Members Present: Tillotson, Laflamme (arrived 6:32 pm), Krampits, McLellan Note Present: Roy Also Present: Dan Garvey (Asst. City Solicitor), Councilor Brooks, Dean Desmarais (Fire Chief), Carl Dietz (Building Commissioner) Holly Davis (Lieutenant Police Department) The meeting was called to order at 6:30 PM. In compliance with the open meeting laws the Chairman asked if anyone in the audience was recording the meeting. Western Mass News was recording the meeting. ITEM #1 Chapter 186- Regulation of Unmanned Aircraft Systems (Drones) Dan Garvey stated essentially what our ordinance is attempting to do is put some kind of regulation on drones that weigh less than fifty five pounds and fly under four hundred feet. We did make an exception from the majority of these rules if you are properly licensed and using them for non-business or non- commercial purposes. If you are taking off or landing from private property; you either have to own it or have written permission to do so. The other issue is that we do not want them flying over city streets or city owned property. If you have a license and you’re commercial, you are excluded from the regulations. He also stated that the Westover Air Reserve Base has to be notified regardless if you’re; commercial, non-commercial or novice and you’re going to fly in the City of Chicopee within a five mile radius. Holly Davis stated that she is a novice; she’s registered and has never flown her drone over fifty feet. If you have this ordinance with the fines, how are we going to enforce this. This is a hot item for the kids and can be purchased for nineteen ninety nine in the store. Councilor Tillotson stated we need something in the ordinance that defines the toy drones. Dan Garvey stated that the commercial drone users that were at the last ordinance meeting were aware of notifying the Westover tower and they routinely do it. Councilor Laflamme stated we need clarification by Westover Air Reserve Base regarding all drone use. Councilor Laflamme stated that we need to postpone this until we get more information. He stated that he was going to speak with someone at Westover. Councilor Laflamme asked Holly Davis to also meet with the Colonel and get some information. Councilor Laflamme motion to postpone to the call of the chair – Councilor McLellan 2nd the motion – motion approved Councilor McLellan motion to take Item #2 out of order – Councilor Tillotson 2nd the motion – motion passed. ITEM #2 Delete from Chapter 34 Fire Department, Section 34-1 Composition, in its entirety: And insert in place thereof Fire Department, Section 34-1 Composition: The Fire Department of the City of Chicopee shall consist of 1 Fire Chief, 5 Deputy Chiefs to be designated first, second, third, fourth, and fifth Deputy Chiefs respectfully, 13 Captains, 23 Lieutenants, 105 Firefighters, 1 Administrative Assistant, 1 Principle Clerk, 1 Senior Clerk, 1 Fire Tech/Foreman. Councilor Tillotson stated that between retirements and resignations they will be able to keep close to their full component. Dean Desmarais stated that we struggle to maintain because by the time we go through the process with; civil service, academy classes and appointing, we’ve almost always lost that number through attrition. Dean Desmarais stated with the civil service process we have to go through CORI background checks. Once we’ve solidified that they have to go through physical exams and physical agility exams and they have three opportunities to pass those. The class is ten weeks and we will have more retirements by then. He stated that much like the Police Department proposed that is the same reason for this request. Fire Chief The regular, full-time Fire Chief and the regular, full-time Police Chief of the City of Chicopee shall receive an annual compensation which shall not be less than (2) times the highest annual rate of compensation of a regular, full time firefighter, or a regular, full time police officer or patrolman, as the case may be. In addition, parity shall be maintained relative to compensation rates paid to the Police Chief and the Fire Department Chief for the City of Chicopee. The highest annual rate of regular, full time firefighter, or a regular full time police officer or patrolman, is to be construed and interpreted as the “base rate” and shall not include any other additional forms of compensation and, if given this definition, the rates of the Fire Chief and the Police Chief would mathematically come out to different levels of compensation, then the lower rate shall be adjusted to the higher rate in order to maintain parity between the two Department Heads. Carl Dietz stated that the building fees are the same but we’ve added some categories to make it more user friendly. The real changes are in the electrical and plumbing fees with keeping in line with the other communities. Councilor Laflamme asked who determines the price of labor. He stated that if I do a job at my home and it’s me that does the work, why should you be charging my labor. Carl Dietz stated there is a minimum up to five thousand dollars if you’re renovating. I think we are just trying to come up with a reasonable value of the job. He stated lets at least cover the cost that the city has in terms of going out performing the inspection. Councilor Brooks stated that you end up being the catalyst for a larger mechanism for us to get additional revenue in the city. By people coming in and permitting their projects, that should be the tickler for our Assessors to look at revaluation down the road. I like the fact that we have minimal fees because then the homeowner can pull the permit properly so that when the reassessment period happens that triggers the additional revenue for the city. You are like the first line of defense getting people to be upfront about what they’re doing so we get actual values of people’s homes.
