Zygarowski Frank Laflamme Timothy McLellan MINUTES September 8, 2014 The following are the minutes of a public hearing held Monday, September 8, 2014 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson, Labrie, Laflamme, Zygarowski, McLellan Also Present: Councilor Lamontagne, Councilor Moreau, Councilor Jerry Roy (At-Large), Tom Hamel, Project Supervisor The meeting was called to order at 5:45 PM. In compliance with the open meeting laws the Chairman asked if anyone in the audience was recording the meeting. Councilor Tillotson motion to take number six out of order – motion passed. ITEM #1 Parking Regulations – Center Street – from 694 Center Street northerly end in a southern direction not to exceed past the crosswalk at 628 Center Street – Parking prohibited anytime. Councilor Brooks stated the Lithographic Company is having problems with people from the methadone clinic; they are coming in for their methadone early in the morning and throwing trash all around, so he wants “No Loitering” and “No Standing” signs from Plainfield Street if you go northerly, to the end of his property. I spoke to the Chief about this and he can’t enforce anything until the signs have been placed there. The Director of the clinic has a security guard on duty and is trying to get more people to police the outside. Laflamme motion to approve – McClellan 2nd the motion – motion passed. Committee vote 5 – 0 favorable. 1 ITEM #2 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended, be and is hereby further amended as follows: By deleting Chapter 275-66 Burnett Road And insert in place thereof 275-66. Burnett Road. A. The purpose of this section is to regulate new development on Burnett Road and appurtenant streets due to the negative impact of increasing traffic and until such time as the City take measures to manage traffic in the area. (1) No further business, commercial or industrial development shall occur on Burnett Road and any appurtenant street for a period of one year commencing on April 6, 2014, and terminating on April 6, 2015, except by special permit. (2) In addition to the special permit submission requirements of Chicopee City Code Chapter 274-9, all special permit applications shall be accompanied by a traffic study. Councilor McLellan stated this is just to regulate new development and change the wording. Motion made by Councilor Laflamme and second by Councilor McLellan to table. Motion passed. Committee vote 5 – 0 favorable. ITEM #3 BE IT ORDAINED BY THE CITY COUNCIL THAT CHAPTER 7 OF THE CODE OF CITY OF CHICOPEE FOR THE YEAR 1991, AS AMENDED BY AND HEREBY IS FURTHER AMENDED AS FOLLOWS: SECTION 2: LIBRARY STRIKE OUT PART TIME PAGE $8.00 PER HOUR INSERT IN PLACE THEREOF: PART TIME PAGE $9.00 PER HOUR SAID ORDINANCE TO BE OPERATIVE JANUARY 1, 2015 IN ACCORDANCE WITH THE STATE MINIMUM WAGE INCREASE. Councilor Tillotson stated that they are adjusting the minimum wage for the part time page to comply with the minimum wage law. Zygarowski motion to approve – Tillotson 2nd the motion – Motion passed. Committee vote 4 – 0 favorable. Councilor Laflamme abstained ITEM #4 Handicap Parking – 89 Park Street Tillotson motion to remove from the table – Laflamme 2nd the motion – Motion passed. 2 Frank Czepiel stated this is the first time we’ve had a business ask for a handicap parking spot; because it’s a business there are certain laws he has to follow. The only accessible handicap spot he has is where he’s putting his patio. The other two doors in the front are not accessible and there is no sign to show where the handicap entrance is. One of the requirements is to mark on both entrances in the front where the accessible entrances are and remove the utility column. He has to comply with these before I would approve him getting that sign. Laflamme motion to table – Tillotson 2nd the motion Councilor Roy stated that he is trying to do whatever he can for the handicap parking. The utility column is not his fault and he has a handicap accessible side entrance. Councilor Zygarowski asked how many handicap spaces is he obligated to have. Frank Czepiel answered two handicap spaces but they are just State Code approved and one has to be for a van. Councilor Tillotson stated this has been on the table for a while and there’s no reason that this can’t move forward. Councilor Laflamme stated he’s already complying with two handicap signs and he wants to make it even more handicap accessible. Frank Czepiel stated if the Council is going to guarantee the signs I will approve it. Mclellan motion to remove from the table – Tillotson 2nd the motion – motion passed Councilor Tillotson stated we will take both of your recommendations that you two will get together and the sign will go up. Councilor Roy and Frank Czepiel agreed Laflamme motion to approve – Tillotson 2nd the motion – motion passed Committee vote 5 – 0 favorable. ITEM #5 Delete – Handicap Parking – Monroe Street Frank Czepiel stated the applicant is no longer there. Laflamme motion to approve the strike – Tillotson 2nd the motion – motion passed. Committee vote 5 – 0 favorable. ITEM #6 Handicap Parking – McKinstry Avenue Not applicable Private property No vote ITEM #7 Parking Regulations – Mellon Street – On west side (Dana Park) for a distance of 30 feet from Newbury Street – Parking Prohibited Here to Corner. Zygarowski motion to approve – Tillotson 2nd the motion – motion passed 3 Committee vote 5 – 0 favorable. ITEM #8 Stop Sign – Mathieu Drive – At the intersection of Woodcrest Drive – Isolated Stop sign Councilor Lamontagne stated there is no stop sign there and the family that requested it has children. Zygarowski motion to approve – Laflamme 2nd the motion – motion passed. Committee vote 5 – 0 favorable. ITEM #9 Stop sign – Woodcrest Court – At the intersection of Woodcrest Drive – Isolated Stop Sign Councilor Lamontagne stated same course. Mclellan motion to approve – Laflamme 2nd the motion – motion passed. Committee vote 5 – 0 favorable. ITEM #10 Parking Regulations – Pendleton Avenue – 25 feet from the edge of Greenwood Terrace on the northerly side of Pendleton Avenue – Parking Prohibited Here to corner. Laflamme motion to approve – McLellan 2nd the motion – motion passed. Committee vote 5 – 0 favorable. ITEM #11 Minutes – June 26, 2014 & June 10, 2014. Motion made to approve. Motion passed.
