4 TOWN OF CICERO TOWN COUNCIL MEETING MINUTES August 21, 2012 At 7:00 PM Call To Order: President Brett Foster called the meeting to order and gave the prayer. President Foster called for the roll call and the members of the Town Council were present or absent as follows: Present: Brett Foster Absent: Eric Hayden Jerry Cook Kay Hartley Dennis Schrumpf Declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Charlie Cambre, Park Superintendent Pat Comer, Street & Utilities Director Dave Hildebrand, Police Chief John Culp, Town Attorney Keith Bryant, Town Engineer Approval of Prior Minutes: Memorandum of Executive Session, August 7th 2012 - Mr. Schrumpf made a motion to approve the Memorandum of Executive Session, August 7, 2012. Ms. Hartley seconded, motion passed. Town Council Meeting Minutes, August 7, 2012, 7:00 PM – Mr. Cook made a motion to approve the Town Council Meeting Minutes of July 17, 2012. Ms. Hartley seconded, motion passed. Approval of Agenda: Ms. Unger asked to remove Ordinance 08-21-2012-2 Reduction of Amount Appropriated in the Cumulative Capital Development Fund stating that she has reconsidered this move at this time. Mr. Cook made a motion to approve the Agenda as amended. Mr. Schrumpf seconded, motion passed. Approval of Claims: Mr. Cook made a motion to approve the Claims as presented. Ms. Hartley seconded, motion passed. Petitions by Citizens: Ms. Carrie Campassi addressed the Council about things for kids to do in Town. Ms. Campassi stated that there use to be a skate park and it was gone and wondered if the glass (canning factory) could be purchased and possibly turned into an indoor skate park. Ms. Campassi also wondered about the waterfront property and if it could be turned into a community building. Mr. Cook addressed the two buildings stating that the glass factory building was for sale but the owners are not motivated and would not give the Town a price on any or all of the property. Mr. Cook stated that the waterfront property 1 is owned by four real estate companies and they were asking more than the Town had to allocate for this kind of project. Mr. Cook also informed Ms. Campassi that there was a recreation facility going into the Chaudion Auction Building in the future. Ms. Campassi inquired about fund raisers. Mr. Foster informed Ms. Campassi that to get involved in the community she might check out Friends of the Park or EDC. EDC is more business oriented. Mr. Foster briefly explained the Jackson Street Pedestrian Walkway project to Ms. Campassi. President’s Report: President Foster stated that the Council needed to change the meeting date of the November 6th Town Council meeting due to elections. After a brief discussion it was decided that the meeting would be held on November 7th at 7:00 PM at the Town Hall. Council Committee Reports: There were none Legal Counsel Report-John Culp: Mr. Culp stated he had a comment under the Water Ban in Old Business he would address at that time. Cicero/Jackson Township Plan Commission Report-Dan Strong There was nothing. Town Engineer Report-Mr. Keith Bryant – Mr. Bryant reviewed the following 1. Jackson Street Pedestrian Path – Mr. Bryant stated that as everyone knew the bids for the project all came in high and that all bids have been rejected by INDOT. Mr. Bryant said United was in discussion with the MPO regarding the possibility of the Town getting more funding for this project. There are two meetings in October, one on the 17th and one on the 31st. Mr. Bryant suggested that Mr. Comer and a Council member(s) attend these meeting. Ms. Unger and Chief Hildebrand will also attend. Mr. Bryant informed the Council that United will be working with the MPO and with the bidding contractor at no additional cost to the Town. United will be bringing a revised set of plans back to the Town when they have them ready. The goal is to have ready to bid out in the spring. 2. Stringtown Pike/Baseball Park Path – Will be discussed under Old Business. Old Business: Council To Award Bid For Stringtown Pike Path Project. Mr. Foster stated that the Council needed to award the bid for the Stringtown Pike Path Project. Ms. Hartley made a motion to approve the low bid of $193,000 by C.A.T Excavating, Inc. Mr. Cook seconded, motion passed. Mr. Bryant stated that he had a Notice of Award for Mr. Foster to sign and then there would be a contract. Mr. Schrumpf made a motion to allow Mr. Foster to sign the Notice of Award and the Contract. Ms. Hartley seconded, motion passed. Mr. Cambre stated that this project was made possible because of a grant from the DNR. Council To Consider Repealing Water Ban. Mr. Comer stated that they will have one water tower drained for cleaning and inspection on August 22nd. The other tower will be down September 5th for the same thing. Both 2 towers will be full over the Labor Day holiday weekend. Mr. Comer would like to keep the ban in effect until they are done with both towers just to be on the safe side. The Council said they would look at removing the ban again at the September 18th Town Council Meeting. Mr. Culp stated that a question had been posed to him regarding if the Town of Cicero had any authority to impose the water ban on Noblesville residents that used Cicero as their water utility. Mr. Culp stated that he had researched this and that in fact Cicero did have authority through him or through Mr. Comer the water director. The police did not have authority. Mr. Culp stated that after serving notice to the homeowner that Mr. Comer had the right to terminate water service if they continued to ignore the water ban. New Business: Council To Consider Ordinance 08-21-2012- 1 Reduction Of Appropriations For Rainy Day Fund. Mr. Schrumpf made a motion to approve Ordinance 08-21-2012- 1 Reduction Of Appropriations For Rainy Day Fund. Mr. Cook seconded, motion passed. Council To Consider Ordinance 08-21-2012- 3 An Ordinance Amending Section 94.22 of Chapter 90 of Title IX of the Cicero Municipal Code of Ordinances Dealing With Sidewalks. Mr. Culp stated that he has reviewed the ordinance and that it was passed unanimously at the last Cicero Jackson Township Plan Commission meeting. Mr. Cook made a motion to approve Ordinance 08-21-2012- 3 An Ordinance Amending Section 94.22 of Chapter 90 of Title IX of the Cicero Municipal Code of Ordinances. Mr. Schrumpf seconded, motion passed. Council To Consider Resolution 08-21-2012-4 Transferring Funds For The Plan And Park Budgets. Ms. Hartley made a motion to approve Resolution 08-21-2012-4 Transferring Funds For The Plan And Park Budgets. Mr. Schrumpf seconded, motion passed. Miscellaneous Ms. Unger informed the Council that she gave them this evening a copy of the appropriated budgets for 2013 as have been discussed by the Council. She asked that they review and get back with her as soon as possible if there are any changes. Ms. Hartley inquired about the re-districting. Ms. Unger said that she had received information from Kathy Richardson in Voting at the County and Ms. Unger stated that she would like to have a committee to work on this. Mr. Foster appointed Jerry Cook, Kay Hartley, Steve Peachey and Ms. Unger. Mr. Cambre reminded the Council of the Chili Cook-off on September 15th and stated that he needed judges. Additionally, Mr. Cambre said that on September 3rd he will have the rod run at Red Bridge Park. Comments By Citizens 3 Mr. Murphy informed the Council of the Cicero Food Drop at the high school being done by Gleaners Food Bank and Good Samaritan Network next Thursday, August 23rd at 3:00 PM. Mr. Murphy stated that the drop in July was very successful. Signatures on Official Documents! Motion To Adjourn: Ms. Hartley made a motion to adjourn. Mr. Schrumpf seconded, motion passed.
