City of Chicopee City Council Ordinance Committee Approved 6-29-2021 Members James Tillotson, Chair Fred Krampits, Vice Chair Frank Laflamme Gary Labrie Jerry Roy MINUTES April 27, 2021 The following are the minutes of a public hearing held Tuesday, April 27, 2021 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson, Krampits, Laflamme, Labrie, Roy Also Present: Dan Garvey (Associate City Solicitor), Councilor Zygarowski, Councilor Courchesne (via teleconference), Elizabette Batista (DPW Superintendent), John Beaulieu (Assistant to the DPW Superintendent) Lt. Holly Davis (Police Department), Douglas Ellis (City Engineer) The meeting was called to order at 6:30 PM In compliance with the open meeting laws the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 BE IT ORDAINED the Director of Public Works submit a report to the Mayor and City Council by December 31 each year for the revenue generated by each clothing receptacle located on City property. Elizabette Batista provided a report of revenue generated by the textile boxes owned by the City. (Report is attached) Elizabette stated that all the textiles that would normally go into the black barrel is saved from the black barrel and the City can make some money. Elizabette suggested that it may be better if the report was provided at the end of the fiscal year instead of at the end of the calendar year. Councilor Laflamme stated he thinks it’s a good idea to receive the report twice per year (June 1st and November 1st). 1 Committee recommends as follows: BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended, be and is hereby further amended as follows: Add to Chapter 169-40 E. The Director of Public Works shall submit a report to the Mayor and City Council on June 1st and November 1st of each year detailing the revenue generated by each clothing receptacle located on City property. Motion made by Councilor Laflamme and second by Councilor Tillotson to approve as amended. Committee vote 5 – 0 favorable. ITEM #2 Chapter 200-3 B Enumeration of prohibited noises. Add The excessive or otherwise unnecessary revving of motorcycle, automobile or other such motorized vehicle or equipment. To Read B. Noisy vehicles. The use of an automobile, motorcycle or other vehicle so out of repair or so loaded in such a manner so as to create repeated or continuous loud, unnecessary grating, grinding, rattling or other noise. The excessive or otherwise unnecessary revving of motorcycle, automobile or other such motorized vehicle or equipment. Lt. Davis stated that there are a lot of after-market parts that can be installed on vehicles and they create a lot of noise. Motion made by Councilor Laflamme and second by Councilor Tillotson to approve. Committee vote 5 – 0 favorable. ITEM #3 Chapter 200-3 E Enumeration of prohibited noises. Add Nursing home after “hospital” To Read E. Noise near schools and other institutions. The creation of any excessive noise on any street adjacent to any school, installation of learning, church or court while the same is in session, or adjacent to any hospital, nursing home which unreasonably interferes with the workings of such institutions, provided that conspicuous signs are displayed in such streets indicating that the same is a school, hospital, church or court house. Excessive noise, for the purposes of this section, shall be repeated and/or continuous noise that can reasonably be construed to impair or hamper the activities involved in any of the above stated entities. Committee recommends amending to read: 2 E. Noise near schools and other institutions. ITEM #4 Chapter 260-16 A Delete 300 feet And insert in place thereof 500 feet To read: A. All territory within 500 feet of the premises of each hospital, each nursing home or any medical health care facility where overnight stays are required by competent medical personnel, in the City of Chicopee, is hereby declared, by the amendment of this ordinance, to be a zone of quiet. Motion made by Councilor Laflamme and second by Councilor Tillotson to approve. Committee vote 5 – 0 favorable. ITEM #5 Chapter 260-16 C Establishment; sounding of warning devices. Add or rev excessively after “at very high speeds” To read: B. No person operating any type of motor vehicle within any designated zone of quiet shall sound the horn or use other warning devices, cause the motor to run at very high speeds or rev excessively so as to cause loud noises or to cause his or her vehicles to spin the wheels at a high speed (burn rubber). The only exceptions are emergency vehicles. Motion made by Councilor Laflamme and second by Councilor Tillotson to approve. Committee vote 5 – 0 favorable. ITEM #6 CHICOPEE STREET - In front of 453 Chicopee Street from the corner of State Street for 21 feet in the southern direction on Chicopee Street - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Krampits to approve. Committee vote 5 – 0 favorable. 