City of Chicopee City Council License Committee APPROVED 12-16-19 Members Stanley Walczak, Chair Fred Krampits, Vice Chair Shane Brooks Frank Laflamme Derek Dobosz MINUTES November 25, 2019 The following are the minutes of a public hearing held Monday, November 25, 2019 at 6:30 PM held at the RiverMills Senior Center, Classroom 30, 5 West Main Street, Chicopee, MA 01020. Members Present Walczak, Krampits, Brooks (arrived 6:31), Laflamme, Dobosz Also Present Attorney Daniel Garvey (Associate City Solicitor), Carl Dietz (Building Commissioner) The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 Application for a Class II License for EDW Auto, Inc., d/b/a Fairview Service Center located at 1492 Memorial Drive. Applicant – Evan D. Whiting, 1700 Westover Road, Chicopee, MA 01020 Evan Whiting was present at the meeting. He stated that he is purchasing the property from the current owner. Councilor Laflamme asked if the applicant owns the property. He replied that he does not yet. The environmental and Title 5 is not complete yet. In the next week or so the bank will be issuing a conditional commitment from the bank. Reports read from the following: Engineering – Parking spaces shall be a minimum of 8’ W and 18’ L, handicap parking?, handicap spaces shall be 8’ W x 18 L with a 5’ access is 6 stripped Planning & Conservation – Property is zoned Business A; auto repair and auto detailing permitted. 4 service bays require 8 parking spaces (detailed on plan with at least one handicap space required – closest to off door – none provided on plan an additional 4 employee spaces) Recommend review of parking layout approved for used car sales to ensure total spaces is adequate 1 Fire – No issues Health – FYI: New septic system going on waiting on plans. Did the percolation test on 10/28/19 (passed) Conditions Good housekeeping No outside storage No junk cars No outside repairs License holder must secure a Certificate of Occupancy prior to exercising the rights granted under this license Total number of vehicles 26 ( 4 inside, 22 outside, 3 employee, 9 customer, 1 handicap) Hours of operation M-F 8 – 5, Saturday 8 -1 Applicant to provide lease agreement or recorded deed prior to issuance of license Motion made by Councilor Laflamme and second by Councilor Walczak to approve with restrictions. Committee vote 5 – 0 favorable . ITEM #2 Application for an Auto Repair License for EDW Auto, Inc., d/b/a Fairview Service Center located at 1492 Memorial Drive. Applicant – Evan D. Committee vote 5 – 0 favorable. ITEM #4 ORDERED THAT Unique Motors, Inc.., 1021 Memorial Drive, be called before the City of Chicopee License Committee and City Council to discuss the license (s) currently held by Unique Motors, Inc., including compliance with restrictions imposed upon any licenses held by Unique Motors, Inc. The Council may modify, suspend, fine, or revoke any license held by Unique Motors, Inc. Violation – too many vehicles on property. Richard Kida and Christine Matt, Office Manager, were present at the meeting. Chairman Walczak stated the reason this business was called in was because the business had too many vehicles on the property for sale. According to the license the number of vehicles is 104. The Fire Department went to investigate and found 130 vehicles. Ms. Matt agreed that there were too many vehicles. Ms. Matt stated that currently the property has 91 vehicles on the property. Motion made by Councilor Laflamme and second by Councilor Walczak to place on file and the owner to comply. The Building Commissioner to review compliance with license requirements. Committee vote 5 – 0 favorable. ITEM #5 Application for a license to drive a cab for A & Z Transportation. Applicant Zaheer A Shaikh, 25 Lorraine Street, Chicopee, MA 01013 Mr. Shaikh was present at the meeting. He stated that he works for a transportation company in Connecticut. The applicant stated that he started working for A & Z transportation 5 months ago. Before he started he went to the Registry of Motor Vehicle and they told him that with the MA driver’s license he could drive the small cars. All of the sudden the company told him that he needs a TLC license to Massachusetts to provide you to drive a cab. He’s been out of work for a month. A & Z told him that if he gets this then he will get his job back. He drives people to medical appointments. There’s no meter in the vehicle. 3 Councilor Dobosz stated that the application has been approved by the Chief of Police. Motion made by Councilor Krampits and second by Councilor Walczak to approve. Committee vote 5 – 0 favorable. ITEM #6 Minutes – October 28, 2019 Motion made by Councilor Laflamme and second by Councilor Krampits to approve. Motion passed. Meeting adjourned at 7:15 PM. 4
