City of Chicopee City Council License Committee Approved 5-24-2021 Members Stanley Walczak, Chair Fred Krampits, Vice Chair George Balakier Frank Laflamme Derek Dobosz MINUTES April 26, 2021 The following are the minutes of a public hearing held Monday, April 26, 2021 at 6:30 PM held in the Council Chambers, 4th floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013 and via teleconference. Members Present Walczak, Krampits, Balakier, Laflamme, Dobosz Also Present Attorney Daniel Garvey, Carl Dietz (Building Commissioner) The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 BE IT ORDERED THAT Daniel’s Truck Center, 18 Montcalm Street, be called before the City of Chicopee License Committee and City Council to discuss the license (s) currently held by Daniel’s Truck Center including compliance with restrictions imposed upon any licenses held by Daniel’s Truck Center. The Council may modify, suspend, fine, or revoke any license held by Daniel’s Truck Center. Violation – Too many vehicles on the lot. Daniel Laflamme was present at the meeting. Councilor Walczak stated that there is a concern over the number of vehicles stored on the property. According to the license and plot plan the business is not operating as licensed. Mr. Laflamme stated that some of the extra vehicles are due to unintentional gathering. Sometimes trucks are taken apart and parts are used on other trucks. There are about 10 vehicles that have been marked to be moved. He also stated that he currently only has one employee. It’s been very difficult to get help. He also stated that there are no repairs being done at this site. He has a repair shop in Holyoke. He also stated that the plot plan needs to be updated. The existing plan still has a house on the property and it no longer exists on the site. 1 Councilor Walczak read the restrictions on the licenses. Class II - Good housekeeping, no outside storage, no of vehicles 21 outside, 2 inside, hours of operation M-F 8- 5, Saturday 9-3, no Sunday, no cars beyond entrance by house. Auto Repair – Good housekeeping, no outside storage, 2 vehicles inside, customer vehicles, 2 outside, minor repairs, no outside repairs, abide by F.D. regs, hours of operation M-F 8-5, Saturday 9-3, Sunday none. Councilor Laflamme stated he is not related to the license holder. He continued that he is pleased that the license holder wants to modify the site plan for the business. The current plot plan on file is when the business started and since than it has changed and should be updated. Carl Dietz stated that when he visited the property there were about 35 vehicles. Councilor Balakier asked when the license holder could get the plan redrawn. Mr. Laflamme stated that it’s very difficult right now to get a licensed professional. There is a huge backlog. Motion made by Councilor Laflamme and second by Councilor Walczak to postpone to the call of the chair. License holder must give an update on a surveyor and new plot plan for the property. Committee vote 5 – 0 favorable. ITEM #2 Application for an Auto Repair license for Metrolube Enterprises, Inc., d/b/a Valvoline Instant Oil Change located at 725 Memorial Drive. Applicant Robert Ladas 1 Nipmuc Lane Southborough, MA 01772 Mr. Ladas was present via teleconference. He stated that his address has changed and it is now 929 Boston Post Road, Marlborough, MA 01752. He continued that this license is for the new facility on Memorial Drive. It is will for automotive quick lube and it will be a drive thru. No repairs on site. It will take approximately 10 minutes for each vehicle. The driver does not get out of the vehicle. The applicant stated that there will be approximately 8-10 employees. It depends on the day. Vehicles will not be kept overnight on the property. CONDITIONS Good housekeeping No outside storage No junk cars No outside repairs License holder must secure a Certificate of Occupancy prior to exercising the rights granted under this license Total number of vehicles 4 inside 6 outside 1 handicap spot Hours of Operation M-F 8-7, Saturday 8 – 6, Sunday 9-5. 2 Motion made by Councilor Laflamme and second by Councilor Walczak to approve with restrictions. Committee vote 5 – 0 favorable ITEM #3 Minutes – March 29, 2021 Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Motion passed. Meeting adjourned at 7:03 PM. 3
