on plan to be compliant with ordinance. Councilor Laflamme motion to approve with all restrictions – Councilor Roy 2nd the motion - motion passed Committee vote 5 – 0 favorable ITEM #3 Minutes – July 6, 2015. Motion made to approve.
