CHICOPEE CITY COUNCIL ZONING COMMITTEE APPROVED ZONING COMMITTEE MEMBERS John Vieau, Chairman Donald Demers, Vice Chairman James Tillotson Dino Brunetti Frank Laflamme Gerry Roy Fred Krampits MINUTES June 25, 2013 The following are the minutes of a public hearing held Tuesday, June 25, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Vieau, Demers, Tillotson, Brunetti, Laflamme, Krampits, Roy Also Present Daniel Garvey (Associate City Solicitor), Kate Brown (Planning Director), Councilor Zygarowski The meeting was called to order at 6:30 PM by Chairman Vieau. ITEM #1 Application for a Special Permit under section 275-51.1 for the purpose of installing 20’Wx40’Lx14’H canopy in parking lot in front of main building. Approx. 69’ from Memorial Drive, 62’ from building, 88 ft. from Town Fair Tire located at 878 Memorial Drive. Applicant James Blair for U-Haul of Western MA & VT 499 Montgomery Street Chicopee, MA 01020 James Blair was present at the meeting. He stated that this is an open canopy no sides just a top for people to pull up and park their vehicles. The following recommendation were submitted: Planning Department This structure was placed on the site in violation of 275-51.1 after a conversation with the applicant regarding the requirement for a special permit. It meets the accessory structure setback requirements in Chicopee City Code Chapter 275-58 Business A so if approved it could remain in the location shown on the plan. I will leave it to the Building, Engineering, and Fire Departments to determine if it is acceptable. I generally do no support after-the-fact permitting and licensing. Fire Department 1 Applicant has been advised that “Registered Flame Resistant Product” certificate is expired. Updated certificate required. Committee informed the applicant that he must obtain all necessary approval from the Fire Department and present that to the Council prior to the July 2, 2013 Council meeting. Conditions: Permit to run with the applicant Satisfy the recommendations of the Chicopee Fire Department Motion made to approve with conditions. Committee vote 7 – 0 favorable. ITEM #2 Application for a Special Permit under section 275-50 A (1) (G) [1] for the purpose of placing a non-accessory 4x8 sign at an 8 foot height with waiver from 500’ residential zone setback located on Ludger Avenue Map 337 Parcel 84. Applicant Chicopee Properties, LLC Domer Ringuette 203 Grattan Street #42 Chicopee, MA 01013 Applicant was present. He stated that the home address on the application is incorrect. It should read 203 Granby Road, #42. Due to a hiccup Department Heads have not responded with their recommendations on this application therefore, Councilor Krampits made a motion table so that department heads have an opportunity to forward their recommendations. Motion passed. ITEM #3 Application for a Zone Change from Residential C to Business A for 45,864 square feet of property located at Grove and Oak Street for the purpose of Commercial Building Parcel 147- 5F, 147-5G, 147-5 partial. Applicants Yves Demers, 885 104th Street, Vero Beach, FL Erik Kaiser, 12 Peterson Road, Palmer, MA 01069 Yves Demers and Glen Ladd were present at the meeting. Mr. Ladd explained that he is partners with the applicants and that he is proposing to buy out his two partners for the parcels in question to develop the land for his business which is currently located at 169 Grove Street. He is proposing to building a commercial building that will include his offices and other professional offices which will look similar to those proposed by the Mayor’s Office under the plan entitled “RiverMills at Chicopee Falls”. Motion made to approve. Committee vote 7 – 0 favorable. ITEM #4 Minutes – May 28, 2013. Motion made to approve. Motion passed. Meeting adjourned at 7:03 PM. 2
