City of Chicopee City Council Zoning Committee Members Shane Brooks, Chair Timothy McLellan, Vice Chair APPROVED Fred Krampits Frank Laflamme Jerry Roy James Tillotson William Zaskey MINUTES August 31, 2017 The following are the minutes of a public hearing held Thursday, August 31, 2017 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Brooks, Krampits, Laflamme, Tillotson Members Absent: Roy, McLellan, Zaskey Also Present Dan Garvey (Asst. City Solicitor), Lee Pouliot (Planning Director) The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 Special Permit application under 275-30 (B) for the purpose containers located at 320 Granby Road Applicant – Kemm, LLC/ Aqua-Matic, Michael Sweeney 320 Granby Road Chicopee, MA 01013 Councilor Laflamme abstained from the meeting Councilor Brooks stated that this would be consistent with our Special Permitting process of storage containers. Applicant was present he stated that he purchased forty foot containers for the back of the building. They are used for storage and compressors that I use for winterizing and the other one I store snow blowers, pumps, pipes and fittings for irrigation. 1 Public Input Joe Pasternak, 75 Fisher Road stated that he concurs with the owner. What’s there right now is eye catching with the big red letters and the white background. I was going to suggest that this be part of the Special Permit that they be painted the same color as the building. Louis Redfern, 49 Carter Drive asked what is the proposed number of containers and will there be a limit on this special permit. Councilor Brooks stated that he is applying for two containers. If there are any subsequent containers he will need special permitting through the City Council. Michael Sweeney stated that there were already two containers there when he purchased the property. He stated got rid of one and kept one and purchased two more, so he is now applying for three containers. Louis Redfern asked what the timeline was for painting the trailers. Michael Sweeney answered before Thanksgiving. Building Department City Council may authorize by special permit the use of truck bodies or other equipment manufactures for use of hauling or carrying materials over the highways, for storage by non-profit or charitable institutions or for other such activities as the City Council deems appropriate. Planning Department Property is zoned Business A; use (storage trailers) is accessary to the primary use on the property. Use of shipping containers for storage, allowed via City Council discretion with a Special Permit (275- 30(B). All setbacks are met; a fence or vegetation screen is required where the property abuts residential use (see plan notes, attached) Engineering Department No engineering comments regarding trailers. Fire Department 1. Applicant will be required to read, understand, and abide by all applicable codes and regulations including but not limited to 527 CMR 1.00 Massachusetts Comprehensive Fire Safety Code, 780 CMR, Massachusetts State Building Code; MGL Chapter 148, Fire Prevention. 2. Proper address numbering as required by Code of City of Chicopee. 3. NO storage of hazardous materials without proper approval. 4. Dumpsters shall be kept at least 25’ from buildings. 5. Maintain access for emergency vehicles at all times. Conditions Three (3) Containers be painted to match current building paint. Painting will occur within (90) days or sooner. Planting will occur within the spring 2018 by April 30th. Councilor Krampits motion to approve with restrictions – Councilor Zaskey 2nd the motion – motion passed Committee vote 4 – 0 favorable Meeting adjourned at 6:45 PM. 2 3
