TOWN COUNCIL MEETING MINUTES
October 2, 2012
At 7:00 PM
Call To Order: President Brett Foster called the meeting to order and gave the prayer. President
Foster called for the roll call and the members of the Town Council were present or absent as
follows:
Present: Brett Foster Absent: Kay Hartley
Jerry Cook
Eric Hayden
Dennis Schrumpf
Declared a quorum present.
Others Present: Jan Unger, Clerk Treasurer
Dave Hildebrand, Police Chief
Steve Peachey, Fire Chief
John Culp, Town Attorney
Dan Strong, Cicero/Jackson Township Plan Commission Director
Brett Morrow, President of the EDC
Cicero Town Council Adopt 2012 Budget Ordinance Number 10-02-2012-1
There was a brief discussion and then Mr. Hayden made a motion to approve Ordinance
Number 10-02-2012-1 for Appropriations and Tax Rate for the Town of Cicero’s 2013’s
Budget. Mr. Schrumpf seconded, motion passed.
Approval of Prior Minutes:
Memorandum of Town Council Executive Session, September 18, 2012, 6:30 PM –
Mr. Schrumpf made a motion to approve the Memorandum for the Town Council
Executive Session on September 18th, 2012 at 6:30 pm. Mr. Hayden seconded, motion
passed.
Town Council Meeting Minutes, September 18, 2012, 7:00 PM – Mr. Hayden made a
motion to approve the minutes of the September 18th, 2012 at 7:00 pm. Mr. Cook
seconded, motion passed.
Memorandum of Town Council Executive Session, September 19, 2012, 8:30 PM –
Mr. Schrumpf made a motion to approve the Memorandum for the Town Council
Executive Session on September 19th, 2012 at 6:30 pm. Mr. Cook seconded, motion
passed.
Approval of Agenda:
Mr. Cook made a motion to approve the agenda as presented. Mr. Schrumpf seconded.
Mr. Hayden inquired if we should a discussion regarding a request from
Ciceroweather.net. It was decided they should. Mr. Cook made a motion to rescind his
motion. Mr. Schrumpf seconded, motion passed. Mr. Cook then made a motion to
approve the agenda as amended. Mr. Schrumpf seconded, motion passed.

Approval of Claims:
Mr. Cook made a motion to approve the claims as presented. Mr. Hayden seconded,
motion passed.
Petitions by Citizens:
Darren Collar, Cicero Fire Battalion Chief, addressed the Council and informed them that
on October 27th the Fire Fighters would be having a Co-Ed 6 on 6 Volleyball Tournament
Campaign for Breast Cancer Awareness. Battalion Chief Collar invited the Council or
anyone to put together a team to support Breast Cancer Awareness.
President’s Report:
Nothing.
Council Committee Reports:
1. Mr. Schrumpf informed the Council that he and Ms. Unger represented Cicero at the
Hamilton County Leadership Academy session on local government. Mr. Schrumpf
gave the attendees a perspective on small towns. Other communities represented
were Carmel, Noblesville, Westfield, and Fishers.
Legal Counsel Report-John Culp:
Mr. Culp had nothing.
Cicero/Jackson Township Plan Commission Report-Mr. Munoz
Mr. Strong stated that the next Comprehensive Plan Meeting would be October 27th,
2012.
Mr. Munoz had asked the Council if they would discuss allowing him and Mr. Culp to
meeting with a representative of NRG. Mr. Culp stated that he had met with Mr. Munoz,
Chief Hildebrand, and Chief Peachey regarding the violations at NRG. There was a
discussion regarding who should be on the committee. Brett Morrow stated that Mike
McConnell and Steve Decatur were both here this evening and they were very interested
in what could happen there. The Council had another discussion and then appointed
Chief Peachey, Chief Hildebrand, John Culp, Paul Munoz, Mike McConnell, and Steve
Decatur to meet and talk with a representative from NRG>
Town Engineer Report-Mr. Keith Bryant –
Mr. Bryant was at the IACT Annual Meeting and not available this evening.
Old Business:
Council To Consider Additional Expense With Fire Station Repair.
Fire Chief Peachey explained to the Council the issue with the plywood under the façade.
Chief Peachey stated that the old plywood was in bad condition and cannot be left on the
building. The cost to replace the plywood is $4,100. Ms. Hartley stated that the Town
should pay for the repair. Mr. Hayden stated that thought the Fire Department should pay
for the additional. Ms. Hartley stated that she thought the Fire Department needed to
have money back for emergencies if necessary and possible furnace repair. Mr. Hayden
stated if that was the case then no money should be transferred out of those lines for
overtime. Ms. Hartley made a motion for the Town to pay the $4,100 for the additional
repair. Mr. Cook seconded, motion passed.

New Business:
Town Council To Discuss Ciceroweather.com.
Mr. Hayden stated that the received an e-mail from Mike Berry who is maintaining Cliff
Nicholson’s CiceroWeather.net website. Mr. Berry wants to add some additional
WebPages that include some community event or announcement pages and links
originator of the information. Mr. Berry wanted to know if that would be okay with the
Town of Cicero. There was a brief discussion and then Mr. Hayden made a motion to
allow Mr. Berry to add information from the Town to their site. Mr. Cook seconded,
motion passed.
Town Council To Consider Ordinance 10-02-2012-2 An Ordinance Amending the 2011
Salary Ordinance.
Ms. Unger explained that this was a bookkeeping issue. Mr. Cook made a motion to
approve Consider Ordinance 10-02-2012-2 An Ordinance Amending the 2011 Salary
Ordinance. Mr. Schrumpf seconded, motion passed.
Town Council To Consider Ordinance 10-02-2012-3 Amendment To The Town’s Personnel
Policies Handbook.
Ms. Unger explained that this change in when a new employee was eligible for insurance
was needed to comply with the requirements of IACT Medical Trust who provides our
health insurance. Instead of a thirty day waiting period a new employee is eligible on the
first day of employment. Mr. Schrumpf made a motion to approve Ordinance 10-02-
2012-3 Amendment to the Town’s Personnel Policies Handbook. Mr. Cook seconded,
motion passed.
Miscellaneous
Comments By Citizens
Mr. Mike Murphy informed the Council that on October 5th the Hamilton Heights second
graders would be visiting the Town. Mr. Murphy stated that this was a great opportunity
for the children to see how the Town operates.
