City of Chicopee City Council License Committee Approved 12-19-2016 Members William Zaskey, Chair Fred Krampits, Vice Chair Frank Laflamme Shane Brooks Stan Walczak MINUTES November 28, 2016 The following are the minutes of a public hearing held Monday, November 28, 2016 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Zaskey, Krampits, Brooks, Laflamme, Walczak Also Present Dan Garvey (Associate City Solicitor), Carl Dietz (Building Commissioner) The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 Application for a Service Station License for NEC OPCO I, Inc., located at 2012 Memorial Drive. Applicant NEC OPCO I, Inc. 2012 Memorial Drive Chicopee, MA 01020 Janice Lee, District Manager, 15 Casmir Street, Westfield, MA was present at the meeting. This is the former F.L. Roberts station. Councilor Walczak stated that he has observed some safety issues at this station (road rage and passing on the right near the pumps closest to the convenience store). Ms. Lee replied that she will bring these concerns to the attention of the applicant. No. of pumps 8 No. of storage tanks 3 Type of fuel stored gasoline Capacity of storage tanks 3 – 10,000 gallon tanks Hours of Operation M-F 8 AM – 11 PM, Saturday & Sunday 6 AM – 11 PM Self Service Yes Heating System Used natural gas Hours attendant is on premise All hours of operation 1 Auxiliary service or sales to be provided Convenience Store Motion made by Councilor Laflamme and second by Councilor Krampits to approve with restrictions. Committee vote 5 – 0 favorable. ITEM #2 Application for a transfer of a Junk Dealers License from 48 White Birch Plaza to 874 Front Street for Moving/Odd Jobs Unlimited. Applicant Glenn Joslyn 129 Taylor Street Chicopee, MA 01020 Glenn Joslyn was present at the meeting. Planning Department has stated that the property is zoned Business A. Business A zones do not permit the storage of “motor freight vehicles” A review of the applicant’s website indicated box trucks, bobcats, and mowing trucks are utilized by the business. This is not allowed under Business A. The committee informed Mr. Joslyn that if he intends to store contract service vehicles on this property a zone change would be required. Mr. Joslyn stated that he will move the contract service trucks from the property and he will contact the property owner to apply for a zone change. Restrictions Hours of Operation M- Saturday 7 AM – 7 PM, Closed Sunday No outside storage Clean housekeeping Motion made by Councilor Brooks and second by Councilor Laflamme to approve with restrictions. Committee vote 5 – 0 favorable. ITEM #3 Application for a transfer of location on a Class II License from 658 Fuller Road to 576 East Street for Royal Coach Sales, LLC. Applicant John Garcia 23 Austin Street Ludlow, MA 01056 John Garcia was present at the meeting. He stated that he has purchased the property on East Street. It was a former cleaning business. He would like to sell used cars from this property. The committee reviewed the plan submitted. Restrictions Good housekeeping No outside storage 2 No junk cars No outside repairs License holder must secure a Certificate of Occupancy prior to exercising the rights granted under this license. Total number of vehicles 13 (10 for sale) 7 inside, 6 outside 1 handicap space Hours of Operation M-Saturday 9 AM – 6 PM Closed Sunday Repairs – Furches Performance, 430 Center Street, Ludlow, MA. Motion made by Councilor Krampits and second by Councilor Laflamme to approve with restrictions. Committee vote 5 – 0 favorable. ITEM #4 Application for an Auto Repair License for Murray Automotive, LLC located at 102 Old Fuller Road. Applicant Michael Murray 636 Fuller Road Ludlow, MA 01056 Mr. Murray and Richard Bourbeau, property owner, were present. Chairman Zaskey stated that the agreement between Mr. Bourbeau and the City has been signed allowing the use of city property for the shed and sign. Restrictions Good housekeeping No outside storage No junk cars No outside repairs License holder must secure a Certificate of Occupany prior to exercising the rights granted under this license. Total number of vehicles 17 (4 inside, 13 outside, 1 handicap space) Hours of Operation M-F 8 AM – 6 PM Motion made by Councilor Laflamme and second by Councilor Zaskey to approve with restrictions. Committee vote 5 – 0 favorable. ITEM #5 Minutes – September 26, 2016 Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Motion passed. Meeting adjourned at 7:14 PM. 3
