No person, partnership or corporation shall operate a commercial animal establishment or animal shelter without first obtaining a permit in compliance with this chapter. F. Annual permits shall be issued upon payment of the applicable fee after inspection by the proper authority: (1) For each kennel authorized to house four dogs or fewer: $50. (2) For each kennel authorized to house 10 dogs or fewer: $75. (3) For each kennel authorized to house more than 10 dogs: $100. (4) For each zoological park: $100. (5) For each circus: $125. (6) For each performing animal exhibition: $50. (7) For each grooming shop: $50. And insert in place thereof 144-2 Permit required for commercial animal establishments and animal shelters. A. JUNK VEHICLE – Any motor vehicle which satisfies one or more of the following criteria: (a) That is partially dismantled or wrecked; (b) That is not operable; (c) That could not be safely or legally operated on a highway; (d) That has become a habitat for rodents, vermin and insects; (e) That in any other way constitutes a threat to public health, safety and welfare; or (f) That has not been moved for a continuous period of more than 45 days. ITEM #4 BE IT ORDAINED THAT THE CHICOPEE CITY COUNCIL DOES HEREBY AMEND CHAPTER 260, SECTION 29 – “SEVERE WEATHER PARKING REGULATIONS” AS FOLLOWS: ADD: CHAPTER 260, SECTION 1: DEFINITIONS REVERSE PARKING BAN – PARKING SHALL BE ALLOWED ON THE OPPOSITE SIDE OF THE STREET AS DEFINED BY SECTION 29(B). SNOW REMOVAL SEASON: OCTOBER 1 – MAY 30 DELETE: CHAPTER 260, SECTION 29 (B) Severe weather parking regulations shall be in effect only when announced by the Mayor, at the request of the Superintendent of Streets. While in effect, parking shall be allowed only on the even side of the street in even-numbered years and only on the odd side of the street in odd- numbered years, 24 hours a day. This section is applicable to all streets except those listed in § 260-69. B ADD: CHAPTER 260, SECTION 29 (B) Severe weather parking regulations shall be in effect only when announced by the Mayor, at the request of the Superintendent of Streets. While in effect, parking shall be allowed only on the even side of the street in even numbered years for the entire snow removal season (October 1 through May 31) and only on the odd side of the street in odd numbered years for the entire snow removal season (October 1 through May 31), 24 hours a day. This section is applicable to all streets except those listed in § 260-69 (B) ADD: CHAPTER 260, SECTION 29 (F): REVERSE PARKING BAN Whenever possible, "Reverse Plowing" will occur the next day beginning as soon as possible upon conclusion of the initial storm cleanup at the discretion of the Superintendent of the Department of Public Works. Prior to authorizing Reverse Plowing, the Superintendent of the Department of Public Works shall declare a Reverse Parking Ban and shall advertise this parking ban in the same manner as is the case with other Severe Weather Parking Regulations. ITEM #5 Add to Chapter 169-13 H. Trash/Recycling/Yard Waste containers/totes must be removed from the street/ tree belt by midnight the day after scheduled pick up. ITEM #6 Chapter 169-40 Maintenance; violations and penalties; enforcement Delete 169-40 F And insert in place thereof F. Enforceable by the Chicopee Police Department, Chicopee Building Department, Chicopee Health Department or the Superintendent of Public Works or any of their designee(s). Any person or entity who fails to comply with any portion of this article shall be fined $25 per day. A person or entity commits a separate offense for each and every day a violation continues. ITEM #7 Add Chapter 279 CHAPTER 279 MENSTRUAL HYGIENE PRODUCTS ACCESS ORDINANCE SECTION 1: PURPOSE To improve gender equity in public toilet facilities by providing free menstrual hygiene products in restrooms serving the general public in its public buildings SECTION 2: DEFINITIONS "Menstrual hygiene products" means tampons and sanitary napkins for use in connection with the menstrual cycle. “Restrooms serving the general public” mean restrooms established for use by members of the public (as differentiated from staff restroom facilities). “Public Building” for the purposes of this ordinance means any facility owned or leased by the City of Chicopee that contains restrooms for the general public and over which the City of Chicopee has care, maintenance, custody, and/or control. This shall include, but not be limited to: Public Libraries, City Hall, the Public Safety Buildings, Recreational Facilities and Parks. “Female-bodied” means any individual who experiences a menstrual cycle. SECTION 3 ACCESS TO MENSTRUAL HYGIENE PRODUCTS The City of Chicopee shall make available and accessible at no charge menstrual hygiene products (tampons and pads/napkins) in its public building restrooms that serve female-bodied members of the public. SECTION 4 MANNER OF DISPENSING Machine dispensers for menstrual hygiene products provided under this ordinance shall be chosen in consultation with the Building Department and Department of Public Health, but must comply with ADA and other equity-of-access laws and considerations. Menstrual hygiene products made available at no charge from an employee, office, or other site in a public building upon in-person request does not constitute compliance with this ordinance. SECTION 5 GREEN PRODUCTS Tampons with plastic applicators may not be provided under this ordinance. SECTION 6 EFFECTIVE DATE This ordinance shall take effect July 1, 2021. It will become effective for the Public Schools of Chicopee upon adoption by the Chicopee School Committee or act on anything relative thereto.