3 ITEM #7 CHICOPEE STREET - In front of 460 Chicopee Street from the corner of Bonner Street for 21 feet in the southern direction on Chicopee Street - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Roy to approve. Committee vote 5 – 0 favorable. ITEM #8 EMPIRE STREET - At 55 Empire Street in front of condo #19 from the corner of the shared driveway of 53/55 Empire Street for 21 feet in the western direction - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Roy to approve. Committee vote 5 – 0 favorable. ITEM #9 STATE STREET - Even side from the corner of Chicopee Street for 25’ in the easterly direction - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Roy to approve. Committee vote 5 – 0 favorable. ITEM #10 DELETE - 90 BONNER STREET - HANDICAP PARKING Motion made by Councilor Roy and second by Councilor Laflamme to approve. Committee vote 5 – 0 favorable. ITEM #11 DELETE - ARMANELLA STREET - West side - 37 feet from East Main Street- PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Roy to approve. Committee vote 5 – 0 favorable. ITEM #12 ARMANELLA STREET- West side - 135 feet from East Main Street - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Laflamme and second by Councilor Roy to approve. Committee vote 5 – 0 favorable. 4 ITEM #13 WOODLAWN STREET - East side – 75 feet from St. James Avenue - PARKING PROHIBITED HERE TO CORNER Councilor Krampits stated that he met with the City Engineer on site to review the parking on Woodlawn Street. After the review it was determined that this proposed ordinance be defeated. Motion made by Councilor Krampits and second Councilor Laflamme to approve. Committee vote 5 – 0 unfavorable. (PROPOSED ORDINANCE DEFEATED) ITEM #14 DELETE - WOODLAWN STREET - South Side – 25 ft from St. James Avenue - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Krampits and second by Councilor Laflamme to amend to read ADD WOODLAWN STREET South side – 35 feet from St. James Avenue PARKING PROHIBITED HERE TO CORNER Committee vote 5 – 0 favorable. ITEM #15 WOODLAWN STREET - West side – 75 feet from St. James Avenue - PARKING PROHIBITED HERE TO CORNER Councilor Krampits stated that at the recommendation of the City Engineer the distance should be increased to 150 feet. It should also be amended to read North side. Committee recommends as follows: WOODLAWN STREET North side – 150 feet from St. James Avenue PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Roy and second by Councilor Krampits to approve as amended. Committee vote 5 – 0 favorable. ITEM #16 DELETE - WOODLAWN STREET - North Side – 35 ft from St. James Avenue - PARKING PROHIBITED HERE TO CORNER Motion made by Councilor Krampits and second by Councilor Tillotson to approve the deletion. Committee vote 5 – 0 favorable. 5 ITEM #17 TAYLOR STREET - Heading east 25 feet from Sheridan Street - PARKING PROHIBITED Doug Ellis stated that there are no parking signs along the entire length of Taylor Street on the south side. There are no signs along the north side, except for a single no parking tow zone sign on the gate to Sheridan Street Mini Park, approximately 210’ from Sheridan Street. There is an existing ordinance for no parking any time on both sides of Taylor Street from Sheridan Street to a point 510 feet southeast of Sheridan Street. Taylor Street is approximately 1330’ long, so the signs past 510’ from Sheridan Street on the south side do not have an ordinance. Motion made by Councilor Laflamme and second by Councilor Tillotson to defeat. Committee vote 5 – 0 favorable to defeat. ITEM #18 COONEY PLACE - East side – entire length - PARKING PROHIBITED Motion made by Councilor Laflamme and second by Krampits to approve. Committee vote 5 – 0 favorable. ITEM #19 Minutes – April 13, 2021 Motion made by Councilor Laflamme and second by Councilor Tillotson to approve. Motion passed. Meeting adjourned at 7:36 PM. 6
