August 28, 2017
The following are the minutes of a public hearing held Monday, August 28, 2017 at 6:30 PM in the City
Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013.

The meeting was called to order at 6:30 PM
In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording
the meeting. Hearing none the meeting continued.
ITEM #1
Application for a Fuel Storage License located at 84 New Lombard Road for 20,000 gallons of
aboveground diesel fuel.

Applicant was not present.
Dan O’Connor (Manager of Estes Express Lines), David Ondick (Regional Safety Manager,
Estes Express Lines), Mark Smith (Engineer, Estes Express Lines) were present.
Mark Smith stated that this is a big property. They are going to put the twenty thousand gallon
above ground tank on one of these existing concrete mats and new peers underneath the saddles.
We are twenty five feet away from the lot line so we are well away in the back of the property.
It’s a double wall fire rated tank set up with two dispensers. I make sure it all meets NFPA 30
and 30A, it complies with all the fire regulations.

Councilor Laflamme stated that it’s a lot cheaper this way down the road verses the
underground with all the UST testing.
Councilor Krampits asked if this is a new tank.
Mark Smith replied yes it’s a new tank.
Mark Smith stated that we are moving from Springfield and we had to put in a fueling system,
it’s brand new.
Councilor Walczak asked how many trucks will be filled per day at this site.
Mark Smith replied twenty five or thirty per day.
Public Input
Juliette Noonan, 19 Blanan Drive stated that their sound wall is on our property. As a
homeowner I’m concerned about having that amount of hazardous material stored just behind
my house.
Mark Smith stated that the tank itself has its own structure with steel Ballard’s. It’s a tank
within a tank.
Dan O’Connor stated that our safety department does a monthly inspection.
Mark Smith stated that we monitor every ounce of that fuel and if there’s any variance of
anything missing, we are going to do an investigation.
Dan O’Connor stated that the tank is above and beyond as far as fire protection goes. It’s called
a fire tank and they are fire tested.
Councilor Laflamme stated that Juliette Noonan can also call the Fire Department with her
concerns. The Fire Chief will be glad to talk to you if you’re still not comfortable.
Councilor Walczak asked if the truck drivers that will be dispensing the fuel are trained in
proper use.
Mark Smith answered yes.
Department Recommendations
Health Department
No concern at this time.
Planning Department
Property is zoned industrial; use is permitted
Project has already been approved by Planning Board and received a Special Permit from City
Council.
Engineering Department
Project has gone through site plan review process.
Review process.
No engineering comments.
Fire Department
1. The business shall comply with 527 CMR 1.00 (Massachusetts Comprehensive Fire
Safety Code) Section 10, General Safety Requirements; Chapter 30, Motor Fuel

Dispensing facilities and repair garages; Section 42.7.4, Self-service refueling: Section
13.6, Portable Fire Extinguishers; Chapter 60, Flammable and Combustible Liquids
(Only Approved Flammable Storage Cabinets)
2. Bollard protection shall be 4’ on center.
3. Applicant will be required to obtain all necessary permits. (527 CMR 1.00, Chapter 1.12)
4. The storage, handling and mixing of flammable and combustible liquids shall meet the
requirements of NFPA 30, Flammable and Combustible Liquids Code.
5. Applicant shall adhere to applicable sections of NFPA 30A (Code for Motor fuel
Dispensing facilities and Repair Garage).
6. Maintain access for emergency vehicles at all times.
7. Appropriate fire extinguishers are required. The number of extinguishers required will be
determined at a later dat. (527 CMR 1.00 section 13.6)
8. Proper address numbering as required in Code of the City of Chicopee.
9. License, Registration and Permits and Building/Fire inspections shall be completed prior
to opening for business.
Planning Department
Property is zoned IPUD-I; existing use on the property is allowed.
Property was recently sub-divided; please confirm that 84 New Lombard Road is the accurate
address for this parcel (parcel A per plans provided).
New above zoned storage tank meets side and rear yard setbacks.
Recommend approval.
Engineer Department
No comments
Councilor Laflamme motion to approve with restrictions – Councilor Zaskey 2nd the motion –
motion passed
Committee vote 4 – 0 favorable
